Refusal to accept RTI application by Law Department,Rajasthan

Sirs,

In my two years activity on RTI,for the first time, I have come across a situation where my RTI application by speed post to Law Department of Rajasthan has not been accepted by them. Indian postal department has returned with remark "न्याय विभाग ने लेने से इंकार अतः वापिस".

Please what need to be done next.

1. Take a picture of both sides of the envelope, where the remarks can be clearly seen.

Keep pictures carefully with you

 

2. Put the same envelope in another envelope and send it with a covering letter to the head of the public authority.

In that letter simply say that you file da RTI application and the department has refused to accept it. This is a gross violation of the RTI Act. Hence you are sending the returned envelope to the head of department so that he can send it to the correct person.

 

PS: Head of department will be Secretary or Principal Secretary (just check the website).

If you want, you can simultaneously lodge a complaint under Sec 18 with the SIC.

 

Send a copy of the complaint to the SPIO and the Head of the department

Only once it happened with me in CVC, but there was no use through follow up,. There is no record with CVC for providing such information as to who/when it was rejected, except the note of Postman, and CPIO/CVC has stated that remarks made by postman is not their record.

Sir,

Do you suggest me to try by physically handing over RTI with law department.

Alternatively, forward the application to FAA with complaint of refusal and simultaneously file complaint with state information commission.

Also file another RTI with same Law Department and see their reaction to it.

If second application is also not accepted, it will prove their intentions clearly.

Such things may happen rarely, as no one cares to sign and accept Tappals, making post man irritate and write the same and return back. (Some one might have said in bad mood, if PM insisted for acceptance 'Take back , if you can not wait".Irritated post man might have done the same way. There is neither loss to postman nor to dept., and unnecessarily innocent citizen is running from pillar to post. Remember, even letters filed by Courier are being returned like that, as courier boys are not generally allowed inside and they will throw them in the box meant outside the office for the purpose.

We have to blame for our misfortune and focus on what should be done. Now file fresh application and this is the only alternative. You may raise the issue that your RTI application was rejected and enclose the cover as informed by Hon.Karira. In first and second appeals also you may add this and enclose copies.

And also follow Hon.Karira's advice. My advice is additional precaution for getting information. Please do not address any RTI application with individual name of SPIO and always say SPIO (RTI). If one addresses envelope as Mr.X, SPIO,...if that Mr.X is transferred and Mr.Y is in his place, he may refuse to take envelope stating that it is addressed to Mr.X. (There can be hundred excuses for every lapse)

      The RTI Act provides for transfer of information u/s 6(3) if the information is/are held by other PIO/PIOs. I asked 15 infromations from the Ministry of Finance. Out of these 15 informations, 12 informations are to be answered by other ministries.Whether the Ministry of Finance is leagally liable to transfer the 12 informations to other PIOs u/s 6(3) of the RTI Act. The inance Ministry refused to act as persec 6(3) of RTI Act saying that they can not do the Postman work of others.What is the position with regard to this aspect.

      Hi everyone,
       
      I have a confusion whether PIO at RPO (Regional Passport Office?) would also be able to give information about application which is stuck at the police department for verification?
       
       
      If I check the status of my application at the "http://passport.chd.nic.in/" it tells me the status as "Police Report has not been received."
      I wonder if RPO would be able to do something about it, or shall i have to write a different application addressing to different PIO who can get me information from Police Department.
