Despite several Right to Information (RTI) pleas filed by activists, the CIC has not released the educational details of the Prime Minister. Although, Modi claims to be a post-graduate in Arts from Gujarat University, critics allege that he has hardly completed his SSC.

The Central Information Commission (CIC) on Friday directed the universities of Delhi and Gujarat to provide proper responses to RTI applications seeking details of education qualification of Prime Minister Narendra Modi.

 

Information commissioner M Sridhar Acharyulu directed the Prime Minister’s Office to make available details such as roll number and degree number of the Prime Minister to the Delhi University so that the commission can search the records and facilitate disclosure of information to RTI applicants.

In the order, the CIC also makes it clear that it was not imperative for the Prime Minister to reveal details of his educational qualification. The order states:

 

"Just because the public is interested in it, it does not mean that it is in public interest. There is no educational qualification prescribed for contesting any electoral position under law. The election to Lok sabha or Prime Ministership cannot be questioned on the point of educational qualification."

 

Despite this contention, the CIC goes on to order the Prime Minister's Office to furnish relevant documents because:

 

"When a citizen holding the position of Chief Ministership wants to know the degree related information of the Prime Minister, it will be proper to disclose. Hence, the Commission requires the PMO to provide specific number and year of the degree and PG degree to the Delhi University and the Gujrat University offices."

What a "You scratch my back and I scratch your back" publicity stunt !

 

1. Where is the RTI application ?

2. Was the application accompanied by the application fee in prescribed mode of payment ?

3. Was it sent/submitted to CPIO ? (IC SA surely knows the CPIOs of the PAs mentioned !)

4. Is IC SA a post office ? To send letters received by him to other public authorities ?

5. How come Arvind's letter dated 28 April is diarised, sent to the ICs DO, seen by the IC himself and also acted upon before noon on 29 April 2016 ? Ever seen CIC working at such speed ?

6. What happened to the others in the "queue" - waiting for orders from CIC for 3 or 4 years?

7. Is Arvind a Senior Citizen or a differently abled person - so as to get priority and leave others waiting in line to scratch themselves ?

8. IC SA is in the CIC. The CICs powers are limited to the public authorities under the Central Govt.

How come he is sending directions and orders to a public authority under the State Govt. ?

 

If IC SA thinks Arvind will oblige him with the Delhi Govt Lokpals position, he better think again. Arvind is known to ditch everyone sooner than later.

The person who claims to be behind RTI in India and its so called Champion, does not read it.

The Info Commissioner, who passes orders does not read it.

That only leaves the few Dumbos like me, who care to read it !

After long time, Super Moderator making re entry with a bang.

The applicant (?) information seeker is a renowned RTI Activist.

The Decision is from a Law professor.

So, one can not question the actions and discretion of both these well known personalities.

No one can question as to how such letters ( Appeals ?) get a priority over other complaints/Appeals as Hon IC may have thought that larger public interest is there in knowing the educational qualifications of PM (according to him)

If it is the case of a simple application from a common citizen, the decision should have been otherwise ruling that appellant failed to provide correct/pinpointed file and for the sake of providing information, officials are not supposed to search and create information only because the applicant has asked and as there is no larger public interest.

Dare not comment on IC, as he can twist and bend the Act as he likes as a Professor and better than some ICs atleast sincerely hearing the appeals, without looking at his watch)

(I understand that during introduction of RTI Act, MPs' were not even capable of either opening or carrying the packet of provided material and most of those sealed packets were collected the next day by sweepers, and it gives an idea of the importance given for the Act)

Kejriwal on April 28 wrote a strongly-worded letter to Chief Information Commissioner M. Sridhar Acharyulu.

 

“According to some reports (details are attached), Prime Minister Narendra Modi is preventing the concerned department from releasing details about his educational qualification. Allegations are being made that the PM has no qualification and degree at all,” said the letter, written in Hindi, which also questioned the CIC’s autonomy.

 

Kejriwal in his letter said, “Nation has the right to know the educational details of the Prime Minister. His educational qualifications should be released in the public at earliest. The RTI Act gives us the right to know the qualifications of the person holding the position of the Prime Minister.”

 

Thereafter, the CIC treated this letter as an RTI application and directed the PMO to give Modi’s roll numbers to the universities so that they could find out the details of his degrees.

Suo motu powers of IC under RTI Act ? (or at par with PIL before HC ?)

Was PM elected on his educational qualifications ? When there was never such a demand during his successful tenure as Gujarat CM, why hue and cry now, particularly by another CM ?

Ak is not finding any other issues in larger public interest in the Country ?

Hon IC is not finding any political vendetta in this issue, whereas all his past decisions strongly condemned vested interests who seek information (insiders/retired/suspended employees) ?

When he can focus more on his Delhi matters, why so much interest on petty affairs in the guise of RTI , by well known Activist ?

Any common man can understand all this "nautanki".

