Just received the copy of the WP to be filed by CBI in Delhi HC praying for quashing of the CIC order.

 

With the following decision of the Delhi High Court, the matter is now settled....and I should easily win my case on 07 Sep 2017 (next date of hearing) and hopefully also get my compensation of Rs. 153.

The full judgment of the Delhi High Court stating that CBI has to disclose information related to allegations of corruption or Human Rights violations and ordering compensation to the applicant of Rs 153.00 + interest @12% for 6 years, is attached to this post.

 

Hope they don't appeal this order.

 

CIC has been adjourning/holding many cases related to CBI citing the stay order of the Delhi High Court in my case.

 

Members can now cite this final judgment of the Delhi HC and get their matters heard once again in the CIC.

The judgment requires careful reading. No penalty or compensation for irresponsible handling and misinterpretation of simple clause in Act by CBI. Just a guarded judgment quoting some other judgment.

 

Although, it would not be open for the petitioner to claim that information relating to

allegations of corruption in other organisation is exempt from disclosure,

 

The argument of CBI has to be noted with attention. They state that information which is provided to them by other organisations and that is already available with them. Both the cases it is information.

It is an example as to how intelligent and smart guys can interpret a simple section, have confidence to go to HC also assuming that they are right, spending amount of Government, only to protect the names of corrupt.

No need to file any more RTIs on this subject, because after the Supreme Court Ruling, all FIRs have to be uploaded on website.

 

Since CBI also files FIRs, they have uploaded all details on their website. One can read the FIRs and get all details.

      Hello,
      I require help on co-operative issue. I had filed the RTI with the PIO, Dy registrar of co-op societies seeking information on affairs of society.
      The PIO has replied stating that the information I am seeking is available with co-operative society. My query is:
      1] Can PIO direct an applicant to private body for information?
      2] The society in question comes under the jurisdiction of the PIO, since PIO is public authority and co-operative society a private body, is it not duty of PIO to seek information from society and give it to me? How can PIO direct me back to society? This is RTI application, either I have to appeal or I have to forego. I cannot complaint against reply. So I want to approach FAA, under what grounds can I?
      3] What kind of violation PIO has committed by directing me back to private society? 
      4] Does co-operative society come under the purview of RTI ACt?
      Your views are appreciated. I am fighting lone battle with corrupt system.

      Can the General Diary of the police station where particulars of "All the details in r/o criminals arrested and entry of arrival/departure of all enrolled police officers on duty with nature of their duties, duty performed and places visited etc."   are maintained be inspected and photo copies sought from a particular police station under RTI?
      Is there any particular clause/section that needs to be quoted for inspection under RTI? Any format available for inspection under RTI?
