RTI for knowing police action

Question

bahl_ajay

Would like to know if one can file a RTI to know the action taken by police against a FIR, if I am not a party to the FIR will it be treated as a third party information or any law abiding citizen has this right to seek details of action taken/initiated by police.

In this particular case of Hit and run by an unknown vehicle, wherein a man lost his life. Police inaction is adding to the apathy of this family who have been harassed to this extent that they may not be willing to resort to RTI to fetch out this information.

Thoug out of context - does any one of us have an idea about the mandatory time limit if any in which the copy of post mortem report has to be provided to next of kin of the deceased.

Thanks

(1). The action of police is public action.

(2). If the investigation is over, the action of the officer is complete.

(3). The action which complete, woud result in information.

(4). When the information is avilable , it is on record.

(5). Information which is on record, any person is entitiled to get the same under RTI.

(6). SO you go ahead to get the information, if it s ripe you will get it.

goodluck

I have been falsely implicated in a case by police for removing illegal banners. They  have remanded me under Sec506(II) Attempt to murder on complaint from ruling party men. Though the FIR is available online I want copy of  other documents like complaint letter, confession letter in which they have forcibly made me sign. I also want the CCTV footage of the police station at that particular date and time.
I have already filed RTI in this regard and have had the information denied under Article 8 1 (h) saying the case is  under investigation. Is this correct? Will First appeal be of any help?

Bengaluru resident T Narsimha Murthy had moved an application under the RTI Act on April 10, seeking information that who all came to meet Salman in the jail during his judicial custody from April 5 to 7 after his conviction by the trial court in the blackbuck poaching case.
Instead of providing information to the applicant, the jail administration sought permission from Salman, asking him of his opinion!
Justifying the move, DIG (jails) Vikram Singh said since the information pertained to a third party, the jail administration required to have his permission before providing the same to the applicant. "Since the information sought by the applicant belonged to a third party , we have sought his (Salman's) permission", Singh said.
Prima Facie, the information does not seem to be third party information and could have been given in larger public interest. What are your views?
