Clarification under RTI Act



Sir, I filed an RTI application to MAUD, AP seeking certain documents copies, the PIO informed me to remit the amount of Rs. 920/- + Rs. 200/- for receiving information. At this stage, can I request the PIO to copy the said information into a CD or DVD and send it to me under RTI Act, if yes then please inform me under which rti section I can request the same...

Remember, you can seek that information which is available as material in the form.

If the material record requested by you is available in electronic form, you are entitled to get that information in CD.

But if the information is available in hard copy as material record with that public authority,

because applicant has asked, PIO can not scan the document and convert to electronic form.

Hope it is clear, if that material is available in their system, you can seek such CD, if it is available in HC, you have to remit fees for xerox @ Rs.2/- per A 4 page.

PIO must inform such number of pages and calculation while demanding for RTI fees.

Members are not aware as to whether that information is available in electronic form or not,

and being one of the most experienced applicant, you ought to have prepared to pay that fees,

and now it is not proper to go back because they are charging actual costs from you.

The other alternative is seek information through inspection, take a digital camera, take photographs, and then convert those which are required as copies. In case of hard copies you can seek certified copies.

Unless, members are aware of the exact query, it is not possible to provide precise guidance.


It appears from several posts in the forum that applicants wanted to get such copies without paying and expecting that PIO delays the information for more than 30 days, and hence they can demand it for free of cost. This is not proper, and applicant must be having an idea as to how much the copies cost, whether he can afford to pay for such copies, and whether those copies are that much urgent and important. Without proper planning, taking a chance to get copies from Govt. free of cost is not proper. (This is not specific, but in general)

      I had sought details of loan and copies of agreement entered with World Bank, JICA etc. of IT Expressway Chennai (created in partnership with Govt of TN) However the PIO has replied that they have moved out of world bank loan and taken loan from other banks details of which cannot be disclosed under 8(1) d of RTI Act citing "commercial confidence".
      However the IT Expressway is a public limited company having entered into agreement with Govt of TN and others for developing and maintaining a particular stretch of road.
      Kindly help me frame a good first appeal.

      I require help on co-operative issue. I had filed the RTI with the PIO, Dy registrar of co-op societies seeking information on affairs of society.
      The PIO has replied stating that the information I am seeking is available with co-operative society. My query is:
      1] Can PIO direct an applicant to private body for information?
      2] The society in question comes under the jurisdiction of the PIO, since PIO is public authority and co-operative society a private body, is it not duty of PIO to seek information from society and give it to me? How can PIO direct me back to society? This is RTI application, either I have to appeal or I have to forego. I cannot complaint against reply. So I want to approach FAA, under what grounds can I?
      3] What kind of violation PIO has committed by directing me back to private society? 
      4] Does co-operative society come under the purview of RTI ACt?
      Your views are appreciated. I am fighting lone battle with corrupt system.
