Please inform the forum members of from where these " Guidelines fro Government Websites.pdf‎ " are obtained this is because one can refer to this document and ask for records from PA

to my understanding this is a internal ( read NOT official ) guidelines

What do you meant by that ?

Guidelines are guidelines - there is nothing like official or unofficial guidelines.

These were issued by DARPG - Department of Administrative Reforms and Public Grievances.

In fact these are "old" guidelines - dated 2003. After that new guidelines have been issued in 2009. They are 132 pages. Important section for RTI users are Sec 4 and 5 of the guidelines. They are attached to this thread. Since they have the obligatory Hon'ble Ministers' photo in the initial pages, I hope you are convinced that they are "official" (LOL).

HOW TO COMPLAIN IF SOME GOVERNMENT WEBSITE DOES NOT ADHERE TO THOSE GUIDELINES:

 

 

Many times we find that some Government website does not adhere to those guidelines. Follow the below mentioned method to complain against these websites:

This is a COMPLAINT against the following Government websites:

Both these websites do not comply with the Guidelines, because they do not

have a "Feedback" section/link !

 

Section 4.4.5 of the "Guidelines" state that it is "MUST" to collect feedback

through online forms.

 

Further, Section 1.7 of the "Guidelines" clearly state that "MUST" means

to mandatorily comply with.

 

NOTE: On the website Guidelines for Indian Government Websites

itself, there is no "Feedback" link.

 

My humble suggestion is that on the website: Guidelines for Indian Government Websites

there should be a provision for Citizens to report Government websites which

do not conform to the "Guidelines".

 

Otherwise, where does a citizen complain against Government websites which are not compliant

to the "Guidelines".

Actually I got tired of complaining to CIC about their website having antiquated information and not being updated regualrly:

The DARPG has published “Guidelines for Government websites” and also the “Guidelines for email management in Government offices”.

 

Information required:

 

1. Are the above two mentioned Guidelines mandatory to be followed by every Government organization ?

 

2. If any organization does not follow the above Guidelines or the Government website does not conform to the two Guidelines, please provide Name, Designation, Address, email id, Telephone number of the Officer with whom a citizen can lodge a Complaint

 

3. Since the introduction of the above two Guidelines, please inform the number of Complaints received by the department regarding violation of the two guidelines

 

4. Please provide action taken report on each of the complaints received as in item nr. 3 above

 

5. After the publishing of these above two guidelines, has the DARPG conducted any audit of different Government offices/websites to check whether they are complying with above guidelines ?

If yes, please provide copies of all audit reports and the copies of action taken reports.

 

6. Please provide copies of rules and regulations as per which action can be taken on responsible persons in any Government organisations which do not follow the above two guidelines.

This is the way the PAs with connivance of PIOs defeat the purposes of Guidelines - separating into advisories and mandatory guidelines.

Now a question comes what purpose serves in issuing advisories by competent authorities, if these have to be left on whims and fancies of PAs?

The second question comes why did the Guidelines were at all issued by the Competent Authorities if these can be flagrantly violated by the PAs?

What happens to the (1) preamble of RTI ACT-2005 – to bring accountability and transparency, (2) What happens to the provision of periodic updation of records and data etc.?

NEW DELHI: The Centre today told the Delhi High Court that a comprehensive e-mail policy will be formed in four weeks for official communication by government officers so that the data will not be transferred to a server outside India.

 

Appearing for the Centre, counsel Sumit Pushkarna submitted a draft policy before a bench of justices B D Ahmed and Vibhu Bakhru and said "the government is on the verge of finalising the e-mail policy and the same will be placed before the court within four weeks."

 

The bench said "it is an important issue. Do it fast. We are sure the new policy will be in line with the provisions of Public Records Act."

 

The Centre's lawyer was answering to a court's query about the government's stand on the petitioner's allegation that government officials are using social networking sites by opening accounts like gmail, hot mail, yahoo and other similar e-mail Ids, whose servers are out side the country, for official communications instead of using the government server-national informatics centre(nic.in).

 

The court was hearing a PIL filed by former BJP leader N Govindacharya contending the use of e-mail Ids whose servers are out side the country and transfer of the country's official data is violative of the Public Records Act.

 

The petition also sought a direction to ensure safety of the data of 50 million Indian users which was transferred "to the US and is being used for commercial gains in violation of the right to privacy."

 

The petitioner's counsel Virag Gupta had earlier alleged Delhi Police, Indian Railways and others have created accounts on social networking sites despite government departments being barred from doing so under the law.

Govt drafts policy to curb use of Gmail, Yahoo for official purposes

 

Central government employees may soon be banned from using Gmail, Yahoo and other email service providers for official communication to prevent transfer of data to servers that are based abroad.

