Good News, The CWP (PIL) 7251 was heard on 9.7.212. The counsels for respondents were present and prayed for more time for filing reply. The Acting Chief Justice and Other Judge, (it is DB) asked me to explain and were convinced. An interim order was passed and the Mayor or Commissioner of Amritsar is directed to file an affidavit regarding compliance of my prayer on next date and also to reply on merit (90% of relief sought is achieved) Next date is 10.9.2012 and the order is attached with this post.

 

Bad news, the CWP (PIL) 8801, was fixed for 2.7.2012 and I could not reach in time in court as well as there was misunderstanding regarding the amicus curie, so the case was a dismissed because of my absence. I appeared after lunch before the Chief Justice and prayed for hearing. But was directed that I have to file an Application for Restoration properly. The application for restoration filed on 20.7.2012 and is checked and find ok, now registered and the shot date for enlistment will be online and the matter will be restored and argued and relief will be sought.

 

I will not spare the guilty (Chorunga nahin choron KO)

Good news, the PIL 8801, fixed for restoration, (as very 1st case in cause list) was argued by me, and was allowed restored today. Rather Chief Justice was keen to hear the matter on merits too.

The matter was explained and court passed interim order as motion of notice to Government of Punjab, with very strict directions. The copy of order applied and on its receipt , will be uploaded on this thread.

A non advocate arguing and pleading PILs. You too do.

This line has paid me in full as my reward for this act, dear Digal.

My Dear RTI Activist Companions,

 

As said by me in past, the RTI should result in to a PIL or atleast a CWP in High Court to bring the actual effect of all exercise.

My one PIL filed versus Municipal Corporations of Punjab had a very deep effect and three Commissioners of Amritsar, Jalandhar and Ludhiana are to be present personally at High court tomorrow on 27.8.2012 to explain. A leading daily, Punjab kesari in local edition of Ludhiana has actually described the nature of my writ and the effect on corporation.

It is pity that other leading dailies and their correspondents do not care for such public awareness reports and go for only hot news for gaining readers strength.

Please ask your known News Correspondents to look in such matters of common cause and report.

Further, I request you to all get armed with PIL filing and make the country to change.

Dear Mr P C Bali,

 

The undersigned has through RTI applications have got some startling facts about mobile towers in Gurgaon which clearly STATE that only TWO OUT of FIVE HUNDRED SEVENTY SEVEN mobile Towers are authorized and rest of them are not authorized. The annual fee of one mobile tower to Municipal Corporation Gurgaon is Rs 2.5 lacs per year and presuming and assuming that these towers are there for last five years or more then the net loss to MCG/public Exchequer is Rs 250000/- X 575 X5 and the amount runs in Crores.

 

Can not spend huge amount on Advocates.Need to know as how to file PIL in P&H HC on this. Kindly guide.

 

Looking forward for practical piece of advice.

Yesterday, on 27.8.2012, in PIL-CWP 8801/12, Commissioners of Municipal Corporations of Jalandhar-Ludhiana & Amritsar were personally present before the bench in the High Court. The respondents asked for a little more time to file the replies on the pretext that the affidavits to file in High Court need examination of a lot of records of their respective corporations, so prayed that the time be given to them. The Chief Justice was a little concerned on urgency and grilled the respondents.

 

CJ. “Why there are unauthorised constructions going on under the nose of Mun. Authorities.”

The counsel for MC Amritsar, “My Lord, the people start unauthorised constructions, those are served with notices, but people are very clever and they go on constructing and now what can be done, Commissioner can not sit on the site.”

CJ, “Very astonishing, how it will do then.”

Counsel. “My Lord, we have much more duties”

CJ, “This is not court’s concern. Any how what about all compounding fee which is levied but not recovered due to unknown reasons”

Counsel, “My Lord, all 84 cases of such compounding are now fully recovered in Amritsar and none is pending.”

CJ, “From which period”

Counsel, “My Lord, of period 2010 & 11, about which the petitioner had made PIL.”

