What is contained in confidential reports is undoubtedly ‘personal information’ about that employee. The ACRs are protected from disclosure because arguably such disclosure seriously harm interpersonal relationship in a given organization. Further, the ACR notings represent an interaction based on trust and confidence between the officers involved in initiating, reviewing or accepting the ACRs. These officers could be seriously embarrassed and even compromised if their notings are made public. There are, thus, reasonable grounds to protect all such information through a proper classification under the Official Secrets Act.

We all speak of registered post and registered A.D. in most RTI discussions. I would like to know which is preferred. As per my understanding, registered post does not provide acknowledgement, but can be tracked, while registered A.D. can be tracked and also provides an acknowledgement of delivery. Everything good so far. The question is , how do we prove that the copy we hold with us is the one we sent to the recipient. The recipient may actually say that the envelope was delivered but there was nothing in it, or claim it was just some text. There are no provision for review either in RTI Act 2005, or in Punjab State Information Commission Management Regulation 2009. State Information Commission (SIC) Punjab rejecting all review petetions of general public stating - "No provision of Review". On another discussion, I mentioned "digital IPO", by which I meant eIPO. To test this one, day before yesterday, I registered at eIPO site. Date of Birth is compulsory for registration - Not sure what they do with this info or where it is stored securely. For Indian citizens, both e-mail and mobile number are compulsory for registration. Many UGC recognised private universities are refusing to provide information under the RTI act by claiming that section 2(F) is not applicable to them. Many also get injunctions from courts and refuse to provide information when asked to do so via the UGC. Complaints to the CIC seem to go both ways. Examples of such universities include the Vinayaka Mission, Sikkim Manipal and Others. The provisions of the RTI act should be applicable to all educational bodies. Any dissent should automatically result in derecognition. I think the act needs to be revised to include this provision.

Hi, Wrt the current state of Andhra Pradesh Information Commission, without a State Information Commissioner or any other Information Commissioners, I would like to know the procedure that is to be followed in general to fill these vacancies, whose responsibility it is to do so and whether it can be expedited in someway - considering the fact that without time-bound responses, escalations and court appeals, the very purpose of RTI Act is defeated. Keeping it in such a comatose state might help the governments in power, with nobody to question their wrongdoings and misappropriation of public funds but not the common man or the state. -Lx

Often it happens that the PIO and / or the FAA provide false statements in the second appeals before the information commission. The appellant often feels helpless in such cases. However, there is a legal way to make such recalcitrant PIO and / or the FAA to be accountable under the law. In such cases, if such false statement(s) made by the PIO and / or the FAA is / are recorded in the decision made by the information commission, then such decision of the information commission can be used as a basis for making a private complaint by the appellant before the jurisdictional magistrate court, for an offence under section 177 of the Indian Penal code, 1860.
