Under RTI can one ask details of a case in Hon.Family Court at Thane, Mumbai

Hello,

Hon. RTI experts,

Sir/s,

[1] Can a person get information on a case currently in progress at Hon. Family Court at Thane, Maharashtra, under RTI?

alternatively [2] Can a person get information on number of summons issued by Hon. Family Court at Thane, Maharashtra in a particular month?

If the answer is yes, then, (a) The RTI is to be addressed to which authority and who is the First Appellate authority? &

(2) The fee structure.

1. Yes if you are party to case. You can get it without RTI also by making application as per rules of court through an advocate.

 

2. Yes, you can get these details under RTI.

Just check in, now several courts are placing court proceedings in their website. This is a simple matter and you can personally meet concerned Bench clerk after 12.00 noon. on any Hearing date. He can immediately tell what ever is available in the docket. Further, they record the proceedings in suit file Register. That can be obtained under RTI Act.

But when you can visit personally, filing RTI application and expecting some thing to happen is a round about procedure.

(There is no fee structure exemption/concession under RTI Act to any senior citizen and State/central commission may accord priority in hearing and that is the only consideration for senior citizen. You need not worry about as to who is the PIO or FAA. Just address the application to State Public information officer (RTI) Family Court, Thane. Like wise First Appellate Authority (RTI).....

Further it is PIO's obligation to provide further appellate procedure with his information/denial.

You are advised to please read Maharashtra District and Subordinate Courts RTI Rules, before you seek such information under RTI. There is specific stipulation about court proceedings.

Thank you Sir, much obliged for an explanatory reply. I was not looking for any concession in RTI fees, I wanted to know the designations of the authorities to be approached for RTI application & Appeal. Your reply has satisfied my query. Thank you once again.

      Mumbai Cricket Association (MCA) is yet to pay their dues to Mumbai Police for the security provided in the last 17 matches played at the Wankhde Stadium in Mumbai.
      Mumbai-based RTI activist Anil Galgali had filed the query under RTI to Mumbai Police asking how much MCA owes to them for utilizing their services. Information provided to Galgali by the police department, raised everyone's eyebrows as amount has crossed Rs 13 crore.
      The Public Information Officer and Asst Police Commissioner (Coordination) Tanaji Surulkar provided the information compiled by the Bandobast Division that, including the 3 ICC World Twenty20, Women's World Cup, Test Match, Practice Match & One Day Match, 17 matches were played in Mumbai for which charged amounting to Rs 13,41,74,177, which is still pending for last 62 months.
      On top of it, police department has not charged interest to them. The working style of police department not charging interest to MCA has raised several questions.
