About penalties

State information commission Punjab imposed 4000 rs compensation to application for detriment loss suffered whereas, time to time respondent has been given available information according. Now, I have to request commission for forgive the penalty imposed. I heard from someone that there is some certain circumstances for penalties from supreme court. Please give me some decisions if any, so that I request to commission for forgive the penalty

As far as I know, the SIC has no powers even to reduce the penalty as per HC judgments.  (If Rs.200/- per day of delay penalty is levied, SIC cannot reduce the penalty @ Rs.100/- per day)

Appellant has no say in penalties and it is also ruled by HC that the penalty issue is in between PIO and IC.

Keeping this in mind, SIC will not impose penalties during decision time and only issues show cause notice on a proposed penalty and ultimately PIO drafts the letter in lines suggested by Registry, and ultimately the penalty will be waived treating the submissions as justified and proper.

Unless the denial is deliberate and malafide, IC will never resort to such serious action.  Only in rarest of the rare cases, to show their powers and if PIO 's attitude is not proper, IC resorts to penalty.
