  1. The appellant had sought information and a copy of order by which one Munna Ansari was using government land for living. PIO, SDM And FAA(may be collector) did not respond to the appellant so he approached the Commission. Commission directed the respondent PIO(SDM) to provide point wise information. In this appeal Commission remained silent on defaulter PIO(SDM) and FAA(may be collector), why? Why ICs do not take any action against such PIOs and FAAs who are senior revenue officers? Rayagada, May 2: Inaugurating a two-day workshop on RTI-CMM (Right To Information-Central Monitoring Mechanism) for PIOs (Public Information Officers), APIOs (Assistant Public Information Officers) & FAAs (First Appellate Authorities) in the DRDA conference hall, the District Collector Sri Jagannath Mohanty said, “though the propounders of RTI Act like Sri Harsh Mander had a noble intention while conceptualizing the framework of the Act, in the recent past, the Act is seen more misused than used. During my stint as a Sub-Collector, even I have been blackmailed by an information seeker who sought information under this act. Some people are extorting money by using this Act and have made this Act a means of business. Of course the Act can be used as a tool to retrieve justice from the erring officials who harass the retired govt employees running for pension from pillar to post and in similar other cases. The information can only be rendered only if it exists and information for a period more than twenty years can’t be given. It is a pity that some information seekers, claiming themselves as consumers, are approaching the consumer forums even if remedial measures exist under the RTI Act. In fact the information seekers are not consumers and approaching consumer forums is not actually warranted. We, as public authorities, do not have a right to exploit and this Act has become a panacea to maintain equilibrium in the system.” He suggested the representative of Luminousinfoways, the facilitator of the workshop, to lead the workshop in practical terms rather than being theoretic.   4. Nagpur: A simple but serious RTI query and a letter of complaint awfully exposed corruption and malpractices rampant in the office of Collector of Stamps/Sub-Registrar, Nagpur. Subsequently, the complainant has requested the concerned higher authorities to stop all project registries and to initiate action against the Collector of Stamps /Sub-Registrar, Nagpur for alleged fraud and causing huge loss to the Government exchequer.   5. Hello friends! I had filed an application under the R.T.I. Act with the S.P.I.O. (A.D.C.) of my area's Divisional Commissioner's office and another with the S.P.I.O. (Additional Collector) of my District's Collectorate. Both R.T.I. applications were filed to get copies of monthly reports which are sent by the Divisional Commissioner and Collector, separately, to the state government regarding their inspection of various offices under them for verifying the implementation of government policies and orders. Both the S.P.I.O.s did not provide the information. After 30 days, I filed my First Appeals with the F.A.A.s- Divisional Commissioner and Collector, respectively. As soon as the Divisional Commissioner received my First Appeal, he sent his clerk to locate me and to ask me the "motive" for demanding reports even though asking such a thing is against the provisions of the R.T.I. Act. I told the clerk that I just need the reports- That's it. Some days later, I received the notice of hearing from the D.C. but due to some unavoidable circumstances, it was not possible for me to attend the hearing on that day so I sent my representative with an authority letter for the hearing. Upon reaching there, the same clerk misbehaved with him by trying to talk to him very rudely. He asked about me and said that nobody can represent me, the D.C. will mark me absent and my representative will have to go "empty handed". After speaking with the D.C., the clerk came back and asked my representative to go inside the D.C.'s office. When my representative went inside, he was very rudely asked by the clerk, as per the wish of the D.C., to remain standing in front of the D.C. My representative opposed but the D.C. said that this is how D.C. Court functions. For 5 minutes, my representative was made to stand. Further, the S.P.I.O.- A.D.C. was not present. When my representative asked about the A.D.C., the D.C. told him that it is he who decides whom to call and whom not to. The D.C. ignored every fact of the matter and asked my representative verbally to ask me to pay money if I need any information. Now, I have received a notice from the Collector for his hearing. The letterhead says- "Court of the Collector & District Magistrate". This time I myself will be going for the hearing but I fear the same harassment as was done to my representative by the D.C. What has the D.C. Court/ D.M. Court have to do with the R.T.I. First Appeal? If this treatment was wrong by the D.C., what can be done? Please guide. Thanks & regards.
  6. friends, I have filed a complaint to "collector" office on few issues and crimes. As usual, I feel that they have dumped and thrown the complaint in dustbin as no reply / response is received till date ( as it has happened in past so many times). Now, what specific questions to ask so as to know why they have not taken any action on the complaint and also how to nail the corrupt & irresponsible officer for not taking action as they are very shrewd to shrug off their hands and expert in passing the buck.. regards, namitabh

