need help to make an appeal

I applied for information regarding FIR filed in a police station by social welfare department where I am a witness and complainant (to social welfare department). I asked for details of action taken, in which stage investigation is there and details of evidences they have got under section 6(3),7(3),7(8)(iii),7(3)(ii). I suspect corruption and improper investigation.but PIO refused to give any information saying FIR is still under investigation and under section 8(1) and bombay high court order number W.P.NO 419/2007 and central govt official memorandam no.1/7/2009-IR,dated 1/6/2009. now, whether I can make an appeal? if so, under which section and any details of judgement by central information authority in this regard. how I can get information.

Go for first appeal stating that appellant was soliciting all that information which is on record, and that investigation in progress is not a reason for denial of information, and only providing of that information which impede the progress of investigation with such justification can only treated as proper denial.

Let me be very honest, RTI is just a paper tiger, Police will never provide that information, by the time you go for second appeal and  you may get opportunity of hearing after two years.  

But, we should be prepared without disheartening, and continue our efforts.

SPIO has to inform the progress of investigation.