(I do'nt know further proceedings and I think that this play is over. Tomorrow, some one may ask for his answer sheets also, hence GU has stated that all other records were destroyed ). I am also not aware as to the name of future Lokpal of Delhi. and whether CIC accepts every letter as RTI Application without fees, considering Ministers as below poverty line citizens, or whether there is a separate channel to decide on VIP issues)

(I am afraid that Hon Professor may order for filing criminal complaint for commenting on his decision (Contemp) , as he always invokes his powers of DJ as per CPC)

No doubt, PMO may not be having an idea, and it is Hon CJK that has pointed specific violations through his posts, because of which they realized belatedly all the violations. What happens next must be watched interestingly ? Do they take it very lightly ?

Even leaders in a party in Capital is not aware that Fee is mandatory for seeking information, and blame DU for returning the application by local speed post and there is a wastage of money. Where all this petty things lead to ? Now these very people either fail to respond to RTI queries or accuse act being misused. Have somebody assured them that he will personally verify records at the time of hearing ?

It was accompanied by a IPO of Rs. 10.00 - BUT the payees name was incorrect !

It was "Registrar, Delhi University".

Central RTI Rules dated 31 July 2012, clearly state that the payees name has to be "Accounts Officer, Delhi University".

So much for the RTI Champion's followers.

I publicly suggested to AK and the other 4 to become members of this portal so that we

can help them avoid such stupid mistakes in future !

 

On one hand its good that they are facing the same music which members of this portal face every day......

public authorities not publishing the name of payee on the payment instrument.

 

On the other hand it is sad that even 10 years after RTI Act, such famous, educated,

professionals in public life do not even know how to file a proper RTI application.

 

Just imagine the situation of a illiterate in some remote part of the country.

And same IC after this fiasco, wants to citizens to read and understand RTI Act in Public meetings. That also means that it is not enough that one must be powerful but also should acquire basic knowledge, though that serve are his friends.

Has no one filed RTI Application to CIC about the response of Professor to GHC notice ?

Whether GHC has decided further on the case or GU also lost interest as there is no response from CIC ?

Which is economical to GU to provide the information or approaching HC against CIC orders ?

What made Professor to give such directions knowing well of his powers and jurisdiction.

No answers for any of the questions.

The latest Face book comments that Every one is offering to donate Kidney to SS but no one is willing to donate Brain to AK.

The only doubt for a commoner is that whether IC can treat a letter written to him as RTI Application (without fees) and immediately deliver a decision. Except Political and publicity angle what larger public interest is involved has to be stated by Professor in his statement before GHC.

      New Delhi, Jan 20 (IANS) From a sports teacher to widow of a slain cop, five people from various walks of life were felicitated here Thursday for effective use of the Right to Information Act.
       
      The winners, including Vinita Kamte, widow of Mumbai Police officer Ashok Kamte who was killed in the Nov 26, 2008 Mumbai terrorist attack, were shortlisted from 726 applications received by the jury appointed by non-governmental organisation Public Cause Research Foundation, set up by RTI activist Arvind Kejriwal.
       
      The jury included Infosys chief mentor N.R. Narayana Murthy, former chief justice of India J.S. Verma, former chief election commissioner J.M. Lyngdoh and journalist Madhu Trehan.
       
      Manoj Kumar Karwasra, a sports teacher in Hisar district of Haryana, filed several RTI applications to expose how government land had been encroached by the panchayat members themselves.
       
      'I have great feeling now. It will boost my morale,' Karwasra told IANS.
       
      Mahiti Adhikar Gujarat Pahel, a helpline service for RTI queries which was launched in May 2006 and claims that it has received more than 60,000 calls till now, was one of the winners.
       
      Sadhna Pandya, coordinator of helpline, said the award will increase their responsibility.
       
      'We receive calls from across the country in various languages,' she said.
       
      Athar Shamsi, an advocate from Faizabad in Uttar Pradesh, was also honoured for fighting for the rights of the beedi workers who were not being paid their full wages by factory owners.
       
      The workers were allegedly paid just Rs.27-34 per thousand beedis made, as against the minimum wage of Rs.60.
       
      The other winners of the Best RTI Citizen award were Ramesh Kumar Verma from Haryana and Rajan Savlo Ghate from Goa. The Best RTI Journalist award went to Saikat Dutta of Outlook for exposing a Rs.2,500 crore-scam in rice exports.
       
      Pradeep Kumar from Bilaspur in Himachal Pradesh received the Best Public Information Officer award.

      Doda, Jan 20: Unidentified persons attacked an Right to Information (RTI) activist at Bhandoga area in Doda district on Monday.
       
      According to locals, Safdar Ali was assaulted by a group of men after he protested against the alleged misappropriation of funds in the construction of a village tank, which collapsed after few days.
       
      “Despite filing of FIR, police has failed to take any substantial action against the culprits,” Safdar Ali said.
       
      “We have documented seven recent attacks on RTI users and activists,” a communiqué issued by JKRTI Movement said adding the activists were facing severe threats from unscrupulous elements.
       
      “The government has a legal and moral responsibility to stop these attacks,” said Haq Nawaz Nehru, a prominent RTI activist.
       
      “We appeal to the Chief Minister, Omar Abdullah and Director General of Police, Kuldeep Khoda to intervene in the matter,” he said.
