If any person want to get our salary details for the last 2-3 years. can we provide this information to applicant or this information is covered under section 8(1)(e) fiduciary relationship.

 

Please tell me if we cannot provide the information instead of 8(e) then provide the judgement for the same

1. Neither its fiduciary info nor personal info.

 

2. SALARY (monthly emoluments) OF an Govt employee has to be declared suo-motu by the PA under Sec 4(1)(b)(x).

 

3. RTI Act is available here:Right to Information Act 2005

Salary details of all govt servants have to be proactively disclosed under section 4.1.b.x. Hence you should supply the same.

You can ask for the basic and gross salary of any govt employee under RTI Act. But further information like deduction, investments, tax paid etc will be called fiduciary relationship.

 

You can ask for the rent received by the govt employee but asking for the details of his accommodation will be called fiduciary relationship

 

You can ask info on travel allowances drawn by him but asking the stations he visited will be called fiduciary relationship

 

and so on ...

(e) information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Salary is drawn from state exchequer , how this information is available to a person in his fiduciary relationship. Hon'ble member. Please take a glance of section 4 (1)(b) (x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations is obligatory duty of public authority to disclose on its website or any other way so that it can be easily accessed.

Can I give information on salary details of employee to her husband.

As I am being drawing officer of employee her husband has applied under rti act to provide salary details.

My employee being a second wife to her husband has given written statement mentioning not provide salary details.

Kindly help regarding this issue.

      New Delhi, July 17: A woman, who is in a legal wrangle for maintenance, has been allowed by the Central Information Commission (CIC) details about salary of her husband, working for a public sector power company.
       
      Ritu Sharma, in an RTI application, had sought the salary certificate of Daya Sharma, her husband and a senior employee with power generation major NTPC, alleging that he had misled a family court hearing her maintenance petition.
       
      In response to the application, NTPC's chief Public Information Officer had denied the information stating that the disclosure, related to personal information of a third party, would cause "unwarranted incursion of the privacy".
       
      Terming the denial of information as "untenable", the CIC directed the CPIO to provide the details within 15 days to the applicant, a resident of Raipur in Chattisgarh.
       
      "All the public authorities are under the obligation under the Right to Information Act to disclose salaries of their employees," Information Commissioner M M Ansari said, while allowing Ritu's application.
       
      The Commission held that the monthly remuneration received by each of its (public authority) officers and employees, including the system of compensation as provided in its regulations should be published.
