“The manner in which Dr Dayanandan pursued the matter and exposed IOB’s high- handedness is admirable. It would remind the Moneylife readers of the late Sharad Phadke, who pioneered this fight in 2010 and inspired many citizens not to take this injustice lying down. (Read: Banks must pay Rs100 a day penalty for delay in reimbursement for failed ATM transactions).

Dr Dayanandan’s attempt to withdraw Rs861 from the ATM of Indian Overseas Bank on 21 January 2017 was unsuccessful, but the amount was debited from his account. As per rules, the customer can lodge a complaint within 30 days of the failed transaction. Dr Dayanandan did so the next day, on 22 January 2017.

Dr Dayanandan has not yet given up. He has filed another RTI application seeking information on action taken on IOB’s errant officers who handled his case. Similarly, in a letter to the Regional Manager, IOB, he has demanded, “As an affected person, I request to reply with the names, designations, official addresses of the bank officials responsible for the delay, the valid reasons of the delay, action taken or being taken against those officials responsible for the delay.’’

 

(Late Shard Padke at his age moved each stone for getting justice on ATM failures. He is our most valued member. It is a great loss for our forum.)

“If complaint filed, ask under RTI for:

- System of dealing complaints about failed transactions with copy of relevant instructions.

- Copy of citizen charter to be provided by the bank free of cost to each customer.(Available on web site too)

- Copy of grievance redressal policy & time line to deal with complaints filed by the applicant.

- Copy of Customers Compensation Policy.

(Hopefully, available on web site too)

- Total complaints received for transaction failure in last 3 years with total amount.

- No of Total complaints & amount paid with time taken.

- No of Total complaints & amount involved.

- Officers/ employees responsible to take on my complaint dated.........

- Action taken against errant officers who have not handled my complaint as per the laid down procedure.

 

The fee for the application is enclosed as Indian Postal Order/ draft/ NEFT/ RTGS/ other mode no ............ UTR no......... /Txn. No........ dated............

In grievance redressal policy, it was instructed that every officer who does not take action in time, he will place the matter to deciding authority along with the reason of delay without asking by superiors. If it is noticed in policy then a complaint may be filed again as

 

"a letter to the Regional Manager, ..........., & demand, “As an affected person, I request to reply with the names, designations, official addresses of the bank officials responsible for the delay, the valid reasons of the delay, action taken or being taken against those officials responsible for the delay.’’

 

FURTHER, A COMPLAINT SHOULD ALSO BE FILED WITH BANKING OMBUDSMAN. IF DROPPED, FILE APPEAL WITH DY. GOVERNOR & APPELLATE AUTHORITY AGAINST DECISION OF BANKING OMBUDSMAN REQUESTING HIM TO ADVISE BANK TO CLEAR ALL THE PENDING CLAIMS WITH INTEREST. THE APPELLATE AUTHORITY MAY BE REQUESTED TO SUBMIT REGULAR REPORT TO HIM UNLESS PEND-ENCY IS CLEARED.

 

IF THE MATTER IS TAKEN UP STRONGLY THEN CUSTOMER MAY FIND DIFFERENCE IN WORKING OF ATMs.

      I had sought details of loan and copies of agreement entered with World Bank, JICA etc. of IT Expressway Chennai (created in partnership with Govt of TN) However the PIO has replied that they have moved out of world bank loan and taken loan from other banks details of which cannot be disclosed under 8(1) d of RTI Act citing "commercial confidence".
      However the IT Expressway is a public limited company having entered into agreement with Govt of TN and others for developing and maintaining a particular stretch of road.
       
      Kindly help me frame a good first appeal.

      Hello,
      I require help on co-operative issue. I had filed the RTI with the PIO, Dy registrar of co-op societies seeking information on affairs of society.
      The PIO has replied stating that the information I am seeking is available with co-operative society. My query is:
      1] Can PIO direct an applicant to private body for information?
      2] The society in question comes under the jurisdiction of the PIO, since PIO is public authority and co-operative society a private body, is it not duty of PIO to seek information from society and give it to me? How can PIO direct me back to society? This is RTI application, either I have to appeal or I have to forego. I cannot complaint against reply. So I want to approach FAA, under what grounds can I?
      3] What kind of violation PIO has committed by directing me back to private society? 
      4] Does co-operative society come under the purview of RTI ACt?
      Your views are appreciated. I am fighting lone battle with corrupt system.
