hi,


i came across a reference, when it comes to a PIO not responding to a RTI at all even after 30 days wait, the applicant can directly forward the matters to SIC under sec 18/19 of RTI act without having to go through a first appeal?
is that true?

i am not talking about incomplete information/delayed info n the above..just NO response at all

what does forward matter directly to SIC mean. does a register post with RTI copy/email to SIC help or do i need to follow all procedures like second appeal and wait for the queue that is n years by the SIC for t to be heard?there is this one PIO  office  @village panchayat that never responds to my RTI.. dont know how to deal with them.. going through first/second appeal will be a waste of time as information is time critical . this  s n tamilnadu

i have dealt with filing several RTI. but still dont know how to deal with PIOs who gives deaf ears to RTI and wonder if they really know the consequences of not responding.

honestly , expect more views n the above as the above affects the spirit of the RTI and its purpose ..

please advise.

You are a regular member, and might have come across such questions in every week.

1.The applicant's focus is on information alone and only.

2.Though Sec.18, one can complain to SIC directly without going for first appeal, such complainant is not eligible for IC orders to PIO for providing of information.   This section deals only with discretion of taking action against PIO for deliberate and malafide acts of denial or silence.  This is most uncertain, and going for complaint serves no purpose, as information is focus and important.  Even if one makes a complaint, it is between IC and PIO and complainant can not have a final except praying in complaint for such action.

3.Finally, if one wants information, there are no short cuts, file first appeal after 35 days from posting of RTI.. as per time frame at the earliest and go for second appeal under Sec. immediately after waiting for 50 days from date of FA..  Pray for information and seek all remedies under RTI Act including information, compensation, penalty, recommendation as per Sec.19

Finally it is the attitude of PIO towards his commitment to duty and statutory obligations that finally counts and not views of members.  The weakness and fear towards law is the first hurdle in not getting information from Panchayat.   Meet PIO personally and show some decisions of SIC where they have penalized.  Make a complaint to collector that PIO is not performing his duties and obligations under RTI with a copy to FAA and quote specific instances as example.  That is only possible, we may take the horse to the water tub but can not make it drink water.

      A Car driver committs suicide in public due to police harassment in January 2018 in Chennai . The cop who incited the suicide has been served a simple suspension and is already serving in some other department of the police. A judicial magistrate probe was ordered and the outcome of the probe is not made public. Can I seek the information on the final report of the judicial magistrate probe through RTI? Another qeustion whom does the judicial magistrate submit the report to? 
      Meanwhile I have filed an RTI requesting for the service record book of the police official ThamaraiSelvan who is said to be the cause of abuse and death. If the information is denied citing pending case in court  can "larger  public interest"  be   used to obtain the service log?. Already a pending criminal case in another issue is said to be against the officer. 
      In a strikingly similar incident another taxi driver commits suicide due to police harassment a week ago. Still now police are unable to find the culprit among 64 personnels within their own department. An enquiry underJoint Commisioner West has been ordered and she has submitted the report to the Police Commissioner yesterday. Can this report be obtained under RTI? Can "life and liberty"  clause be added to get the information sooner?

      Further instead of making the cops more public friendly, the senior cops have offered compensation of Rs 3 lakh and brokered peace in an attempt to dilute the investigation in both the cases. No relief has been ordered by the CM which makes one suspicious of the source of the money(bribe/black money/hawala  money).. etc. 
      There has been a severe laxity in registering cases against police which makes them take undue advantage of their power and position in TamilNadu.

      I need to know all the RTI laws and sections under which cpio/spio and PIO and also FAA and CIC,  should not reject the information towards the government employee regarding his education qualification details, moveable and immovable property returns as per the record from his govt office to be made public whenever its been seeked by any citizen of India Being suspect to be forged.