CJ, “Then what about rest of the arrears, are you not going to recover?”

Counsel, (mum)

CJ, “What is being compounded? Even non compoundable too?”

Counsel, “No My Lord, I just read the By-laws. (counsel reads by laws), My Lord, leaving some such serious offences, we can compound the rest of all”

CJ, “Then what about the marriage palaces parking lot? What are Bye-laws?”

Counsel, “My Lord, 50% of land plot covered area and same for underground parking area.”

CJ, “(Laugh) But I have seen all vehicles parked out side at road.”

Counsel, (Mum)

 

Me, “My Lord, I want to submit”

CJ’ “Yes, say.”

Me, “My Lord, worthy counsel for respondent no.6 is grossly misguiding and misleading the Hon’ble court by making false statements.”

CJ, “How?”

Me, “He says that after service on notice to unauthorised construction, commissioner can not sit over their, while section 270(2) (3) (4) of Municipal Corporation Act ask the commissioner to actually sit over there or through his staff, commissioner is duty bound to sit and watch that no further progress in the construction should go and if it is done, he is to deploy police and pick up his men and material on the cost of such constructor. My Lord, what more the act should say, it is law, how can Commissioners say that what can be done if there is construction going on, we can not stop, how the law will be enforced then,

CJ, “Ok, let them file reply. We will see”

Me, “My Lord, please, also see that he has also misguided the court by saying that Compounding can be done in rest of all, rather he has not intentionally read the conclusive para of Bye-Laws that Compounding will be done minimal, and only in rare cases and as such the Municipal Corporation Officers can not use it as a tool for their vested interest to get their palms greased and allow an unauthorised construction to go on intentionally to make it compounded afterwards. How, My Lord, then people will go for a planned Housing.

CJ, “Ok.”

 

CJ dictates order and ask me, “What section you were mentioning Bali,” I said, “My Lord, section 270.”

CJ dictates that the defendants will observe onward that section 270 be enforced strictly.

I pray, “My Lord, ask them to recover all compounding fee what so ever in arrear.”

CJ dictates some order.(not heard clearly)

 

The matter is adjourned till 24-09-2012. The copy of interim order will be applied in HC registry and actual interim order will be collected and uploaded in this thread.

U r most welcome, anytime, all times.

The format of PIL is already appended in this thread in start, you can just make so. Otherwise, you come here in Amritsar for a day, stay with me, I have a guest room and we will prepare the PIL for you myself. Please note that for this, there is no cost to you. The cost is that afterwards, you will teach more people to come forward to file PILs in person. Any time, you fix up on mobile with me the day of your coming on safe side; we will manage it, no problem. My mobile is +919417010035, (or 183 2277829 res. after 8PM to 8AM)

 

Regarding threats, paper bullets are always shot; do not fear, Guru said, "De Shiva bur mohe iho, subh Karman se kabhoo na daro. Follow it and "Jo lare deen ke hait, soora soi Purja Purja katt mare, kabhoon na chhare khet. So r u ready to be cut to pieces, then only come forward and only then you can achieve the goal. First boost up yourself.

 

Practically, no body will harm you, I am sure, it is my experience, unless one enter in any blackmailing or treacherous activity, which I know, you are of that nature, so nothing will happen, come on. Try it.

In case if some thing is beyond expectation, you can compromise and can withdraw the PIL. Simple. But the fire you will kindle will make a way and court may suo-motu (of its own) take up the matter, or some one else taking a cue from your PIL may file separately. But the process will start and your goal of getting revenue to Municipal Corporation will be achieved, (As news papers will make it a storey, as soon as you file PIL)

 

Lastly, if you do not want this way to file PIL, you can send a registered letter with all self attested copies your RTI information as evidence, to Hon’ble Chief Justice of Supreme Court. This is also a valid and perfect legal provision and Court can take up the matter of its own motion. (You can write even that to Chief Justice, High Court of UP, but it is better send it to Supreme Court and see the result, wait for a month. If no action starts, you still have full right to file regular PIL (and mention in writ petition that you sent a letter to CJ of SC, as must) you are again at the same platform.

