  1. friends, I have filed a complaint to "collector" office on few issues and crimes. As usual, I feel that they have dumped and thrown the complaint in dustbin as no reply / response is received till date ( as it has happened in past so many times). Now, what specific questions to ask so as to know why they have not taken any action on the complaint and also how to nail the corrupt & irresponsible officer for not taking action as they are very shrewd to shrug off their hands and expert in passing the buck.. regards, namitabh

In a certain complaint case, a Consumer Court in their orders have directed the Opp. Party to make certain payments to the Complainant towards refund of the amt. paid by him to the Opp. Party with interest thereon from the date of the payment till realisation and another sum towards costs, compensation and reliefs etc. The Opp. Party now desires in a telephonic message to the Consumer to personally collect the cheque from their office and acknowledge receipt thereof " IN FULL AND FINAL SETTLEMENT OF THEIR ACCOUNT". The question is: What shd the Complainant do? Should he comply with this requirement as desired by the Opp. Party? How shd he go about all this matter? Pl. elucidate the modus-operandi the Complainant should adopt in this matter.THANKS & REGARDS.
  3. Could the group members please elaborate the process of filing a complaint to the CIC. I went to the CIC website read through the content to identify first whether a complaint was applicable in the case. [Not receiving correct answers to my questions] I filed an online complaint, a complaint no. was given to me. The status says "Signed copy awaited". Do how do I forward a hardcopy, each page signed, with a print of the the online complaint.
  4. Based on my complaint about misconducts as per T.N.Govt. servant conduct rules the inquiry was initiated. The erring officials were asked for explanation. Through RTI application I have asked for the copy of explanations given by erring Official. It was denied as private information by PIO and AA. Now matter is pending before SIC. No reply were given on action taken report as of today. They deliberately delaying the process. need help to face SIC with relevant citations and orders.
  5. An applicant under the RTI act is also a consumer. I understand that the applicant can approach the consumer court in case information is not provided by the CPIO. My query is whether the applicant submit the first appeal and simulatneously file a petition in the consumer court? Will the consumer court direct the PIO to provide the information or just grant the compensation to the applicant? Whether non-supply of information can be the ground for getting compensation or the applicant has to prove something more?
  6. My brother completed his BCA from Madras university in the year 2005 with arrears. He later cleared all his arrears in the year 2008. His certificates didn't reach his college and hence they asked us to go to the University directly. We kept going to the University once in every months and didn't get a proper reply. They kept asking us to come back once in every 2,3 weeks but kept giving different replies and finally we reapplied and after few months we got the Provisional certificate alone. We didn't get the consolidate marksheet and Degree certificate. We kept going to University frequently for these certificates and we reapplied for Degree certificate and Consolidated marksheet again giving a photocopy of the provisional certificate before 3 months and gave a self address envelope. It's been 3 months now and we have gone to the University atleast 6 times and we are not getting a convincing reply. They said they will send it to us but we aren't receiving it, The company in which my brother is working has put a hold to his salary unless he produces his certificates now. We are not sure what to do do get the certificates?. Is there an address or phone no we could complain so that we could get his certificates at the earliest?.

