RTI letter to GST counsil




I am going to write RTI letter to GST council for getting information regarding GST tax rate,…. That is how they are obtaining request for GST rate reduction and how they are processing it,…… the main reason for writing this letter is the GST rate on metals(copper, zinc, brass, iron,…… and even scrap of these metals) set at 18% and till now continue to be the same,…. During VAT all these are at 5%,…… We thought that they will reduce it after few months,….. but now there is no sign of that,…… I just don’t want it to be rejected by any means,…….. so I am writing down the exact questions which I am going to send to them,…… please comment your suggestions,…..

1) Please specify how and through which medium GST council is getting request for GST tax rate reduction?

2) On which bases these request are processed,…… ie. considering the number of request received for the particular product or comparing the GST with old VAT system or if any other manner please specify the same.

3) Please specify on what bases the GST on metals (copper, zinc, brass, iron (raw metal & scrap)) are set at 18% whereas these are set at 4 or 5% during VAT?

4) Please specify Is there any consideration in pending for reduction in GST rate on metals, if so then specify the time frame for that to get implement?

Please avoid interrogative form while seeking information.   Though that form is accepted still some CPIOs deny information that the queries are in questioning form.


1. Please inform the process under which GST Council is entertaining the requests for GST Tax reduction on products.

2.Instead of On which basis seek the basis on which

3. Please inform the criterion on Fixing GST at 18% in case of raw materials and a scrap of copper, zinc, brass, iron when these were carrying at 4 and/or 5% rate during VAT.

4. Please inform the pending considerations if any for reduction GST rate on metals and the present status and the period by which they are considered for implementation.

      An RTI applicant was surprised on being charged the Goods and Services tax (GST) and portal fee when he filed an RTI application. The application and appeal were made to the state government’s portal. Bhaskar Prabhu, the applicant was charged Rs 5 portal fee each time he made an appeal or application and 18 per cent GST.
      “It is not credit or debit card charges. They are taking GST. RTI is a right and we pay Rs 10 as application fee besides other charges, against information provided by authorities. RTI is a right and not a service,” said Prabhu.
      The Ministry of Finance after introduction of GST had stated “exempt supply of services by way of providing information under RTI”.
      DNA - in its October 20, 2017 publication - had reported about Maharashtra State Road Transport Corporation (MSRTC) asking an applicant to pay 18 per cent GST. The report criticised by activists except for one information commissioner stating that it should not be levied.