 

Finally, if you fear, send me the information, I will file the PIL, but I will always wish it as a last resort. My actual theme is that an army of PIL filing people be prepared to make use of Law to bring some respite to present lawlessness. If I go on filing myself always, it will just make me lonely.

 

I have explained you all the probabilities and methods, now you may decide and discuss on this thread or personally if needed. I will be always at your disposal and to all those who want to follow RTI to PIL Path.

Yes, I intend to file PIL only. In May 2012, My PIL no CWP 8844 was listed on same day as yours in which the undersigned prayed for CBI inquiry against corrupt IFS officers of Haryana in Forest Scam. The result was Hon'ble HC taking cognizance and issuing notice on the same to UOi, CBI, State Govt and all concerned.

 

Why I mentioned threats was because I wanted to know whether I can put this in PIL itself. Otherwise there is no worry. Your truly has sought permission/sanction from Hon'ble CM of Haryana for prosecuting then Finance and now Electricity Minister/ Forest & Environment Minister of Haryana in which the undersigned has been assaulted also but has not been deterred from doing what is right in the eyes of law. Because of this assault, the Hon'ble CIC of Haryana SIC wrote A DO letter to DGP Haryana seeking police protection for undersigned but DGP did not accede to his request because of political pressure.

 

The guidance and daring approach of yours & others motivate beginners like undersigned and which is good fodder for fire to keep burning.

Please do not give me so big applaud which I do not deserve, rather this field is of service and not of clapping or glamour. I will like and appreciate if you treat me a simple person and your companion in the journey to achive Justice for all.

 

In a PIL, in person, you can add what so ever you like, even threat to your life and can pray for protection. If the court is convinced, it may give you relief immediately or if the court is of view that you are creating some mischief like want to have body guards for pump and show (like many leader take security to frighten the public and grab their rights and properties) it may not and even may dismiss the PIL with huge cost. Truth is Truth and always Truth triumphs, is my experience.

      RANCHI: A PIL was filed by one Surendra Sao of Bokaro in Jharkhand High Court demanding a CBI inquiry against SAIL chairman, BSL MD and former Union steel minister Ram Vilas Paswan in connection with the expenses incurred during Prime Minister Manmohan Singh's visit to the state last year. The PM had come to lay the foundation stone of BSL's modernization and expansion programme.
       
      Sao has challenged the Rs 1.92 crore expenditure incurred by BSL during the visit of the Prime Minister on April 22, 2008. The estimated expense to be incurred by BSL in this programme was around Rs 11,000 crore.
       
      The petition was filed on basis of information collected through RTI from SAIL. The report of alleged misuse of money during the Prime Minister's visit to the state was first published in TOI.

      MADURAI: The Right to Information (RTI) Act, 2005 has exposed the appalling conditions of a middle school in Tiruchi where 195 students were suffering from lack of basic facilities such as electricity, ventilation, toilets and structurally stable buildings.
       
      Disposing of a public interest litigation (PIL) petition filed on the strength of information obtained under the RTI Act, the Madras High Court Bench here on Friday directed the education officials to shift the students to other schools.
       
      The Tiruchi District Elementary Educational Officer (DEEO) was ordered to transfer immediately all 195 students studying in Standard Six to Eight in Sacred Heart Middle school at Pushpa Nagar, Sangiliandapuram, to two other nearby schools.
       
      A Division Bench comprising Justice V. Ramasubramanian and Justice D. Hariparanthaman held that the temporary recognition granted to the middle school, until October 31, 2009, was illegal.
       
      Mr. Justice Ramasubramanian directed the Collector and the Director of Elementary Education in Chennai to inspect the buildings where the school was accommodating students studying in Standards I to V and ascertain whether they had all necessary facilities.