Respected Sir TRANSFORMER installed illegally & without consent on VARALAKSHMI NAGAR , ONDIKUPPAM , MANAVALA NAGAR 602 002 , P.H.ROAD , THIRUVALLUR , TAMILNADU TRANSFORMER INSTALLED CLOSELY TO THE RESIDENCE AS WELL IN 15 Ft ROAD IN CONGESTED AREA , THOUGH RESIDENTS SUGGESTED ANOTHER PLACE. We , the residents of Varalakshmi nagar requested and submitted our objection & request letter on 09/07/2010 , But they never considered our request. As there is only 14 Ft road is available for vehicle movements, and very near to residence , there is a lot of possibilities for accident. Even there is heavy sparkle coming on every night which threatens the innocent peoples passing on that road and we feel that very dangerous. There is a lot of possibility the vehicles to hit that transformer since it is very small road n have turing also . The street get using by lot of residents. We also offered a different spot for the same, but TNEB - JE ,110 KV SUBSTATION officer AT MANAVALA NAGAR didn’t oblige to our request inspite of objections? Please note that we had raised an objection at the first instance when the poles were erected and except verbal assurances the officer didn’t oblige to our requests. I request the TNEB to Kindly do the needful by removing/shifting this transformer at earliest. Kindly advise.   8. :(hi my question is related to supreme court of India> if the petition is dismissed due to delay and if advocate is responsible for delay in filing petition for SLP and charging a huge amount and later not giving back the amount. where can I complain against the advocate and what action should I be taking i am a female dealing with injustice I have already complaint to the bar council ,the supreme court of India, chief justice of India and many more authorities and in police station also the day I came to know about his fraud its almost 4months now but have not received any information related to my complaints can u plz guide and tell me what all I can do now I want permission to reappear in the court and I want my huge amount back which I gave it to this advocate of mine he mislead me and harassed me a lot I have the evidence against him what do I do.

While deciding a writ petition filed by Mr Praveen Kumar Jha, an employee with the BHEL Education Management Board, Hon’ble Delhi High Court has set aside the order of the Central Information Commission imposing the cost on the “Information Seeker/ Complainant”. In the instant case, the Commission has held that the Complainant is in the habit of filing “frivolous applications” and hence suggested to the Public Authority to take disciplinary action against the Complainant and also recover the cost incurred on the transportation of the Central Public Information Officer for coming to Delhi for attending the hearing at the Commission. Commission directed the BHEL Education Management Board to recover the cost from the salary of the Complainant. While challenging this decision of the Commission, Petitioner/ Complainant alleged that the Commission has no such power to impose any cost to the Complainant and also pleaded that while deciding the complaints filed by the Complainant, the Commission over stepped its powers and without giving any opportunity to the Complainant/ Petitioner, imposed cost on him and directed the Public Authority to initiate disciplinary proceedings. Justice S. Murlidhar while passing its order on 12.01.2011 set aside the order of the Commission imposing cost on the Complainant and recommending disciplinary proceedings against him. Justice Murlidhar held that the Commission has been given some powers of a Civil Court under Section 18 (3) of the Right to Information Act, but the Commission has not been vested with all inherent powers of a civil court. In absence of any such power, there is no legal basis for imposing cost on and directing disciplinary action against the Complainant. The order of the Commission has been set aside.     Complain Against Buider

    Hi, I have purchased a Flat in Badlapur on Dec 2009. After Three Month We will take a possion from Builder that time Builder has not given US Electric Meter he tole us meter will be coming in next 2-3 months there were some issue with M.S.E.B. And Builder given us one Common Electric meter to the Building where around 14 People are Living. But Yet Builder is not given us Individual Our Meter . From Mar-2010 to Sep 2010 We 14 People are Paid the Electric Meter Bill thourgh Contribution as well as water Bill & Watchmen Bill. But in Sep month We all told him we will only give u 500 RS. for Electriccity that time he has agreed but now he demanding us Three Months Bill (58000) means every person around 1000 plus amount. So Please guide us What can We Do ?? Builder got the Completion Certificate From Corportion but there are some work yet is pending from him & he is not ready to complete the same 1> Dreange work is uncomplete 2> Several Damage work is uncomplete 3> yet we have not got the Individual Electric City meter Please suggest us what we can do ??   12. Dear Sir, I purchased an Nursery School form by the Darshan Academy (Nur-Wing), Add: Kirpal Bagh, Sant Kirpal Singh Marg, Delhi-110009. It also give me the prospectus which i don't need. I told them today I read it in the newspaper that it is not necessary to take the prospectus. But they did not agree and give me the prospectus. So i want to ask that the news published by Education Minister is right or wrong. Or just publish the news in the Newspaper Hindustan(hindi) is just a formality by Education Minister. Kuldeep Rajput
  13. Hi all, I've applied for my passport renewal 8 months back. Usual story of incompetency of High commission of India, London. In reply to my last RTI they now refused to even accept that there is an application pending for passport renewal. I've sent e-mail to Appellate asking him to provide me the required details. 3 days passed I didn't get any reply. Having fed up with these incompetent thugs now I want to file complaint in CIC against PIO for providing me false information. I've all the records, e-mails etc from previous RTIs. Following are my queries 1) Shall I file a formal complain with Appellate before proceeding to CIC? 2) Is there any draft for filing complaint in CIC which I can download and upload on CIC complaint page? I've checked CIC complaint page and it is little complex.

