There appears to be CONFUSION in the questions

1.Copy of existing recruitment rules of various posts can be supplied as it is INFORMATION available.

2.Copy of PROPOSED RECRUITMENT RULES will be available in the form of INFORMATION only when they come into use in which case the old recruitment rules will get MODIFIED/Nullified.

3.Dates of receipt of applications etc., will arise only when ADVERTISEMENT IS ISSUED TO THE NEWS PAPERS calling for applications

Every recruitment rules will not be notified in GAZETTES

Sir RR as Per Dopt guidelines will take 1year by dopt & 4-6 weeks by upsc for processing it but our existing RR took more than 10years that too after going for a court case.. & proposed RR is still in progress after passing of more than 6 years.. Thats why i am asking for dates through RTI. Sir is there any other way pls help.

If you wanted to know WHY THEY ARE TAKING SO MUCH TIME PROBABLY you may not get any reply, as PA can provide information that is actually appearing in their records.

PRASAD GARU,framing recruitment rules arise ONLY WHEN A NEW CATEGORY OF POSTS ARE SANCTIONED BY GOVT. for all the regular posts Recruitment rules do exist and if needed anytime govt. may add one or clauses or remove but NO FRAMING OF NEW RECRUITMENT RULES EVERY TIME.The thread starter was asking about CHRGEMAN etc., which are available posts in workshops,Railways ,Naval etc.,His querry appears to be NOT CLEAR.

You appears to be NOT CLEAR about RRs which will be already in force for all the CATEGORY OF POSTS with every central govt.organisation./ department and only WHEN A NEW TYPE OF POSTS are sanctioned by govt. then only NEW RRs will be prtepared for that post and the EXSISTING RRs also can be altered /Modified/Amended but very year/Time new rrS WILL not notified.This practice applies to all CENTRAL GOVT.DEPTS.Please ask specific querry so that you will get SPECIFIC REPLY/CLARIFICATION from senior members.

there was post of chargeman-II & Chargeman-I pre 6th Central pay commision, post 6th CPC these posts has been merged & designated As CHARGEMAN for which Recruitment Rules(RR) has to be ammended but till this has not been amended around 6 years has passed.

rules for promulgation of RR says :

CONSULTATION WITH DOPT

2.4 Ordinarily, the draft Recruitment Rules will be returned by the Department of

Personnel & Training with their comments, within a month from the date of

reference to that Department. If the circumstances of a case require more time for

scrutiny / discussion, the administrative Ministry / Department will be informed of

the same and where there are many points for clarification, the Ministries may also

be requested to discuss the case with the officers of the Department of Personnel &

Training.

CONSULTATION WITH UPSC

2.5 After obtaining the concurrence of the Department of Personnel & Training,

the Administrative Ministry / Department should refer the draft Recruitment Rules

for posts/ services which are within the purview of the UPSC in a self-contained

letter to the Commission, along with the information in the prescribed proforma

(Annexure II). It should be stated in the letter to the Commission whether the

clearance of the Department of Personnel & Training (and also the Department of

Pension & Pensioners’ Welfare where required) has been obtained in respect of the

proposals in question. Where the procedure for consultation with the Commission

has been followed and information necessary for consideration of the proposal has

been fully given, it should be possible for the Commission to convey their advice

ordinarily within 4 to 5 weeks. If the Commission’s advice is not received within

this time, the administrative Ministry / Department may settle the matter by personal

discussion with the officers concerned in the Commission.

 

from the above para you can see that maximum possible time required for RR's is around 2 to 3 MONTHS only,but as a matter of fact it took around 10 long Years for promulgation of existing RR & RR after merging is stiil pending after 6 years..

 

I want to get this data,s (time Taken for promulgation) by RTI so that we can take a case against this.

 

our prospects have been delayed due to the delays in framing RR's. & i not asking the reason for delay i just want the time taken for processing the same.

Under the provisions of RTI Act,2005 can an applicant question(Ask) the department concerned or DOPT as to WHY THERE IS SO MUCH DELAY IN FRAMING RRs? This cannot come under INFORMATION U/S 2 (f) in any form and also amount to INTEROGATORY IN NATURE.Further as for the guidelines NO SPECIFIC TIME FRAME FIXED for finalising RRS and it always says SHOULD BE DONE EARLY.If you have got any such order with you ,you can post/quote that letter so that we can reply you.

If you have got DOPT guidelines as stated by you or atleast have the order No. you can post it.Generally govt.orders say it should be DONE EARLY and not specify TIME FRAME and thereby different depts.take their own sweet time.

Further can an applicant ask the CPIO 1.The reasons for abnormal delay in finalisation of RRs 2.Likel;y time when it will be finalised etc.,in my OPINION cannot amount to INFORMATION U/S 2(f) and even if one file application can he get REPLY( USEFUL)(?

One cannot seek 'reasons' through a RTI application, but one can always seek 'reasons on record' through a RTI application.

 

Please find the definition of section 2(f) quoted below (emphasis added):

 

Section 2(f) "information" means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force;

 

Thus as per the definition of section 2(f), one can not only seek 'reasons on record' but one can also seek 'opinions' & 'advices' through a RTI application, provided they are held on the records of a Public Authority.

Can you please PROVIDE any such RULES/GUIDELINES FROM DOPT regarding time limit for finalising the RRs for the information of members and to give further reply to your thread?
