Want to know related to pvt hospitals

There is one pvt hospital in my knowledge which has set its own protocol for inpatient . This hospital asked to every admitted patient that patient need to get HIV test if they want treatment in their hospital if the patient denied for this test than hospital denied to admit the patient. In short hospital forced the patient for this test. When anyone asked no...hospital said this is government rule. And the same hospital declared that this patient has critical disease like cancer HIV etc in its lab report. But the same disease reports come negative in Central Government hospital. What action can be taken against that hospital which gave wrong report of disease.

Can we make any complain or use RTI on the above condition. If yes please tell me what to do and how to do ?? I will be very grateful to your quick response.

RTI is as information seeking procedure and can not be a complaint, redressal grievance mechanism .

This is a fit case for first complaining to District Medical Officer as immediately as possible with such proof of documents, and waiting for a month, taking all evidences and then filing complaint before District Consumer Forum for deficient services and harassment of general public.

Dear member,

Kindly file a written complaint in detail and point wise addressed to health ministry with a copy to the District Health Officer and submit it in registry branch of concerned authority or alternatively mail it by Speed Post, track its delivery status on internet and take a print out when the status shows delivered and preserve it as a proof of delivery of your complaint.

 

Wait for say 15 days and then file a RTI application to seek information on the action taken status of your complaint by referring to the blog on the following link (enclose along with such a RTI application, a photocopy of the complaint as well as the postal track report as a proof of delivery of your complaint.)

It would be advisable to make a joint complaint along with few other victimised persons/patients of the area, with copy to ... In democracy numbers count.

If you have any evidence which can prove that report of medical test issued by said private hospital's lab is fake/false then you can file a complaint to police.

At the cost of repetition:

 

[1] File detailed complaint with documents to the Deputy Director of Health Services of your district or any equivalent officer of the District.

 

[2] File a detailed complaint to the Secretary, Ministry of Health (or Health & Family Welfare etc ) of your state.

 

[3] File a Complaint in jurisdictional police station (as suggested).

 

In all the above 3 cases, you can follow up after a month by filing RTI Applcation with the respective PIOs and seek:

 

[1] Certified copy of the note sheet indicating notings by various officials and decision of competent authority;

 

[2] Certified copy of the investigation report and findings on the alleged illegalities committed by the hsopital;

 

[3] Certified copy of documents indicating the steps taken to prevent recurrence of such incidences and criminal negligence on the part of the hospital in question.

      Owing to the indifferent attitude of the authorities, the ultrasound machine installed at the local General Hospital has been non-functional for the past 34 months and no effort is being made to get it repaired.
       
      The issue came to light when a local resident, Mr Manoj Kumar Aggarwal, sought information regarding the machine from the hospital under the Right to Information Act. The information provided by the authorities points towards the lackadaisical attitude of the hospital authorities.
       
      Mr Aggarwal, who has been taking cudgels against the high-handed and indifferent attitude of the authorities toward the general public in the past too, sought information from the hospital authorities regarding the ultrasound machine.
       
      The information provided by the authorities revealed that the ultrasound machine was installed in the hospital on September 28, 1999, and had not been in working condition since February 27, 2004.
       
      The information provided by the hospital authorities revealed that even during the period when the ultrasound machine was in working condition, there was no radiologist in the hospital and the one deputed from the General Hospital Hisar conducted the tests. The information revealed that earlier the hospital authorities had a contract with M/s Philips Medical Systems India Limited for the repair of this machine, but now there was no contract with any firm. To a question whether any request had been made to the company for the repair of the machine, the hospital replied that a request was made on November 29.
       
      Interestingly, Mr Aggarwal had given his application under the Right to Information Act on November 29. He was provided with the requisite information on December 4.

      We are having a private hospital.Can a advocate ask for a patients record and case paper under RTI act to lodge a case against us in court of law.Is RTI act is applicable to private bodies(hospitals).
