School asking money for issuing Leaving Certificate

Hello,

 

My nephew just completed his 10th Class from IIS (Islamic International School) Mumbai. The school follows IGCSC board and we just learned that the school is not registered... Which would mean that the school is not in the position to issue Leaving Certificate and the school principal is demanding for 60,000 /- INR to get the leaving certificate issued from UK school... He is not ready to have any conversation and the more we delay he is adding more late fees... Here are a few questions that I have...

 

  • Can we take any legal action for the school because i believe that charging a big amount of 60,000 /- is not correct and Parents should not bare the cost...
  • How important is the Leaving Certificate? My experience is that LC would be needed only for college admission... Is there a way we can still get the admission in college without Leaving Certificate?

This forum is dedicated for seeking guidance on RTI Act, which enables any citizen as a right to seek information from Public Authorities. The school being a private entity is beyond ambit of RTI Act.

There is a certain remedy under CP Act.

Issue a Registered notice to school principal under CP Act as follows:

..............................

 

Mumbai.

 

 

This notice is being issued by ...............................s/o aged...................residing at............................, hereinafter referred as complainant.

 

Complainant 's son......................................... was a bonafide student of the school and passed 10th class in IGCSC Board examination with Hall ticket No.............

 

Complainant has personally called the principal on................. requested for issue of school leaving certificate and character certificate of his son.....................as complainant wished to join his son to a college, and these documents are mandatory.

 

Principal has demanded for Rs.60,000/- for issuing such certificate without any justification. Principal has also failed to show the rules and regulations that state the fees of Rs.60,000/- for issuing of a bonafide certificate. Complainant has paid all prescribed fees. Complainant has also shocked to learn that the school is not having any recognition and registration for functioning as a school as per laid down law.

Thus the principal has spoiled the career of the student and using tactics in demanding amount for a routine certificate without any such rule and justification and without recognition.

 

The complainant hereby demands for issue of such school leaving certificate within 7 days from date of receipt of this notice, failing which complainant will be forced to file complaint against school and management for deficiency of services, seeking compensation for harassment and misleading information on school recognition. Complainant is also exploring to take up the matter seriously with educational authorities for permitting such school without any registration, and for looting parents by demanding unreasonable amounts for routine work.

You can contact any college in person and explain the difficulty and find a suitable remedy.

Wait for a month and file a consumer complaint with District consumer Forum demanding compensation of Rs.25,000/- for harassment.

The total costs may not exceed Rs.500/- in all , if you file the complaint as a party in person. The only thing to be established is that the college has demanded money and not provided leaving certificate, which the registered ack notice establishes. The complaint hearing is summary in nature, will be decided in 180 days, and there is nothing to be argued except stating about demand of money and non issuance of such certificate. If you want more information on CP Act, purchase CP Act book for Rs.80/- and read the same.

 

Also file a complaint against school with DEO and to IGCSC Board separately.

      New Delhi, Mar 2 (PTI) Leaves availed during the service period are not personal and private matter of the employee and should be disclosed under the RTI Act, the CIC has held.
      "Leave taken by an employee from a public authority is a matter of exercise of the discretion vested in the public authority to grant such leave. There can be no bar on the disclosure of an information which is about how the public authority exercises its powers to grant leave to its employee,"the CIC said in its ruling.
       
      Information Commissioner A N Tiwari was hearing the plea of one Raj Kumar who sought information about the leave account of an employee of the New India Assurance Company Limited.
       
      The insurance company had rejected the application on the grounds that it was personal information of the employee, a third party, and could not be disclosed.
       
      "It cannot be said to be a personal or a private matter of that employee,"Tiwari said directing the insurance company to disclose the information within two weeks of the receipt of the order.

      My Boss is harassing me by many ways
      like not sanctioning of leave, incorrect pay fixation on revision of pay due to latest sixth CPC , using office machinery for personal use, like that
       
      My superiors at other station also helps him, may be because of some fear or do not wish to interfere in any other activities which are not framed.
