what steps further



I had sent an RTI,to ZSWO,Bangalore on 11 June 2019.  

Since there was no reply,I have sent a first appeal on 22 jul 2019 and an email too. I had requested to provide the information free,as the time limit for reply was over.

Yesterday,I have received a reply,from the assitant PIOquoting my rti application datex 11 June,First appeal dated 22 jul and email dated 23 jul 2019,asking me to remit rs.41/- by "Postal Orders". My queries.

1. can the APIO demand cost of providing the information,after appeal stage?

2.does RTI authorises APIO,to sign a reply to first appellate authority?

3.what further steps,appart from complaint to the SIC?

An applicant is concerned only with information alone.

It is proper to remit Rs.41/- as required/demanded by PIO and then file addendum to First Appeal as follows:

Addendum dt.................. to First Appeal of ......2019 under RTI Act


Before: FAA,....................

Against: SPIO,...............


Brief Facts: SPIO has not responded to RTI Application dt...., and first appeal was submitted to FAA on.............and FAA orders are still pending.  APIO has demanded Rs.41/- as copying fees.   IPO Valued Rs.41/- being enclosed under protest.

Grounds for Appeal:  APIO is not the competent authority (sec.5 (2) under RTI Act and it is PIO that has to make such demand for additional fees with such calculation sheet, within 30 days of receiving RTI Application.   If the information is provided after 30 days SPIO is not entitled to demand any fees(Sec.7 (6) and must provide information free of costs.  Hence this addendum to first appeal as FAA has not delivered orders.

PRAYERS: Appellant prays for directions to  SPIO for adhering to stipulations in RTI Act and directions to  refund the fee now sent  under protest by appellant. APIO responding to RTI Applications and SPIO remaining silent even after one month etc., and demanding fees after 30 days disclose that the officials are not properly trained and poor in fundamental knowledge.  Please arrange for suitable training to designated staff in the interest of the Act and to avoid wasteful correspondence.
