DoPT has issued a new circular for strengthening the implementation of RTI Act. Some of the suggestions given are: 1. Annual reports submitted by departments should contain a chapter on RTI including information like number of applications received, number in which information denied, novel efforts made for RTI implementation, etc. 2. Each Ministry/Department/subordinate offices/PSUs/etc. to organise at least one half day training session for PIOs/FAAs - every year 3. Members might be aware that DoPT had issued a circular on 01 June 2009, based on a judgement of the Bombay High Court, regarding questions in a RTI applications - those starting with "WHY" . Now, DoPT has issued a circular clarifying the earlier circular. The clarification is self explanatory. Both the earlier circular and the new clarification, are attached to this post. RTI cell in Ministries Rs 50000 grant

DoPT had set up a "RTI cell" in its office and this had resulted in a better system for handling RTI applications. Based on this experience, DoPT has now recommended that Ministries/Departments set up similar "RTI Cells". For this purpose, it has agreed to give a one time grant of Rs 50,000. The Government of Maharashtra (General Administration Department) has issued a new circular replacing all earlier circulars in this regard. It declares that anti corruption committees will br formed at state, district and taluka (Tehsil) levels. The committees will have usual suspects like departmental heads from revenue, ploice, co-operation, forest, PWD, ACB, as ex-officio members, and upto 10 non-governemtn members. In the Minutes of Meeting of CIC held on 12 August 2008, item No. 6 deals with the the procedure to be followed while imposing penalty on PIO and its in corporation in the CIC (Management) Regulations 2007: 6. DoPT has issued a Office Memorandum (OM) Nr. 12/9/2009-IR dated 24 May 2010 wherein it has clarifed that "additional" fees have to be only as per prescribed rules and no additional fee can be charged for postal expenses or additional manpower, etc. The copy of the OM is attached to this post. Members should note that this will be applicable only to PA's under the centre, unless the nodal departments in each state also issue similar circulars, if there is no provision of such types of additional fees in those States. DoPT has issued a circular No. 1/14/2008-IR dated 28 July 2008 clarifying that PIO's cannot "designate" other officers as PIO's using Sec 5(4) and 5(5). It is the duty of the PIO to obtain information from other officers and provide to the applicant. The RTI Act enables the PIO to seek assistance of other officers (deemed PIO's) to enable him to provide information to the information seeker BUT does not give him authority to designate these "other" officers as PIO's. In a circular dated 01 June 2009, DoPT has informed various authorities about a Bombay High Court (Goa Bench) decision which has stated that: "The definition of information cannot include within its fold answers to the question "why" which would be same thing as asking the reason for a justification for a particular thing. The public information authorities cannot expect to communicate to the citizen the reason why a certain thing was done or not done in the sense of a justification because the citizen makes a requisition about information. Justifications are matter within the domain of adjudicating uthorities and cannot properly be classified as information. " …

In a Circular No. F.10/9/2008-IR dated 5th December 2008, DoPT has warned PIO's and PA's that non acceptance of DD/BC/IPO in favour of "Accounts Officer" as payment of application fee under Sec 6(1) of the RTI Act tantamounts to refusal of the RTI application. DoPT has issued two similar circulars (one each in respect of CIC and SIC's) clarifying that inter alia that there is no provision in the RTI Act for constitution of benches. It seems that the Department of legal affairs has also opined that under Sec 12(4) and 15(4) the Chief Information Commissioners of CIC and SIC do not have any powers to constitute such benches. Based on a CIC observation during an appeal hearing, DoPT has now clarified its earlier circular on Sec 6(3) and "collection/creation" of information: The undersigned is directed to clarify that the OM dated 12.6.2008 does not propose to say that collection of information per se amounts to creation of information. The above referred statement has been made to emphasize that the public authority to whom the application is made is not required to collect information from different public authorities to supply it to the applicant.
