RTI to get building plan from Municipality

Question

Filed an RTI to Municipality for approved plan of illegal construction.

On 29th day PIO answered that file is missing now what should do?

This is my 3rd RTI with different questions on similar issue. In earlier RTI, PIO has not provided proper answers.

Read the blog on missing records.

File first appeal.

Missing records is not reason for denial under Sec.8

If that record is missing from Municipality, they are supposed to reconstruct the record by obtaining such copy from the builder/owner and also conduct inquiry into missing records, fix accountability and file police complaint on such missing records.

Without any of these steps the reply appears to be deliberately malafide.

 

In addition to filing first appeal with the ground that missing record is not exemption as stated under Sec.8 and amounts to malafide denial, file fresh application seeking following information.

 

Subject matter of construction: Approved plan , terms and conditions for construction at...................................(state full particulars like name of builder, exact location with a copy of photograph for identifying)

Information solicited:

1.Please provide the date on which the missing record was noticed and provide such office note bringing this serious issue to higher authorities and their office notes for further action.

2.Please provide steps taken for reconstructing the records by obtaining such copies from builder/owner .

3.Please provide information on the name of the employee, his superior official under whose tenure the records were found missing.

4.Please provide the date of such inquiry into the missing records and provide copy of the inquiry report, fixing accountability and further action on reconstruction.

5.Please inform specific reasons on record for not making police complaint and provide copies of such office notes on deferring filing complaint and specific reasons for not filing complaint.

6. Please inform the name of the concerned building inspector during whose tenure that construction was made and action taken by him against such construction.

In last RTI, GIC issued order to refund document charges anf provide all information without any charge within 30 days. Even though, municipality is silent on matter no compliance till date.

Bring the non compliance to GIC in the form of a complaint, providing their earlier orders, after issuing a demand notice to PIO for such refund.

      Hello,
      I require help on co-operative issue. I had filed the RTI with the PIO, Dy registrar of co-op societies seeking information on affairs of society.
      The PIO has replied stating that the information I am seeking is available with co-operative society. My query is:
      1] Can PIO direct an applicant to private body for information?
      2] The society in question comes under the jurisdiction of the PIO, since PIO is public authority and co-operative society a private body, is it not duty of PIO to seek information from society and give it to me? How can PIO direct me back to society? This is RTI application, either I have to appeal or I have to forego. I cannot complaint against reply. So I want to approach FAA, under what grounds can I?
      3] What kind of violation PIO has committed by directing me back to private society? 
      4] Does co-operative society come under the purview of RTI ACt?
      Your views are appreciated. I am fighting lone battle with corrupt system.

      Can the General Diary of the police station where particulars of "All the details in r/o criminals arrested and entry of arrival/departure of all enrolled police officers on duty with nature of their duties, duty performed and places visited etc."   are maintained be inspected and photo copies sought from a particular police station under RTI?
      Is there any particular clause/section that needs to be quoted for inspection under RTI? Any format available for inspection under RTI?
