  1. Whether a bank is obliged to issue Bank statement of it's client (not individual's, of an association registered under societies Act) to anybody who asks under RTI. Does RTI provides such provisions?
  2. Dear all I am a new member and ex-staff of Nationlised bank. I request the RTI INDIA group members to guide in respect of disclosure of AUDIT reports under the RTI act. THE audit in the bank are conducted by their own staff of Audit Department and most of the time the auditor gives a good relating despite some lapses being noticed by them. the follow-up of the rectification of audit report too is weak.it is because of this collusion of audit staff with branch officials frauds in the bank are on the rise resulting in loss of public and customers money. though a case of FRAUD is reported to RBI , it consolidates the date for statistical purpose but no effort is made to recover the lost and misappropriated funds. this can be prevented to some exgent by use of RTI Act. so, kindly give your opinions or suggestions to tackle the problem of Fraud by the staff of the bank who are continuing in service of the bank without any punishment. with regards umapathi.s:rolleyes:

Power of the Reserve Bank to give directions.-(1) Where the Reserve Bank is satisfied that—>> (a) in the 2*[public interest] ; or 3*[(aa) in the interest of banking policy ; or] (b) to prevent the affairs of any banking company being conducted in a manner detrimental to the interests of the depositors or in a manner prejudicial to the interests of the banking company; or © to secure the proper management of any banking company generally; it is necessary to issue directions to banking companies generally or to any banking company in particular, it may, from time to time, issue such directions as it deems fit, (1) In my view this does not specifically allow RBI to free depsoitor's Fixed deposits; speciallty those that have matured. My RTI on this isue has got a vague reply. First appeal also got a similar vague answer. Does anyone have any answer to the above? (2) also, Need to know how : (A) To which CIC authority the second appeal is to be filed and the exact (B) The postal address to which this appealk to be sent © Whether any more fees to paid. Kotwa
  4. Dear Sir, This company makes perfumes worth more than 2 crore every month and sell all over india. Though they have only licence to refill perfume for a limited quantity, they are making huge quantities. not only that they use illegal banned ALCOHOL to fill perfumes and the grade alcohol they are using to refill the perfume bottles is baned in India. By using this brand 'XXXXX' or 'YYYYYYY' or ZZZZZZZ Perfumes can cause health problems We need some one to take this matter serious now. Company make perfume using illegal and baned ALCOHOL is . ABCDEFGHIJK and PQRSTUVWXYZ. Brands they make are AAAAA, BBBBB, CCCCCC, DDDDDD, XXXXX, YYYYY , ZZZZZZ , ZZZZZZ EEEE, FFFFFF, ETC Also we came to know they sell 90% of the stocks with out bill, by not paying excise duty, they dont sales tax (vat). there is so much revenue loss to India govt. I hope there is some action taken.
  5. One of my clients is interested in using the bank provided EDC terminal to communicate to his server to record some transaction. Can this be done. Need to understand the bank terminal functioning and the network.
  6. Most branches/offices of State Bank of Travancore are housed in Bar/liquor shop buildings. [Liquor barons get construction loans from the Bank and get the Bank to hire part of the premises. Let us not consider the under-the-table matters involved, though.] This creates embarassment and problems to women and student customers always. Security of the Bank is also an issue. In some branches, customers have to pass through Bar corridoors to get into the Bank. I asked SBT about branches which are housed in buildings where liquor outlets function and asked for distance from Bar door to Bank door in each case. They replied that they 'do not have the information'!:p
  7. how can i get the information from a nationalized bank? To whom shall i approach?
  8. I had applied for a credit card from ICICI Bank 15 days back. I got a message from the bank that my application has been rejected. This is despite the fact that only a month back, they upgraded my account status from normal to esteemed customer status. When I asked the banking officer for the reason I was told that i could not be told. I am sure there is some hurdle, but i wish to know what it is. As a respectable citizen of this nation serving in the armed forces, why have I been denied a credit card?

