Delay in providing the info and amount of fine.

When an applicant files a plaint under RTI act, the PIO has to provide the information within 30 days.

I want to know what are the consequences for the officer who fail to provide the information within 30 days ?

I understand that the officer will be fined . But is there any concrete procedure to determine this fine amount ? Will this fine be calculated on daily basis ? then how much per day ? is this penalty amount same across all the departments of the goverment ? can the FAA or SIC let go the erring PIO just by reprimanding ? in extreme cases is there a provision in the act for suspension or sentencing an erring PIO ? :confused:

But there is ambiguity regarding the maximum penalty clause

 

" The amount of penalty shall be Rs. 250.00 per day, till the information is furnished or the application is received, subject to a maximum of Rs. 25,000.00 "

 

What happens when the amount of penalty piles up to more than Rs.25000?

For example if information is provided after 6 months, isn't the PIO going to pay Rs.45000 as a penalty ?

Dear Ajit

No penalty will be Rs. 250.00 per day, subject to a maximum of Rs. 25,000.00 .regards

      In one of my recent 2nd Appeal, IC of a SIC imposed a "token" penalty of Rs 2500/-on PIO admitting a delay of more than 100 days; the IC was well aware of different judgements on Penalty by Hon'b'e Apex court and High Courts wherein it is clearly made out that the ICs have to take a decision on   either  penalty or no penalty  but, cannot change the prescribed the rate of penalty. 
      IS THIS NOT MAKING A JOKE OUT OF RTI ACT-2005 by SIC
