Delay in Pension and Gratuity from BMC Health Department

Mam/Sir,

I Sneha B. Pednekar daughter of Mr. Bhagwan N. Pednekar wanted help regarding delay in pension and gratuity. My father got retired in May 2013 and still he is being delayed for the pension. At first the staff told that his record book was incomplete. Now after two yrs they say that there has being mistake ingiving him the salary when he was at BABHA Hospital as Liftman. Can you please help us with the deyails given.

BABHA Hosp is established and run by MCGM. If there is a mistake, they had 2 years time to rectify the it and settle pension of the retired employee.

 

First file a detailed representation with a request to arrange for pension immediately. After a month, follow it up with RTI Application and seek the

 

[1] Please inform me the action taken on my representation dated ...........

 

[2] Please supply me certified copy of the note sheet containing notings by various officials and decision of competent authority on my representation dated ............ regarding grant of pension.

 

[3] Please inform me the name, designation and office address(es) of officer(s) and staff who dealt with my pension papers from my date of retirement i.e. from ..........(date).

 

[4] Please inform me the name, designation and office address(es) of officer(s) and staff who are presently dealing with my pension papers and settle my pension case within reasonable time.

 

[5] Please supply me the reason on record for not granting me pension since my date of retirement i.e from ..................(date).

 

[6] Please supply me the certified copy of the citizens' charter stipulating the time period for settlement of pension of an employee retired from MCGB.

 

 

Simultaneously, please file another RTI application in the name of retired employee (your father) and seek the certified copy of his own Service Book - give full details such as designation, office from where retired, Staff/PF No. of the employee. From Service Book, it is possible to check if there is any anomaly during his service at BABHA hospital.

File RTI Application under LIFE & LIBERTY and specifically write on application that information is required within 48 hours as he is not having other source of income in absence of pension for last two years.

      Hi,
      Need some clarity on how to draft the RTI for the information asked; Alternatively, please advice what other course of action to pursue?
       
      Background:-
      Case of Illegal Recovery of Pension by Public Sector Bank  (thereafter referred as PSB)
      1) The PSB, the pension disbursal bank mistakenly overpaid the pension to the pensioner for 10 years;
      2) No connivance or misrepresentation from the Pensioner; solely a mistake done by the Bank. 
      The over payment was detected via a CAG Audit, and the mistake of the bank as well was pointed out in the same audit
      3)Now the PSB has started recovering the Pension since last 3 years, illegally.
      4)No recovery order or show cause notice has been ever issued to the Pensioner by the bank or any competent authority
      5)This recovery is illegal as per Apex Court judgement on Rafiq Masih's Case- 
      which states that no recovery can be done after 5 years of continual overpayment
      6) The Pensioner has been forced to go to the court to seek redressal. Case is stuck in the court for the last 3 years
      An RTI Was filed in May 2018/ Information sought and response received are as under:-
      Q-2) Provide the list of all officials and their designation who dealt with this pension matter during Dec 2006 to Dec 2007 at CPPC and PSB Branch
      Q-3) Name the officer who responsible for sanctioning the excess pension
      Q-5) Please provide number of cases in your bank wherein excess amount of pension is being recovered
      Response received (for all three questions, above) from CPIO: As informed by the Branch Manager of your branch : Information is not available
      Q-4) Name the officer who is recovering my excess pension
      Response received : The excess pension has been detected by the Performance Audit Team  under CAG and adviced via audit memo 36 dated XX 
                           to recover the amount of 10 Lakhs which is over paid since  1. 1. 2007. As such bank is recovering now and refunding the authority.
      My Comment on Q-4:
      It doesn't give the name of the officer who is recovering excess. Plus: The Audit Memo from CAG does not talk about recovery at- all. This has also
      been mentioned in the affidavit by the pension sanctioning authority in the court where it states that CAG has not issued any order of recovery. So this response is misleading.
      Unfortunately I was not able to file the First Appeal to the above response.
      Should I file another RTI ? Is re-drafting of the questions needed? The bank is hell bent on shielding its errant officials and protecting them.  Please feel free to advise me on any other course of action as deemed fit.

      Coimbatore, Dec. 26 (PTI): With abnormal delay in supplying LPG refills in the region, Coimbatore based Citizens' Voice Club has sought various details from the Indian Oil Corporation under the RTI Act 2005.
       
      The information sought includes number of dealers and connections under each of them, number of days taken by each dealer to supply refills to consumers on an average and action taken by IOC to reduce the gap, if the delay was widespread, club secretary, C M Jeyaraam said in a letter to IOC.
       
      The 'stoic silence' adopted by IOC over the attitude of LPG dealers has irked the public, who want to know whether it was consumer oriented or favouring the distributing agency, regarding supply of LPG, Jeyaram said in the letter, a copy of which was released to the press here.
       
      Despite highlighting the ordeal undergone by the public through the press and letters, there was neglible impact in streamlining the distribution of cylinders, the letter said.
       
      "Some dealers have the dubious distinction of flouting all rules and regulations. Unfortunately in practice LPG refills are not supplied even after 40 days from the date of the last supply," Jeyaraam alleged. Suggesting that records be verified to find out whether the dealers are following the numerical order in supply, he requested IOC to organise a consumers meeting to know the reality.