    The RBI declined to furnish information on the fraud committed in a bank which was detected by the RBI Inspection.The RBI declined to furnish information citing the Sec 8(1)(a)(e). Give some decisions of CIC in this connection

Hi i am Rajeev Ranjan. i lost my state bank of India (SBI) debit card which was issued from Bhagalpur (bihar) main Branch . i reapply for new debit card near about January 15,2009 but bank don't given me any receiving of application. so naturally i don't have any proof. since that i called many times to customer care and only only assurance that your card is in process and u will get it within week. how i not got till now so i wanna to know from ur expert that how RTI can Help. if possible then pls give me advice full procedure.   13. hi to all members, i am here to share my experiences related to rti act presently m presenting second appeal to SIC bhopal facts are- my questions for state bank of india were- 1} how many officers posted at branches/offices at indore whose transfer orders have been issued for more than 5 months but they have not yet been relieved/provide their names along with the date of their transfer orders 2} inform the specific dates on which they will be relieved and the reason for each officers who have not been relieved till now 3} if the transfer order of any one{officer} has been cancelled then give the name of such officer and the reason thereof i was denied information under section 8 (1)(d) and section 8(1)(j) please suggest me what shud i write in my appeal
  14. Unethical Practices adopted by Banks - Allotment of Lockers Clients are harassed for allotment of Lockers in Public Sector Banks. They demand a bank account in the name of all desirous allottees. In addition they demand fixed deposit - linked to Locker account. This is all contrary to instructions of the banks and RBI. Even after managing fixed deposit, on persuation they will say to submit an application and suggest to follow on after sometime and whenever there will a vacant locker the same will be provided. On submission of application they neither acknowledge nor give any prioroty number. Either the branches are not maintaining any priority register or not showing the same to the customer on demand for entry. There are vacant lockers always in every branch of the banks but the same are allotted to the big guns or well wishers. Above all as per RBI instructions every branch is displaying the board " Lockers Available". What is the use of this board. Kindly explain some guidelines for the users how to take the matter under RTI.
  15. A PSU bank had wrongly debited my friend's loan account twice with an amount of Rs 57,000 for a single transaction. He discovered this after about 18 months. He spent over a month negotiating with the bank to get the amount back but nothing happened. Finally, he approached me for help and a simple RTI application did the trick. Bank returned the amount within one week along with full interest charged on that amount and a request to withdraw the RTI application.

Need experts, get political directors off my back: PSU bank chief goes public New Delhi, June 25: In perhaps the first such case, the chairman and managing director of a PSU bank has gone public to protest the presence of directors appointed to his board at the behest of the ruling party. “I have requested the government to reconstitute the board and I welcome people who have integrity and who can contribute...Banking is a highly complicated sector and we are custodians of depositors,” he said. “The bank board should be professionally represented so that it can contribute meaningfully,” said R P Singh, CMD of Punjab and Sind Bank, at a press conference today. Last month, The Sunday Express had reported how the UPA government had crammed at least 32 of the 37 positions for independent directors (called in bank parlance, “non-official” directors) with men and women known for their allegiance to the Congress party. Surprisingly, Singh is getting support from the highest quarters. Sources said he got the Finance Ministry’s OK to hold the press conference and moves are on to sack at least two of the five independent directors. According to Singh, as the bank tried to reduce its non performing assets (NPAs) — from 17% two years ago to 2.4% today — defaulters felt the “pinch” of the recovery initiative and some of them “have been approaching the non-official directors for gaining concessions in settlements.” Since the bank refused relief, these directors “have launched a false propaganda against” the bank’s management, he said. When the bank would go for auctions to sell distressed assets like properties, “we were put under pressure by these directors along with other political pressures from the sides,” said Singh. “We were told not to go for sale and take the settlement route,” he said. This route yields less money than an auction route. The bank directors include Krishna Mohini, former Congress MLA from Solan, Himachal Pradesh and vice-president in the All India Mahila Congress; Harcharan Singh Josh, former secretary of the AICC minority cell; Umesh Kumar Sharma, former general secretary of the Haryana Pradesh Youth Congress and K K Sharma, former AICC Secretary. In their complaint to the PM on May 25, these directors appreciated the Congress “tradition” of appointing party loyalists on PSU bank boards.     Bank Account details