 

The Central government on Thursday informed the Delhi High Court that a comprehensive policy on email use for official communication was being formulated . Government standing counsel Sumit Pushkarna also submitted the draft policy before the bench of justices B D Ahmed and Vibhu Bakhru on Thursday. Pushkarna assured the court that the policy would be finalised within four weeks.

 

The submissions were made during a hearing on a plea filed by RSS ideologue K N Govindacharya regarding online privacy. Facebook, Google and other web service providers are also parties.

 

"It is an important issue. Do it fast. We are sure the new policy will be in line with the provisions of Public Records Act," the court said.

 

The new policy is expected to be in line with the provisions of the Public Records Act which lays down guidelines for the management, administration and preservation of records of various government agencies.

 

During a previous hearing, Govindacharya's counsel Viraag Gupta had alleged that government officials were using social networking sites, whose servers are outside the country, for official communications instead of using the government server provided by the National informatics Centre.

 

The lawyer also submitted copies of official contact information of various ministries, which showed that ministers were using email IDs hosted by Gmail, Yahoo and others for official communication.

 

According to the petitioner, the sensitive data would be stored on servers outside of the country and could be accessed by foreign governments.

 

Advocate Gupta alleged that the Delhi Police, the Railways and others had created accounts on social networking sites despite government agencies being barred from doing so under the law. The next hearing is on October 30.

This is required in respect of all State Governments also. The problems are acute in Cities. All Municipal Offices in Cities are also required to have dedicated sites, with details of Contracts/Contracts awarded with the address/contact of concerned dealing officer of all Public Utility Services.

The Delhi High Court on Thursday directed the Centre to finalise its under-preparation national email policy within four weeks and submit to it.

A Division Bench of Justice B.D. Ahmed and Justice Vibhu Bakhru passed the direction when, during the hearing of a public interest litigation in the matter, counsel for the Centre informed the Court that the government was preparing a draft national email policy for online communications of official records.

 

Earlier, the counsel for the petitioner informed the Bench that the government was violating the Public Records Act, 1993 prohibiting sending out official records outside the country by exchanging communication of official records through private email service providers like Google which had installed its servers in the U.S.A.

 

MINORS OPENING ACCOUNTS

 

Former Bharatiya Janata Party ideologue Govindacharya, the petitioner, has alleged that social networking sites are allowing minors to open accounts as it helps them generate huge earnings.

 

VIOLATION

 

Drawing the attention of the Bench to the use of a private email service by an investigating agency to announce a monetary award on an accused for providing information regarding a blast and opening of an email account on it by a Union Minister, counsel for the petitioner Virag Gupta, submitted that these two instances were the Act’s violation.

 

The government also filed an office memorandum of the Union Ministry for Home Affairs of 2004 in the Court advising that “the Ministries/ Departments should not host their websites in the servers of private parties or servers not located in India.”

“The Ministries/Departments were also requested to host their websites on NIC or ERNET or in any other server owned by the Government of India or the State Government Server,” the memorandum further said.

 

The memorandum was sent to the Secretaries of the Union Ministries in 2005 and to the Department of Information Technology in 2007.

Meanwhile, the counsel for Google and Facebook informed the Court that they had appointed grievance officers to deal with the violation of the Information Technology (Intermediary) Rules, 2011. People can now lodge complaints with these officers in case of violation of the Rules, including opening accounts on the social networking sites by children below 13 years of age, Mr. Gupta said.

 

The case will now come up for hearing on October 30.

I-T dept asks officials to use official email IDs

 

The Income-Tax (I-T) department has directed all of its officials to use official email IDs for all official communication. Moneylife had raised the issue of I-T officials sending mails to taxpayers using IDs from free email service providers like Gmail and Yahoo!.

 

In a circular, issued on 27 September 2013, the Directorate of I-T, has said, "Since official IDs are available with most of the Departmental Officers, it is instructed that hereinafter all official communication(s) on mail shall be only through the official email IDs detailed above. In the event that an official email is required to be sent urgently and the official email ID not available, the official IDs of the Commissioners of I-T (CsI-T) or Directors of I-T (DsI-T) may be utilised for the same.”

 

As Moneylife pointed out one of the I-T officers sent a reminder to a wealthy individual to pay his advance tax in time and send details to his Gmail email address.

Govt bans Gmail for official work, to monitor staff's online activities

 

NEW DELHI: The government will be monitoring online activities of bureaucrats on official computers, block content which it feels is adversely affecting the productivity of the babus and also have a right to delete e-mails or internet history on such computers after intimating the user.

 

 

The measures are a part of twin notifications issued by the Narendra Modi government on February 18 by which the use of private e-mail networks like Gmail and Yahoo has now also been officially banne ..