    Rs 175 per sq ft for Borivli plot

    As reported by Varun SIngh at mid-day.com on 17 Sept 2010 That's the rate at which housing society got collector's 3,080-sq-ft disputed land A 3,080-ft plot in the prime location of LT Road in Borivli (W) was given away by the government to a housing society for a throwaway price of Rs 5,39,000. This comes to a measly Rs 175 per sq ft, when the going rate in the area is between Rs 8,000 and Rs 10,000 per sq ft. The land belongs to the collector and it has been given to a group of 11 members under the banner Swami Samarth Co-operative Housing Society Ltd. RTI documents available with MiD DAY show that nine of the 11 members are government officials and one works in a nationalised bank and the other in a semi-government organisation. The deal, according to papers available with MiD DAY, was finalised in October last year. However, the name of the society was put on the property card in February this year. According to the collector, the land has been leased to the society with rights of occupancy and development. The Bhandari family, who occupy a small portion on the controversial land, have taken this matter to court. Advocate Vinod Sampat, who is representing the Bhandaris, said, "The land has been occupied by a family for nearly 40 years. The government has to first acquire the property to allot it to someone else, which was not done. The government in a haste has handed over the property to some co-operative society and that too at throwaway prices." The Bhandaris say The Bhandaris claim that they have been staying on the same land for the last 40 years. "The electricity bill, the property tax receipt, ration card and other important documents bear the family's names. How can the government one day decide to give away the land to someone else, without informing us? A few men came to survey the property in August, after which we approached the court, which ordered a stay on the whole thing," said Rakesh Shetty, legal advisor for the Bhandaris. Shetty further added, "The Bhandaris also own a small flower shop in the premises, for which they have the required licences and permissions." Shetty further claims that when they investigated about the members of Swami Samarth Society, they found that they already have flats in their names. "These people want to develop a building over here and exploit it commercially and even destroy the garden within the premises, along with nearly 25 trees that are decades old," he added. The law states that if one has a house in their name in Mumbai limits, the person cannot avail of any housing scheme under the government.

Bikaner collector fails to reply under RTI, fined as reported in Times of India, TNN, JAIPUR: Jun 5, 2010, The chief information commissioner (CIS), Rajasthan, S D Kaurani, has imposed a penalty of Rs 25,000 on district collector of Bikaner for failing to answer some questions under the RTI. The matter relates to an application filed by one Sripal Jain on December 11, 2008 seeking information regarding deployment of election officers in Bikaner (west) assembly segment during the 2008 Vidhan Sabha polls. The applicant had sought information like names of poll duty employees, whose duties were cancelled, on what ground duties were cancelled, details of the officers who performed their duties, details of employees on duty in all the seven assembly segments of Bikaner during the 2008 assembly polls. The CIS has directed the Bikaner collector to deposit the amount within 30 days and extract the amount from the official responsible for the lapse. Besides, the commissioner has asked the collector to give all information sought by the applicant within the next 10 days.     RTI fallout: Collector fined as reported by Faizan Ahmad,TNN 12 Oct 2008, Times of India Cartoonist R K Laxman’s common man is no longer a hapless commoner. Armed with a constitutional weapon provided by the Right To Information (RTI) Act, he is now empowered enough to expose the powers-that-be and ensure the erring ones among them are taken to task. This is exactly what Ram Pravesh Rai has been doing for sometime now. This 48-year-old farmer from Buxar has almost dedicated his life to dig out the truth buried in official files and expose the erring babus. Thanks to his relentless efforts, a district magistrate (DM), who once sent him to jail, has been fined by the State Information Commission (SIC). The former Buxar DM, Vishnudeo Prasad, was fined Rs 25,000 by name and the money has since been deducted from his salary. His successor in Buxar was also slapped a fine of an equal amount. But at a later meeting of the full bench of SIC, the recovery of fine from the present DM has been stayed. Rai, an activist of Soochna Ka Adhikar Manch, is often seen carrying a heavy bundle of photocopies of official documents he has procured through RTI, and even a cursory look at these documents provides enough evidence of corruption, embezzlement of government funds and evasion of taxes worth several crores of rupees in Buxar district alone. The information he has secured concerns implementation of three government-sponsored schemes - Million Shallow Tubeless Yojana, Pradhan Mantri Rojgar Yojana and the scheme for loan to purchase tractor - during the last six to seven years. "What is surprising is that such corrupt practices continued not only during the RJD regime but also under the ‘sushasan’," rued Rai, showing the documents. Chief minister Nitish Kumar too knows most officials do not want to supply information to public. "Justice can be provided to people through RTI but the problem is that some officials with old mindset are hesitant to make official information public," he once said at a function of SIC. Noted social activist Parveen Amanullah, the founder head of `Soochna Ka Adhikar Manch’, said since the information dissemination mechanism is still in a very early stage, it is not functioning satisfactorily. "The officials are supposed to keep details readily available but they are not doing it," she said. SIC spokesman Rambadan Baruah admitted that certain officials are still hesitant to share information with people. "The scenario has changed after the commission ordered posting of public information officers in each department and government offices," he said.
