What is contained in confidential reports is undoubtedly ‘personal information’ about that employee. The ACRs are protected from disclosure because arguably such disclosure seriously harm interpersonal relationship in a given organization. Further, the ACR notings represent an interaction based on trust and confidence between the officers involved in initiating, reviewing or accepting the ACRs. These officers could be seriously embarrassed and even compromised if their notings are made public. There are, thus, reasonable grounds to protect all such information through a proper classification under the Official Secrets Act.

I intend to start this discussions where we can suggest points for improving the RTI Act and it's usage amongst citizens and Government. There are no provision for review either in RTI Act 2005, or in Punjab State Information Commission Management Regulation 2009. State Information Commission (SIC) Punjab rejecting all review petetions of general public stating - "No provision of Review". Often it happens that the PIO and / or the FAA provide false statements in the second appeals before the information commission. The appellant often feels helpless in such cases. However, there is a legal way to make such recalcitrant PIO and / or the FAA to be accountable under the law. I suggest to collect total number of decisions delivered in 2007-08 [01-04-2007 to 31-03-2008] and total expenditure incurred in the same period by CIC/SICs. This will give per decision cost to the public. Since it would not be possible to single-handedly collect these details through RTI for at least 20 SICs, I invite other members from different states to cooperate with me. I would be drafting RTI query which may be included in RTI appln form if any prescribed by concerned state. The data will reveal interesting facts and will be released to press and posted to state/central govts for corrective steps. Pl comment.

Dear RTI Activists, For many years now I have known that most of the ICs of TNSIC never issue decisions as per the RTI Act. They always go easy on the PIO who did not even care to reply even after first appeal and up until the commission issues a notice. Though I have successfully penalized many of them but in more than 50% of the cases the ICs don't apply penalties even after multiple reminders... The option of going to the High Court, as you all know, is expensive given that these matters are simple.
