CIC orders CRPF Kadarpur, Gurgaon to provide information about Mandated FIRE NOC from MCG

Dear All,

 

I had sought information about mandated Fire NOC obtained by CRPF Complex, Kadarpur, Gurgaon from MCG Gurgaon. The CRPF replied that they are exempted for providing information under RTI Act 2005 as CRPF is exempted organization as specified in schedule II of Section 24 of RTI Act 2005.

 

Aggrieved by the decision of CPIO & FAA of CRPF in not providing the information concerning the life and safety of thousands of people living in and around Kadarpur CRPF Complex, Gurgaon which is not exempted under said section of RTI Act 2005.

 

The matter was argued before Hon'ble Mr. Vijay Sharma CIC of Central Information Commission, New Delhi who was pleased to order the furnishing of information at para 4) of undersigned RTI application

 

"The appellant referred to his RTI application of 19.07.2013 and stated that he was seeking information whether DIGP, Group Centre, CRPF, Kadarpur, Gurgaon, has taken N.O.C from fire department/Municipal Corporation, Gurgaon. The appellant said that he also wanted to know the process undertaken by the respondent for getting the N.O.C."

It has come to yours truly notice that CRPF Complex ar Kadarpur, Gurgaon does not have mandated Fire NOC as stipulated under Haryana Fire Services Act 2009.

 

This is victory of sorts and good precedent that security organization's can not hide crucial information involving the life and safety of masses under the guise of national security.

Thank You Learned Mr. Vidyaranya Sir for your kind words and yes it is correct to say that many a times these "exempted" organizations take advantage of the Section 24 of RTI Act 2005.

 

Thank You Learned Mr Manoj B Patel Sir, it is indeed a good precedent that in the name of exemptions, one can not take blanket cover of exemptions.

The success always lies on focusing the point on larger public interest. When Hon. Hd has stated life and liberty / well being of Public, IC can not overlook it, if something happens later, this may figure once again stating his inaction. IC is smart and could not defend CRPF as the strength in the issue is more stronger.
