Angry over missing Govt file, Bombay High Court directs FIR against officers MUMBAI: Observing that information under Right to Information Act (RTI) cannot be denied to a citizen, the Bombay High Court has directed Deputy Secretary of Urban Development Department in Maharashtra to register an FIR against officers responsible for a 'missing' file. A division bench of the HC further directed that after filing the FIR, the investigation must be completed within six months and it should be headed by an officer not below the rank of Deputy Commissioner of Police. Justices Abhay Oka and A S Gadkari imposed costs of Rs 15,000 on the State Government for the lapse on part of officers which led to a UDD file going 'missing' as a result information under RTI Act couldn't be provided to an advocate. "The case in hand is a classic example as to how the Government officers protecting their fellow officers tend to frustrate the basic intention of the legislature behind the enactment of the Right to Information Act, 2005," said the Judges in their order on Friday. The HC was hearing a petition filed by Sangli-based advocate Vivek Vishnupant Kulkarni, who is also an office- bearer of Swatantraya Veer Savarkar Pratishthan, a voluntary group which runs two schools having 1,600 students on rolls. The 58-year-old petitioner filed an application on September 5, 2008, with the Section and Information Officer of UDD seeking information under RTI in respect of a Government Resolution (GR) dated August 21, 1996. The resolution pertained to release of various lands in and around Sangli city in western Maharashtra which were acquired by the Government under the Urban Land (Ceiling and Regulation) Act, 1976. He sought information about the Government notings and other documents on the basis of which the GR was issued. By a communication dated September 22, 2008, the UDD Information Officer told Kulkarni the required information sought by him regarding file ULC/1089/2123//ULC-2 is not available on the Department's record and therefore, the said details cannot be furnished. In the same letter, the petitioner was also informed that some details sought by him is connected with the office of Deputy Collector and his application to that extent had been transferred to the said authority for further action. Being aggrieved by inaction of the Information Officer, the petitioner filed an appeal on November 27, 2008, before the Deputy Secretary of UDD. The Deputy Secretary asked the Information Officer to search the missing file and give the details sought by Kulkarni immediately. The issue of installation of ACs in the two court buildings, visited by thousands of litigants every day, has been brought to the Delhi High Court by a lawyer who had earlier sought information in the matter through the Right to Information Act. The High Court was told that the absence of air-conditioners in the court rooms had created unhealthy and inefficient working conditions. A person can use the RTI Act to access an information even if it is available through any other route, Delhi High Court has ruled. ************************************************************************************************************* The court, in a landmark order which will impact number of RTI cases of similar nature, allowed a petition seeking disclosure of communication between Urban Development Ministry officials with those of CBI--an exempted organisation--in a corruption case. In a recent order, Justice Vibhu Bakhru also said that section 8(1)(h) of the Act--which allows an organisation to withhold such information that impedes the process of investigation, apprehension and prosecution--cannot be imposed without giving proper reasons to justify the denial. Allowing the petition seeking disclosure of communication between the Ministry and CBI, he dismissed the order given by Information Commissioner MA Khan Yusufi who had agreed with the Ministry to deny information on the grounds that its disclosure would impede the process of prosecution. Justice Bakhru said neither the first appellate authority nor the Central Information Commission considered how the information sought for would impede the process of probe, apprehension or prosecution of the petitioner, an accused. He rejected the Ministry's argument that during trial, the material relied upon by the prosecution would be provided to the applicant, thereby no prejudice would be caused to him. "In my view this cannot be a ground to deny information to the petitioner. First of all, the question whether the information sought by the petitioner is relevant or necessary, is not relevant or germane in the context of the Act; a citizen has a right to information by virtue of Section 3 of the Act and the same is not condition on the information being relevant," he said. He said the fact that the petitioner has access to the material relied upon by the prosecution does not prevent him from seeking information, which he considers necessary for his defence.