    A petrol pump, allotted under ST, i.e. reserved category, is having a bank account. The ST person sold out the petrol pump to non ST candidate and Non ST person operates bank account of original petrol pump firm. I had asked the bank account details from the bank but bank refused information under the plea of fiduciary capacity. As per my understanding, the Act and Law protects only those who obey the Act and Law. Here, the a/c being operated by a dummy person. Hence, he is not a bona fide a/c holder. He can never be a dealer of ST petrol pump. Hence, it is an act of violation of the law and guideline. Will anybody please provide me the reasons to justify my RTI appeal for the information?
  18. Hi all, I am a new member on this platform. Greetings to all. My query arised when our bank (HDFC) refused our request of Solvency Certificate due to their internal policies. This certificate is a must for us to apply for Customs license. We have no other option but HDFC as we have a current A/c with HDFC only. Please suggest how I can get the said certificate or any other alternate if available. Regards, Khalid
  19. Hi, I opened a new savings account in ICICI bank for my mother in 2002. At the time of opening the account I provided all the required documents including proof of age and based on that they recorded her date of birth in the account details. At that time she has short by few months to become senior citizen. She became senior citizen in April 2003. This account is of "optima flexi savings account" type wherein Fixed deposits gets created automatically in the chunk of Rs5000 if balance in my account increases beyond Rs10000. It came to my notice recently that all these years ICICI bank has been applying interest rate of non-senior citizen only(which is 0.5% less) for all these fixed deposits. On enquiring, they do not have any single answer. Sometimes they say that it is a mistake on their side as their computer system has a limitation that can not apply the senior citizen rate on these FDs which are created automatically. Sometimes they reply that we should have asked bank to upgrade the account to senior citizen account in writing once account holder became senior citizen after openning the account. I dont know what to believe. What can I do in this regard ? As per our calculations we are loosing big enough amount of money to spend time in fighting for it as I used to keep good amount of balance in this account. Thanks, -PK

  22. Many members of this forum have been successful in obtaining information from Pvt Banks and companies through their respective regulatory bodies. The extent of information which can be sought is still vaguely defined. Could learned members such as Sidmis and others please come forth and reveal as to what exact information was sought by them and what was given. I intend for this thread to act as a reference point to see as to what exact details can be sought for from these regulatory bodies.
  23. Hello Everyone, I have a savings a/c in a MNC bank and they have deducted around 900/- for not maintaining a sufficient balance without even informing me. Can they do it without informing the customers? Does it fall under Banking code of conduct? Can't we challenge the amount they have deducted as its too much and moreover will they give it every quarter if we maintain sufficient balance in the account. Loan info: RTI at co-owner's disposal As reported in the Times of India, 12 Aug 2008, TNN AHMEDABAD: The Central Information Commission (CIC) has held that a co-owner of land on which loan has been granted by the bank is entitled to have the information about the loan under Right to Information (RTI) Act. Mukhatyarali Kuereshi of Fatehpura in Vadodara sought information under RTI from the general manager and the central public information officer (CPIO) of State Bank of India's (SBI) local head office in Bhadra. Kuereshi wanted to know information about a loan taken from SBI, the name of the person who availed of the loan, the amount of loan taken and the outstandings. He also wanted the name of co-owners of the land who had given their no objection consent on granting of the loan as also names of the guarantors of the loan account and whether they too had availed of loan facility from the branch. The CPIO denied the information but the appellate authority directed the CPIO to seek consent of the other co-owners as third parties and incase they agree then to furnish the information. Notices were issued to all nine co-owners and as one of them objected to disclosure, information was denied to Kuereshi. CIC ruled that except the information regarding whether the guarantors had availed any loan facility, as Kuereshi was a co-owner of the land on which loan had been granted, all other information had to be given within 15 days and disposed off the appeal. I have been assisting one of my friends in getting information under RTI Act of his NSC loan account from a nationalized bank, which has not been giving it on simple requests, as large amount of money has been defrauded in the account with staff collusion. I have following queries: 1. The RTI application was submitted at designated post office, which accepted it with Rs.10/- fees. However, the Bank insisted that we should pay Rs.10/- again to them, as application fee and averred that post offices are not authorized to accept RTI applications for central government undertakings. 2. We had sought internal audit queries and replies by the branch pertaining to friend’s own account. The information was denied stating as under: “The information sought by you are of commercial value therefore they are prohibited as per the provisions of RTI Act. The disclosure of such information has no relationship with any public activity. Moreover these are all internal matters which cannot be shared with public.” 3. We had requested for certified photo copies of circulars of head office/controlling office which prescribe procedure of disbursement of NSC/KVP loans. The information is declined for the following reasons: “The circulars are meant for internal circulation only, therefore it cannot be shared with public. The disclosure of such information has no relationship with any public activity. Therefore they are prohibited as per the provisions of RTI Act” 4. PIO has supplied photocopies of some papers without certifying them as true copy. We had asked for certified photocopies. Does it amount to improper compliance? I shall be obliged to have opinions/suggestions on these issues.
