Not received RTI repy even after one year of follow up

Hello,

I have file RTI seeking copy of application or DDR submitted at Sadar Police staton- Phagwara(Punjab).

 

But the officials their always gave answer come later. Sometimes they note my number and say we will call you. But even after more than one year I had not received any reply to my RTI.

 

I have also filed first appeal, but all in vain. First appeal also happens to be one year older.

 

Please guide me what to do in that case

Dear member, you may file complaint u/s 18 to the Information Commission to take action against the PIO. Also file a fresh RTI application with a request to provide information you want.

both your applications are time barred now to file second appeal with SIC -Pahgwara , the only option is to file a fresh application and after 45 days if there is no reply then go for first appeal and after 50-55 days no reply then go to second appeal and you are not required to visit PIO often and let him give his reply.

If you file complaint, you cannot seek relief of direction to supply information. As already suggested, file fresh RTI Application and seek - certified copy of document .............................................. Attach the Application Fee of Rs.10/- as per RTI Rules of your State. Submit the RTI Application by Speed Post Acknowledgement Due or Registered post acknowledgement due. Don't visit the police station. Don't give your telephone / mobile number. Let the PIO take a decision and communicate it to you by post.

 

In case, you don't receive decision of the PIO in 40 days time, you may file First Appeal before the First Appellate Authority. Refer your State RTI Rules for format, Fee (if any), for deemed denial. Even if you receive a reply and you are not satisfied with the information received or fee demanded, you can file first appeal.

 

If the FAA also do not respond to such First Appeal, please revert back to us with details for further guidance in filing Second Appeal before the State Information Commission.

RTI is a time bound process and if you had not received a written reply from the PIO then you should have filed a first within 60 days of the date of receipt of your RTI application by the PIO. Please do not go by oral conversations with the PIO but as far as RTI is concerned go by written responses.

 

Now instead of 60 days more than one year has elapsed and therefore kindly file a fresh RTI application once again, and this time around follow the time limits laid down under the RTI Act, and this time around if you do not receive a response from PIO within 40 days then within next 20 days (i.e. a total of 60 days) file a First Appeal before the concerned First Appellate Authority and likewise if you do not receive a response from the FAA then file a Second Appeal before the Information Commission.

      NEW DELHI: Delhi Sikh Gurdwara Management Committee has written to lieutenant governor Najeeb Jung asking him to exempt Sikh women from wearing helmets. To claim the exemption, they cited an RTI reply from Delhi Police as proof showing that no Sikh woman had died in a motorbike accident last year.
       
      Avtar Singh Sethi, president of Delhi Sikh Citizen's Council said that he had filed the RTI to the office of special commissioner (traffic), Taj Hassan. Traffic cops then asked them toapproach the district police who replied that no data of a Sikh woman being killed in a fatal accident was received by them.
       
      The groups also wrote to the LG asking him to exempt Sikh women from wearing helmets since it would be hurting their religious sentiments.
