A 90-year old widow claiming to be the aunt of Prime Minister Narendra Modi has knocked on the doors of an appellate authority after failing to get satisfactory answers from the Labour Ministry on her RTI application seeking details of lease renewal.

Dahiben Narottamdas Modi who claims to be the aunt of Prime Minister Narendra Modi had filed an RTI application in December last year in which she sought to know details of lease, renewals, norms for fixing rent, reasons for not renewing her lease every five years and whether the department was ready to pay arrears for periods in which lease was not renewed after five years, among others.

The matter reached the Commission after she failed to get satisfactory response of her Right to Information application and her first appeal before higher authorities remained unanswered, according to details submitted by Dahiben before the CIC. Dahiben claimed she was all alone and survived on the meagre rental income of Rs 1,500 from the building for which the revision of rent was pending.

While hearing the matter on June 21, Acharyulu observed that while she claimed to be a relative of the Prime Minister, she had not used it to influence the authorities.

It was only after not being provided a proper response that, in utter helplessness, she mentioned her relationship with the Prime Minister, he noted. He also asked some tough questions from the department about the ordeal faced by her and why penalty should not be imposed on the officers handling her RTI petition.

What is such relationship to do in RTI when every citizen is entitled ?
True.  There is no partiality among PIOs and they are united in denying information on one ground or other.
If it was given to local advocate, by this time he should have handled the matter in a befitting manner.
Providing CIC decision link help other citizens as such orders from Professor of Law is highly educative for citizens on RTI.

On 14.03.2018 a complaint was filed under RTI Act,2005 with CIC under section 20(1), on the grounds that the CPIO did not provide the information despite the orders of FAA.
During the hearing the respondent CPIO of PMO office submitted that information had been provided to complainant vide letter dated 01.03.2018 through speed post.
Whereas, the information wasn't received by me and after having hearing submission of both the parties and persuing the records the commission directs the respondent to resend the letter dated 01.03.2018 alongwith the proof of its dispatch including tracking number to the complainant within two weeks. Furthermore my complaint have been disposed of.
The CPIO of PMO has coplience the orders of CIC and now I received the information alongwith proof of dispatch on 05.07.2019.
Since the copy of reply furnished by CPIO of PMO is unprincipled and immature, & very much fishy. Therefore, expert advice is needed on the following issues
      1. Can I still file my appeal against the reply of CPIO of PMO in the event of disposed of my complaint in CIC orders.
For your convenience I am enclosing the CIC orders.