RTI activist TH Naidu, who had sought information related to auction of Sonegaon lake, fought a two-year-long battle to prove that the Court of Wards falls under the RTI Act. Reported by Timesofindia.indiatimes.com on Feb 17, 2015 Supreme Court fixes 90-day limit for suspension of govt employees - The Times of India Protracted period of suspension of delinquent government employee has become a norm and such practice must be curbed, the Supreme Court on Monday said while fixing a period of ninety 90 days for authorities to complete proceedings against such an employee. The court said that an employee suffered ignominy and scorn of society due to prolonged period of suspension. "We, therefore, direct that the currency of a suspension order should not extend beyond three months ... if within this period the memorandum of charges/chargesheet is not served on the delinquent officeremployee," a bench headed by Justice Vikaramajit Sen said. It said suspension, specially preceding the formulation of charges, is essentially transitory or temporary in nature, and must be of short duration. "If it is for an indeterminate period or if its renewal is not based on sound reasoning contemporaneously available on the record, this would render it punitive in nature," the bench said. "Protracted periods of suspension, repeated renewal thereof, have regrettably become the norm and not the exception that they ought to be. The suspended person suffering the ignominy of insinuations, the scorn of society and the derision of his department, has to endure this excruciation even before he is formally charged with some misdemeanour or offence," the bench said The court passed the order on a petition filed by defence estate officer Ajay Kumar Choudhary who was kept suspended for a long time.

National Dairy Development Board (NDDB) subsidiary Mother Dairy Fruit and Vegetable Private Limited has been declared a "public authority" as defined under the Right to Information (RTI) Act, making it amenable to disclosure of information. A Delhi High Court bench of Justice Vibhu Bakhru dismissed the petition filed by Mother Dairy Fruit and Vegetable Pvt Ltd, which had challenged the Central Information Commission (CIC) April 15, 2011 order holding it to be a "Public Authority" within the meaning of section 2(h) of the 2005 RTI Act.   13. Hello, A few of my First Appeals in a department have been disposed because I wasn't present during the appeal proceedings. The appealate authority said appellant not present and is not interested to persue the matter, so appeal is disposed in accordance to General Administration Department's circular. On persuing the matter I found that the state General Administration Department, nodal department for RTI related matter has issued. Guideline type circular for In which it is stated that appellant should be compulsarily called for first appeal hearing and provided legal help if necessary. I would be filing a second appeal with the State Information Commission but I don't think it would set aside the PIO's order easily given its past track record? Beside section 19(5) what should I add to my grounds of appeal? Is there any court judgement in the matter? Requesting learned members help in the matter.

  15. RTI information received from the civic body by Vansh’s father Arun Maheshwari stated that there were 22 parks in Sector 7 and they were not meant for playing. Following the RTI information, the children moved the court. The complaint by the children stated that there was no specific place or playground allocated by the MC or HUDA. The Hindu, 18 Jan 15, New Delhi, Mohammed Iqbal RTI reply supplied to lawyer Amit Sahni reveals that there is no written guidelines regarding installation of ACs in Tis Hazari and Patiala House court complexes. However, the RTI reply said the work in this regard was in progress. Mr. Sahni said he had noticed that in Tis Hazari court, ACs were installed in the offices of almost all the clerical staff, but surprisingly, not in all the court rooms. The issue relating to the need for installation of ACs in the two important court complexes in the Capital, visited by thousands of litigants every day, has been brought to the Delhi High Court by a lawyer, who had earlier sought information in the matter through the Right to Information Act. RTI: Delhi HC admits PIL over patent office’s disclosure policy PIL wants India’s patents office to follow the Right to Information Act in order to make its information disclosure system more transparent Mumbai: The Delhi high court on Wednesday admitted a public interest litigation (PIL) that wants India’s patents office to follow the overarching Right to Information (RTI) Act in order to make its information disclosure system more transparent and easily accessible to the public. “It is an important issue and deserves consideration,” said chief justice G. Rohini about the petition that claims the disclosure policy followed by the patents office flouts the RTI Act. The PIL, filed by a group of lawyers, argued that the Office of Controller General of Patents Designs and Trademarks, which deals with crucial market monopoly decisions, often denies vital information of relevance to the public by invoking provisions in the Patents Act. The court sent a notice to the Central government asking it to respond by 29 August, when the case will be next heard. The petition alleged that the patents office has been following rules laid out in the Patents Act in order to block key information related to the working of patents. The department, exploiting provisions in the intellectual property (IP) law, also ignores the time frame stipulated by the RTI Act for disseminating information and charges a much higher fee for disclosures, it alleged. This is despite the fact that the RTI Act trumps all other information dispensation mechanisms under other specific legislation, including the Patents Act, the PIL claimed. ​ The lawyers group led by Shamnad Basheer, former IP chair at the National University of Juridical Sciences in Kolkata and founder of intellectual property blog Spicy IP, was represented by Salman Khurshid, senior advocate and former minister for law and justice. “A patent is a 20-year monopoly and this monopoly is granted on the promise that the public would benefit through the patent information submitted by the patentee. Transparency and disclosure of patent information therefore lie at the heart of the patent regime,” said Basheer. ​ Patent information is vital and it should be made available in an easy and affordable manner to the public, he added. The patents office argued that it has its own specific legislation governing the dissemination of information to the public, and therefore the RTI Act does not apply. The patents office currently charges at least 100 times the fee charged under the RTI Act, making it prohibitively expensive for the common man to seek information, the PIL said.   21. Hello, I have given the High Court Recruitment Clerk Exam, Pre & Mains have been cleared by me, but they have failed me in the Typing Test, which i can believe and unfortunate. My Query is that, if PIO refused to give me my type test copy, what should be my next step for the same. Whom should i approach as i have to file the case against the High Court Officials.