As reported in timesofindia.indiatimes.com on 28 August 2010: Now, your RTI complaint is sure to be registered - Lucknow - City - The Times of India Now, your RTI complaint is sure to be registered LUCKNOW: In order to provide respite to applicants, the Uttar Pradesh State Information Commission (UPSIC) has taken a positive step. The complaints made by the applicants will be heard in the commission in all instances. The chief information commissioner (CIC), UP, has issued an order in this regard saying that complaints made at the commission by applicants be examined and registered under section 18 of the Right to Information Act, 2005, for further action on them. The CIC has also directed information commissioners (ICs) that notice be sent to the public information officer (PIO) of the department, against which the complaint has been made. The RTI applicants whose complaints were not heard and sent to the departments as first appeals were facing delay and difficulties. The CIC, therefore, has issued an order saying that PIO should be asked by the commission to provide information to the applicant within the specified time. And if the officer is unable to provide the information within the specified time period then the applicant should be informed about it. Besides, the order also says applicant should be given a reason by the PIO for delay in providing the information. When contacted, ICs agreed that in most cases complaints are heard. And in certain cases if complaints are sent back as first appeals to the department, it is done only after hearing has taken place. Commission cannot refuse to hear complaints as that is provided under the Act, was the common opinion. On the other hand, RTI activists are of the opinion that in some cases, UPSIC was not accepting complaints under section 18 of the Right To Information Act. On the contrary, complaints sent to the commission by applicants were being converted into first appeal under section 19(1) of the Act. The appeal was then sent to the first appeals authority of the department and the complaint was disposed of in first hearing. "Applicants were a harassed lot due to this," said activist, Urvashi Sharma. In case, first appeals authority did not respond to the appeal, applicants had no option but to move second appeal to the commission and wait for hearing. The activists had taken up the issue with UPSIC, the governor and the chief ministers' office. The commission finally has taken note of the activists' complaint and issued the order. It has therefore, been made compulsory that complaints of applicants be heard.
  15. I have yet to receive a reply from the Puducherry Fire Department -- in fact the due date for reply was several days ago. It's clear this department wants to avoid answering my RTI application, therefore my only recourse seems to be: 1. First appeal to FAA --- How to write First Appeal under RTI? - RTI Guide 2. Additional complaint to Puducherry CIC --- COMPLAINT UNDER RTI ACT 2005 - RTI Guide I have tried to check up specifics with regards to complaint/appeal procedures in Puducherry, but I could only find this --- Right to Information Act-2005 I hope I am on the right track here? Should I ask for disciplinary action/fines against the errant PIO for not providing me information on time? Any further comments would be appreciated. Gerard

Chandigarh, April 1: In a recent judgement, the office of the State Information Commission, Punjab (SICP) has imposed a fine of Rs 25,000 on the Public Information Officer (PIO) on his failure to provide information to the complainant within the stipulated period of 30 days under the Right to Information (RTI) Act. The two-member Bench of State Information Commissioners P.P.S. Gill and R.K. Gupta has taken serious cognisance of the fact that despite orders from the Commission, the required information was not supplied within the prescribed time period. Gurdial Singh, Finance Secretary, Pensioners, Ludhiana, had sought information from the PIO, Director of Employment, Punjab, regarding some recruitments since 2004, but even after over two months, Prem Singh, Under Secretary, PIO, along with Harbans Sharma, Employment Officer, and Harjit Singh, Senior Assistant, failed to provide the information. Even when Gurdial Singh approached the Commission in December, the PIO failed to comply. On March 16, the respondent, on behalf of the PIO, told the Commission that the information has been dispatched by them on March 12. However, the complainant denied having received any information and nor could the respondent produce any documentary proof. The Commission not only imposed a fine of Rs 25,000 on the PIO, but also ordered that compensation be paid to Gurdial Singh for harassment. I live in chennai, the place next to is being demolished,they had 4 ventilators on the compound wall all of which opened in to our home,our is a indipent house not a street house,I have planted a lots of plants in my garden in all my open space,the neighbour demolished 2 of his windows and has not demolished the bathroom and the ventilator of the same which opens in to my home,and he demolishes in mid night with big bulldozers,with out covering our side with the sheets.so I wanted to know the possibility under law whether he could still have the old ventilator on the compound wall .what actions can I take.

As reported at thehindubusinessline.com on March 25, 2010 The Central Information Commission has been able to resolve almost 75 per cent of the total complaints/appeals received by using the Right to Information (RTI) Act. The Commission disposed off about 45,000 cases over the last four years till February 2010, out of the total 60,000 odd cases filed, according to Mr Wajahat Habibullah, Chief Information Commissioner. There has been an increase in awareness of the RTI Act which is evident from the sheer increase in the number of appeals received on a month-on-month basis. “In the first year of the introduction of the Act we were receiving about 60-70 appeals in a month, which has now gone up to about 2,000/month,” Mr Habibullah said while speaking on the sidelines of an inter-active session organised by the Merchants' Chamber of Commerce here on Thursday. The Commission, Mr Habibullah said, had been receiving complaints/appeals across a wide range of issues. “While we receive appeals pertaining to kerosene, ration card and land allocation from the poorer sections of the society, we have also been receiving appeals from affluent people pertaining to their ancestral properties or from members of political parties,” he pointed out.   21. Hi All , I'm happy that finally got a forum where I can share some views regarding Customer / Consumer Complaints. But at the same time I'm confused, if the contents are relevant or not... Well... I think with the continual use of technology in our daily life - Mobiles, Desktops, Laptops, I-pods, etc... many a times we feel, that "I was not given as promised...", "I was misleaden...", "I was made a fool..." to outright "I WAS SWINDLED...". I have found majority of my Friends, Colleages, Relatives, suffered mostly with their Mobile Handsets (of various makes & costs). One of the reason being there easy availability and frequent changes into new models. I want to first concentrate this thread into "Complaints towards Mobile handsets - Branded & Unbranded"...   23. I and my wife are in insurance business. We have faced a problem since last year Some people do take the policy and give us the cheque but as the policy document proceeds, the cheques are dishonoured by Bank due to STOP PAYMENT The reason we found is that this people need the Insurance Premium Receipts for NO DEDUCTION IN SALARIES, they receive from the Employer. HOW WE CAN COMPLAINT AGAINST THESE FRAUDS? DO THE INCOME TAX DEPTT TAKE ANY ACTION AGAINST THIS TYPE OF PEOPLE. Example XXXXXXX XXXXXXXXXXXXX

    Complaint vs. Appeal

    It is surprising to see that not many of us realize that the RTIA2005 provides two methods of approaching the CIC/SIC. These are 1. Second Appeal and 2. Complaint. However, not many of us are sure about the use of these two options. It would thus be desirable that the experienced members of this forum please shed some light on the difference between the two and which is a better under what circumstances. I intend for all aspects regarding the same to be discussed. Eventually it would nice if the forum leaders could include this in the guide as the present guide only lets us know about First and Second appeals.
