Yes. You can ask for rules and regulations. Punishment is imposed after employee received EO Report, after his submissions, and after appeal rejection. If the past record is good depending on the circumstances a lenient view may be taken depending on the circumstances and gravity of violation. The query may be styled as

Please provide copy of disciplinary rules and regulations that empower the authority to impose various punishment in case the charge is established in in the inquiry conducted and after submission of EO report and on obtaining submissions on EO report by employee.

[1] An RTI Applicant shall not ask questions to the public authority, eliciting answers from the PIO, but shall pinpoint some information available in material form.

 

[2] Moreover, it is now a well settled law that the information with regard to charge memorandum and punishment etc are "personal information" and thus qualified for exemption from disclosure under Sec-8(1)(j) of the Act.

 

[3] imposing more than one punishment for the same offence arising out of same cause of action is not permitted under the disciplinary rules. If such punishments are imposed, after exhausting the departmental remedy, please consult a good lawyer and challenge it before appropriate Court of Law.

Drafting queries for seeking information is the most skilful part of drafting a RTI application, one can seek all the information that one requires merely by rephrasing one's questions in such a way that it points towards documents held by a Public Authority.

Any act or omission of the work supposed to be done by Govt. is defined by the documents held by a Public Authority, and therefore the answers to almost all the questions that you have in mind can certainly be found in the documents held by Public Authority.

      An RTI was filled by me on 19.11.18 to PIO to finance Department as enclosed herewith, Now PIO has replied that since you have asked certain questions in the disguise of  seeking information under RTI act. Asking the question is not covered under definition of "Information" as provided u/s 2(f) of the RTI act. Therefore the Questions asked by me can not replied under RTI Act 2005.
      Further PIO says Nonetheless I may visit the office of S.O.(Civil Establishment-II) inspect the concerned file on any working day between 03:00 pm to 04:pm and identify the required papers/documents. Same shall be provided the photocopies of required documents after depositing the prescribed fee @ Rs.2/- per page.
      So please guide me the use of word "Weather" comes under the definition of question?
      PIO reply after 55 Days and not trying to deemed and denies the information.
      May please advice further course of action, as I am not interested to visit the office.
