Respected members, I made a police complaint regarding encroachment and pursued it through rti. The police came and took photographs of the site... How do I check what action the police has taken..... What to do so as to ensure that they don't get influenced and do their duty properly.

If sufficient time has passed, you can file another RTI.

 

Also, the actual action on the ground will clearly tell you what action has been taken.

You may also submit a detailed representation to the District Collector of the district and the Tahsildar of the Taluka where the land is situated and urge them to take action to evict the encroachments. Also attach the copy of police complaint. Address similar application to the Municipality or Municipal Corporation, if the land is situated in municipal area.

 

After reasonable time, say one month, you may file RTI Application and seek the note sheet indicating notings by various officials and decision of competent authority on your representation dated ........ with regard to eviction of encroachment from government land situated at .....................(give full details of land.)

police cannot intervene in encroachments as it is a civil case. only if there is fight between the two parties near the site then also they deal only with the fighting and not with encroachment.

First file RTI Application and seek information on action taken against your complaint and collect copy of FIR and photographs with due attestation and dates of such photograph taken. Please follow RTI rules and regulations applicable to your state for format and fees.

Removal of encroachment is not duty of police dept. It is Municipal Commissioner or Chief Officer who is responsible for removing encroachment. Hence you may submit papers and complaints sent to police dept to Municipal office with a covering letter. After a month follow up with Municipal office through RTI by referring:
