LUDHIANA: As part of their peaceful protest against the building branch of the municipal corporation (MC), some RTI activists and residents of Harnam Nagar presented flowers to officials, including the MC commissioner, on Tuesday. Residents alleged that despite several complaints, officials are turning a blind eye towards unauthorized constructions mushrooming in the city. They also accused the civic body officials of being hand-in-glove with the guilty, due to which illegal constructions are sprouting in the city. They further alleged that corrupt practices are prevalent not only in the building branch, but also in other branches of the MC. Even as it issued more than 1,300 notices to violators who have put up banners and billboards without seeking approval from the competent authority (MC commissioner) last year, it is yet to recover Rs 11 crore as advertisement fee. In reply to an application filed under the Right to Information (RTI) Act, the civic body admitted that it failed to take action against the violators. Notices were issued to shop owners, industrialists, jewellers, besides others for displaying hoardings, banners illegally under the Advertisement Control Order, 1954, last year.   5. MUMBAI: The Bombay high court on Monday asked the state to sort out the jurisdictional issues that come in the way of taking action against illegal structures in Navi Mumbai. The court was hearing a public interest litigation filed by a local resident seeking demolition of illegal structures in Digha area of Navi Mumbai. The petition claimed that despite filing complaints, no proper action was taken against unauthorised structures. A division bench of Justice Abhay Oka and Justice Revati Dere sought a response from the government. An query under the Right To Information Act revealed that there were 86 buildings of four to six stories constructed illegally on government land in Digha - 56 structures on land owned by MIDC; while the remaining 30 buildings were constructed on state and Cidco owned plots.   6. Hi, I have filed RTI to West Bengal Municipal Affairs SPIO asking for all the information stated in http://www.rtiindia.org/forum/showthread.php?139858 post. After receiving the RTI application, Municipal Affairs had redirected the RTI application to DumDum Municipality Chairman/SPIO (intimation to me also) within 5 Days of receiving the RTI and instructed them to give all the information sought in RTI immediately and with giving intimation to Municipal Affairs. But unfortunately 30 Days over and I have not received any information from neither the concerned municipality nor Municipal Affairs. I am not expecting to receive any response from Municipal Affairs as they had done their duty to transfer the RTI application to concerned municipality. Now what will be my next step? I would like to file again RTI complain to FAA of Municipal Affairs for non receiving information from SPIO for the RTI application. Could anyone Please guide me how to file the RTI to FAA? Do I need to again give fees for RTI? What will be the format to writting RTI to FAA of Municipal Affairs? Also this time I would like to file the RTI under section 21, as there will be a penalty charge for non replying the RTI application. I am waiting for your reply. MUMBAI: The Bombay high court vacation bench judge Justice A S Gadkari on Friday stayed an order by state information chief Ratnakar Gaikwad that had sought a reply from the municipal commissioner concerning illegal construction behind Haji Ali Juice Centre in south Mumbai by May 15. Gaikwad had, in April, directed the BMC chief to personally file a reply on the steps taken pursuant to its earlier order which sought action against the unauthorized construction at Haji Ali Kinara Masjid. The BMC then moved the HC to challenging the order. PANJIM: 41 technical assistants have been recruited in the PWD even though the government and the finance department advertised for 33 posts. 26 of these recruitments were done from Ponda taluka, the home of the PWD Minister Sudin Dhavalikar. Two of his MLAs from the MGP are also from the same taluka. There were only 33 posts of technical assistants published in the advertisements on two occasions, 22 posts on December 18, 2012 and 11 posts on December 2, 2013. The Supreme Court in the Anupamdas & others v/s State of Assam and others has ruled that that filling of vacancies over and above the number of vacancies advertised would be violation of fundamental rights guaranteed under article 14 and 16 of the constitution of India and that such selection could not claim appointments as a matter of right. It has also revealed from the information which was sought under RTI Act that there was no government’s approval taken by the PWD before the recruitment process of these technical assistant. MC to issue demolition notices to illegal shops LUDHIANA: The municipal corporation will issue demolition notices soon to illegal shops constructed on the road from ESI Hospital to Kochar Market Chowk, after receiving a complaint against the shops. Earlier, MC officials had conducted a survey in the area to find out about the violations done by shopkeepers, after a complaint was submitted to the department by RTI activist Rohit Sabbarwal. It is pertinent to mention here that the complaint was against shops initially allotted to 1984 riot victims in 1987. At that time, there was an agreement that an area of 6*6 feet was being allotted to victims, against a rent of just Rs75 per month, with the condition that these shops should not be further given out on rent or sold. According to information, another point in the agreement was that the allottees were allowed to establish only temporary structures at the piece of land, not concrete buildings. The Mangaluru division of the Karnataka State Road Transport Corporation has been suffering revenue losses to the tune of Rs. 14 lakh every day due to clandestine and illegal operations by various kinds of private bus operators in the region.   12. Information under the RTI Act has revealed that an illegal construction is going on near the department of archeology at Sunet village (BRS Nagar). The area has been declared prohibited. It was learnt that even though the archeological department had served a demolition notice, the construction was going on in full swing. The Archeological Survey of India has even lodged a complaint with the Sarabha Nagar police station, but no FIR has been lodged to date. The process of DOs/Legal assistants/Legal Managers/Law Secretary signing orders of the Commission is not correct and illegal. These officers do not have any such powers. 2. Participation in "penalty proceedings" is at the discretion of the concerned IC hearing the case. Needless to state, the concerned IC has to record reasons if he agrees / or disagrees with the appellant/complainants request to be a part of the "penalty proceedings". - - - Updated - - - TO: 1. All Officers in CIC whose email ids are in the public domain Dear Sirs/Madams, Attached is a Judgement of the Delhi HC dated 27 April 2015. Sum and summary is: 1. I have personally been highlighting this illegal practice by staff and officers of the CIC for last 7 years but no one bothered to listen. I have myself been a victim of such a practice followed by staff and officers of at least 11 present and past CICs/ICs. None of my written representations/complaints or verbal complaints were ever attended or responded to. Please check with Mr Vijay Bhalla and Mr K L Das - who are well aware of the incidents. Ex CICs, Mr Wajahat Habiubullah, Mr Satyananda Mishra, Ms Deepak Sandhu and Ms Sushma Singh were also briefed about this illegal practice, but did not do anything ! In fact the practice continued even after I sent written representations cautioning them about such a practice. Please check with them. Kindly check the records of several ICs and my letters/emails sent to them. You can also check with them regarding my verbal complaints on this issue. I have CIC orders in my possession wherein the DO has stated: "I am directed by the IC ...............to convey to you regarding your second appeal / complaint Nr..........." and these have been signed by the DO - which as it now turns out, is blatantly illegal. As recently as a few months back, I had complained about such a practice in the Registry/Office of IC Vijai Sharma. His DO Mr V K Sharma was adequately briefed about it with several case laws. I had also briefed Ms Devi (Manager Legal) about it and her response was astonishing ! The same was conveyed to Ms T Y Das (Secretary, CIC) and Mr Tarun Kumar (the then JS Law). Please check with Ms T Y Das. Now the same team (under IC Vijai Sharma) has been hauled up by the Delhi HC in this particular judgment ! On the second issue of Penalty proceedings, several of my representations regarding being part of the penalty proceedings in hearings before CIC/SICs have been not responded to. Please remember, that on an average a IC hears about 8 to 10 cases per working day. It is ONLY the appellant/complainant who knows the exact details and finer aspects of his case. Why not allow him to participate in the penalty proceedings, specially if he has specially requested, so that any flaw in the PIOs response to the show cause notice, is immediately pointed out. Isn't this necessary in view of the prime object of the RTI Act 2005 : TRANSPARENCY ? Surely, deciding something behind a appellants/complainants back cannot be considered as "TRANSPARENT". Is it too much to expect CICs/ICs to follow the rule of law, proper procedures, record keeping, heed to citizens suggestions/complaints and at least RESPOND to written communications about incorrect practices being followed in the CIC ? Sachin Gaur (RTI activist) was not only not allowed to check the records of the place, he was manhandled by some 8-10 goons and also booked in the Sector 4 police station for simply exercising his democratic right of asking certain questions.When recently Gaur read an article in an English daily about a 'ghost construction,' going on in the Sector 4 near HUDA District Ayurvedic office, he was intrigued. The English daily was calling it a ghost construction, since no one (either HUDA or MCG) was taking responsibility of the construction. Gaur, being an activist filed three RTI's and he received one reply from the CMO office. Cosmos City project sale illegal, says DTCP GURGAON: After TOI reported that around 400 investors were allegedly duped by a developer in a multi-crore housing scam in Sector 103, a government probe has revealed that Adel Landmarks violated norms by selling off the Cosmos City project on Dwarka Expressway to another developer after taking 25% of the cost for each flat. The report by the department of town and country planning (DTCP) has recommended strict action, including filing of FIRs, against Adel Landmarks for selling off its subsidiary company, Identity Buildtech Limited, which was developing the Cosmos City project, to another builder - Ansal Housing and Construction Limited - without the department's knowledge and allegedly cheating 432 investors. The report, prepared by the then senior town planner Kamal Kumar has come to the fore, thanks to a response to an RTI query by one of the investors, K K Khurana. According to the probe report, Adel Landmarks Limited sold off Identity Buildtech Limited, along with all its assets, by entering into a share purchase agreement with Ansal Housing and Construction Limited. The whole process - which amounts to transfer of license - had taken place without the knowledge of DTCP, the licensing authority. In fact, the probe was ordered by the then principal secretary of town and country planning, TC Gupta, after TOI had exposed the scam in July last year and reported that a project by the second builder was coming up on that land. The then senior town planner, Kamal Kumar, carried out the inquiry. Kumar has recommended action against the developer for breach of terms and conditions of license. "DTP (enforcement), Gurgaon, has sent a complaint to the commissioner of police, Gurgaon, for lodging an FIR against the offenders," he said in the reports. When contacted, the additional chief secretary to DTCP, P Raghvendra Rao, told TOI, "After the case came to light, the department had even initiated action against the developer and a show-cause notice as to why the builder's licence should not be cancelled was issued to the builder." He added, "During a hearing, Adel's representatives had said that the claims of all investors would be settled by refund of their money along with interest. Hello, I need to know how to complain against a coaching centre running just next door to my DDA flat (doors are just opposit each other with a 6 feet gap), its a big nuisance with so much of noise, students standing in groups, rash driving, foul language, need to understand where to complain against this...Moreoevr, they do not have license or registration to operate coaching center, thay are paying all residential rates not commercial rates.

NGT Registrar General passed 'illegal' RTI orders as FAA: CIC New Delhi: Central Information Commission has come down heavily on Registrar General ofNational Green Tribunal for issuing "illegal" orders "without application of mind" on RTI pleas, saying such actions will obstruct furnishing of information and scare away applicants. While issuing a show-cause notice to Registrar General Sanjay Kumar, Information Commissioner Sridhar Acharyulu also recommended that he be replaced from the post of First Appellate Authority (FAA) under RTI matters at the Tribunal. Kumar, the senior most officer in NGT, was directed to explain why he passed "such illegal orders, why he spent so much of time without hearing the appeal within the time prescribed by the Right to Information Act and insisted on personal presence and presentation of affidavits." Acharyulu said as the NGT is suffering from absence of coordination within the office, the Environment Secretary should look into administrative problems of the Tribunal. The case relates to activist Subhash Agrawal who had sought to know, through multiple RTI applications, the details of vehicles purchased and sold by NGT, rules and procedures etc on sanctioning of leave, LTC etc of the Chairman and members besides statistics about RTI applications and first appeals. National Green Tribunal is the legal body for adjudication of environmental issues. Not getting response in time, Agrawal approached the Commission alleging Kumar caused him serious harassment by insisting on his presence to prove originality of his RTI application, to explain about his RTI applications and prove number of envelops, postal orders and their genuineness. Kumar also wanted him to file affidavit duly verified and attested by the competent authority mentioning all the facts. "The Commission finds that there is substance in the complaints made by the complainant. Some of the aspects of the interim orders of the FAA are funny and strange. They will definitely impose obstructions in the process of furnishing information according to the RTI Act. It will scare away the information seekers," Acharyulu said. He said Kumar has not "applied his mind" to the facts, law and the circumstances of the case and made the hearing of the first appeal a very elaborate and unnecessary exercise on trivial matters because of which furnishing of information was totally obstructed. "The Commission also observes that the FAA orders reflect lack of understanding of law in furnishing the information which is harmful to the public authority (NGT)," he said. The Central Public Information Officer of NGT, sub-ordinate of FAA, who was present during the hearing said he does not want to continue to handle RTI responses as he was over burdened with work as he is also Accounts Officer of the Tribunal looking after Accounts Division. He said he has to personally go to another section to use the computer for typing the RTI responses. Acharyulu said, "Having heard the submissions, the Commission comes to conclusion that it is not proper to burden an Accounts Officer with RTI related work. "The Commission recommends the Public Authority to replace the CPIO with another officer by providing necessary infrastructure including the computer operator, so that he could attend the RTI matters in a careful manner, which is desirable for an esteemed organisation like the NGT which is dealing with important matters like environment/pollution."