  22. Under RTI to the PIO , whether can I ask about a Govt. Servant Past criminal history, any pending criminal cases, or disciplinary action is pending ,has he appeared with respect to any criminal court case as a witness or has he attending a criminal court case as a witness. After asking this under RTI, If any case if it is not there , whether will he file a defamation case against RTI applicant.
  23. I am married with my wife on 2008 March. Wife had a conjugal life of hardly 3 months with me, sometime in my native and for 1 month with me, left matrimonial house in 2009. Although my native place is in Raiganj, i live in Kolkata. She and her parents use to abuse me althrough-out. My father expired on April'2012. Earlier father has filed general diary against my wife, her parents on 2010 with local police station and again reported the same on 2011 giving all the details that she does not live with me, not returned bacl and I stay far away from kolkata. Wife filed dVA and maintanance case against me on May'2012. Lower district court send notice to me along with my widow mother and my brother. during june'12. My widow mother accepted her but denied to take notice addressed to me and my brother as a reason that she is not in contact with her children. I have not received/accepted court notice/summons till date although a letter basis court ex-parte judgement on monthly maintanance of 20K and arranging her to stay in my native house was shared to me via protection officer on July 2013. I handed the same to local lawyer. Now court has ordered warrant against me whose executing order is still pending. My wife with help of protection officer brought police along with protection officer, broke lock and keys of my native home last week where nobody stayed. Wife started living along with her mother regularly. Local lawyers told me that there is nothing to worry as because summons/notice were not sent to me through proper channels. Pasting in my residential place, court did not accept the same. No publication in newspaper as well. Although a court record exists that they have sent the same to my kolkata adrress. But I did not acknowldege the same at any stage nor did I recieve. Local Lawyer has done a RTI to get top of it as how the summons were served Particulars of Information to be sought are:- a) To which address the summary of Mr. Suman Ghosh S/O Late Suprabhat Ghosh the O.P No 1 of case no CR 292/2012 of Ld Addl J.M was sent by the protection officer? b) By which process the summons were sent? c) Whether any summon/notice was sent to the address of working place of the O.P No1 Mr. Suman Ghosh of case no C.R.292/12 by the protection officer before 18-12-2012? If so by what mode? d) Whether any summon or notice of case no C.R 292/12 was served upon O.P Suman Ghosh S/O Late Suprabhat Ghosh personally? e) Was there any impediment/objection to serve the summon on him personally? If so what was the reason? Kindly let me know what may be the outcome and how many days does it take to get informations on RTI. I shall be waiting for expert input on the same. Regards Suman

Two brothers, retd colonels, got 31 plots under HUDA quota Two retired Army colonels being probed as part of an investigation into allegedly fraudulent multiple allotment of plots to individuals by the Haryana Urban Development Authority (HUDA) had between them got as many as 31 plots. Karan Singh Yadav and Dharam Singh Yadav, who are brothers, were allotted these plots in various urban estates of Haryana between 1998 and 2004 (including the time they were serving), documents submitted in the Punjab & Haryana High Court show. The scam is being probed by HUDA on the orders of the court. Over 325 FIRs have been registered against beneficiaries, including 188 defence personnel, who allegedly got more than one plot in their name, or in the name of their spouse or children.   25. I gave 100 application to police station about nuisance created by loudspeaker in Gurudwara. Police came many times but the loudspeaker is still creating lot of noise each day in the morning. I also submitted the photocopy of the orders given by the supreme court to the police station. But police still not able to remove the loudspeaker. Please tell me what kind of RTI and to whome i should use.
