Question

Pritam Nath

Well, i filed an application seeking photocopies of my answer script under RTI Act. They, called me to their office and allowed me to see the answer script. But i was denied a photocopy of the same with the reason saying our university rules doesn't permits us to provide photocopy of answer script.

(When i wrote the application, i clearly mentioned that i want photocopy of answer script.)

Please tell me what i have to do now to obtain the photocopy of the same.

File a first appeal with the first appellate authority on the grounds that you were given:

"Incomplete information" : Given inspection and not photocopies

Quote from the SC judgment in your first appeal.

SC judgement overrides all rules of individual universities/boards. Refusal by University would amount to contempt of court and concerned officers can be penalized by SC.

In your appeal, cite that as per section 2 (Definitions) of the RTI Act 2005,

subsection (j) "right to information" means the right to information accessible under this Act which is held by or under the control of any public authority and includes the right to—

(i) inspection of work, documents, records;

(ii) taking notes, extracts or certified copies of documents or records;

(iii) taking certified samples of material;

(iv) obtaining information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts where such information is stored in a computer or in any other device;
