Hello,

Sirji, One of applicant has submitted his grievance to the effect that his deceased father was renowned poet and on his death; he was getting contractual agreement regularly upto 2014. Now-a-days he is not getting contractual agreement for talk. He has sought RTI application stating 'PROACTIVE DISCLOSURE" INFORMATION. Does it falls under PROACTIVE DISCLOSURE? Under what section and is the information is exempted for necessary FEES to be paid? and PERIOD OF TIME LIMIT for submitting details is what? kindly guide... THANKS, TUSHAR CHOLERA

This matter is not under proactive disclosure mandated by RTI Act. Only holders of BPL card are exempted from filing fee and other expenses under RTI Act. Information has to be supplied within 30 days from date of receipt of RTI application. If you are PIO, please study links on home page of this portal and peruse RTI Act.

Also, if you are a PIO then kindly click on the following link and go through all the provisions of section 7 of the bare RTI Act titled "Disposal of Request", it lays down the procedure for the disposal of a RTI request in detail.

Can you please reproduce the exact RTI application so that our members can clearly understand the situation ? You can delete personal details from the application.

      Facts:
      The appellant had sought certain information which are furnished by the member companies and are available with the respondent in fiduciary capacity.
      The CPIO has denied the information on the ground that the information sought has no relation with public action or interest. The CPIO has also mentioned that the appellant has filed a complaint against the companies whose information are being sought. He has therefore contended that disclosure of information would impede the process of investigation. He has thus soughtexemption u/s 8(1) (h) of the Act. Commission’s Decision:
      Information sought relate to the personal information of third parties, the disclosure of which do not fall under public domain. As such, there is no overriding public interest in disclosure of information sought, which is exempt u/s 8(1) (j) of the Act.
      The appeal is accordingly disposed of.
