Madras HC seeks chief information commissioner's response on denial of info under RTI Act

MADURAI: A petition has been filed in the Madurai bench of the Madras high court seeking its intervention to get information under the RTI Act on the appointment of 23 district judges in Tamil Nadu.

 

 

In his petition, Madurai-based K Kathiresan said he submitted an application to the Madras high court registrar (administration), who is the public information officer (PIO), on November 25 last year seeking the copies of application forms and police verification reports of the 23 district judges (entry level) who were appointed in 2013.

It only shows the very pathetic situation of RTI act in the state of tamilnadu.We need court' intervention even to fine a PIO which is a rule of RTI to be followed by the SIC when information is not provided..i am only wondering on the amount of time and energy this RTI applicant might have spent so far and now he is back in the so called slow -paced judicial court..and we all know what happens next...the court adjourns it to a later late..and then ask the SIC to reply and then the SIC replies saying he will direct the PIO to furnish the information..and the cycle restarts all over again..nothing but delaying tactics..

MADURAI: The Madurai bench of the Madras high court on Thursday impleaded Tamil Nadu home secretary (courts) in a case relating to furnishing information under the Right to Information (RTI) Act on the appointment of 23 district judges in the state in 2013.

 

The court directed the government side to produce the police reports and application forms of the appointed judges before it. Read more at;

The court directed the government side to produce the police reports and application forms of the appointed judges before it.

      I require help on co-operative issue. I had filed the RTI with the PIO, Dy registrar of co-op societies seeking information on affairs of society.
      The PIO has replied stating that the information I am seeking is available with co-operative society. My query is:
      1] Can PIO direct an applicant to private body for information?
      2] The society in question comes under the jurisdiction of the PIO, since PIO is public authority and co-operative society a private body, is it not duty of PIO to seek information from society and give it to me? How can PIO direct me back to society? This is RTI application, either I have to appeal or I have to forego. I cannot complaint against reply. So I want to approach FAA, under what grounds can I?
      3] What kind of violation PIO has committed by directing me back to private society? 
      4] Does co-operative society come under the purview of RTI ACt?
      Your views are appreciated. I am fighting lone battle with corrupt system.

      Dear Sir/Madam, I am Syed khaja from Osmanabad Maharashtra. this is the response of PIO. in this response he is saying that "the record has been frozen/destroyed." So what should I have to do? kindly please help me in this regards.
