Time to cheer on Right to Information Day when it has come to notice that India has 4th Strongest RTI laws in the world.  This report is available on 28th September which has been declared by UNESCO to be celebrated all over the world as “International Day for Universal Access to Information”. India as been ranked 4th in the world having strongest RTI Act. This has been done by a website rti-rating.org

The website however states

India has long been recognized as one of the most advanced countries in the world when it comes to access to information, but its failure to top this ranking is demonstrative that global standards of the right to access have advanced considerably since India’s law was first passed.

The top two reasons for India considered as lower in ranking are due to “blanket exceptions in Schedule 2 for various security, intelligence, research and economic institutes” and “not allowing access to information held by private entities which perform a public function“.

On analysis of the details it is also found that India has scored less on not only exemption reasons, but also on imposing less sanction. Here are the other major factors which are matter of concern in so far as RTI Act is concerned. In these matters India has scored lesser.

  1. There is a system for redressing the problem of public authorities which systematically fail to disclose information or underperform (either through imposing sanctions on them or requiring remedial actions of them).

  2. There are legal protections against imposing sanctions on those who, in good faith, release information which discloses wrongdoing (i.e. whistleblowers).

  3. A central body, such as an information commission(er) or government department, is only given overall responsibility for promoting the right to information.

  4. A system is not in place whereby minimum standards regarding the management of records are set and applied.

  5. There are clear and reasonable maximum timelines (20 working days or less) for responding to requests, regardless of the manner of satisfying the request (including through publication).

    I fully agree with the comments of Sri Praveen Sakhuja. Some times in a short notice, the appellant may not be in a position to attend the SICs which are holding their hearings not through video conferencing. There are occasions wherein the hearings are taking place without getting acknowledgments of the notices from the appellants. The Information Commissions can not expect the appellants always to be present in their residences awaiting for the notices and they too have their own works to be attended at out of headquarters. The Information Commissions are taking things very casually. There are humpty number of incidents wherein the Orders passed by the Information Commissioners are totally in favour of the Public Authorities for various reasons. If any one is desirous of knowing such Orders I shall provide them. The system is getting misused. All the appellants can not take their matters to High Courts and Supreme Court.

    The Public Authorities are getting Arrogant,!
    The Information Commissions are shutting door for the RTI appellants !
    More than 250 RTI activists are reported killed, kidnappers, intimidated, molested, threatened, thrashed, injured, and thousands of cases gone unreported!!

    Is this the RTI Regime We are celebrating?

    We want the RTI Activists to be provided security under the RTI Act itself!!
    The RTI Act needs to be amended further!!

    DEAR SIR/MADAM, PIO’S HAVE MADE THE RTI ACT A JOKE AND DO NOT CARE FOR THE PROVISIONS OF THE ACT. THEY EITHER SUPPLY PARTIAL OR DO NOT PROVIDE THE INFORMATION TO THE APPLICANT WITHIN 30 DAYS.MANY INSTANCES DEPICT THE PICTURE.

    I disagree with the report, it looks the report has been prepared without taking data from CIC and SIC,s. The back log and decisions coming after zusymore than 15 months acussing appellant for not attending the proceedings is shame on commission. Blame game stating appellant is not interested in getting the information is a blow to system. Celebrations after 12 months is also shmae. Much more can be delivered. Let us see what is out come on celebration day on October.
