Mrsuresh Nambiar vs Ministry Of Petroleum & Natural ... on 9 February, 2015 Central Information Commission, New Delhi File No. CIC/SH/C/2014/000131 Right to Information Act*2005*Under Section (18) Date of hearing : 9th February 2015 Date of decision : 9th February 2015 Name of the Complainant : Shri Suresh Nambiar, 101 Manish Apartment, MHATRE Residency, Near Siddhivinayak Temple, Dahisar (West), Mumbai 400068 Name of the Public Authority/ : Central Public Information Officer, Respondent Mahanagar Gas Limited, MGL House, Block No. G*33, Bandra Kurla Complex, Opp. ICICI Tower, Bandra (E), Mumbai 400 051 The Complainant was present at the NIC Studio, Bandra. On behalf of the Respondents, Shri Raja Dutta, DGM (Law) was present at the NIC Studio, Bandra. Information Commissioner : Shri Sharat Sabharwal This matter pertains to an RTI application dated 4.2.2014 filed by the Complainant, seeking information on six points regarding a new PNG connection. He filed a complaint CIC/SH/C/2014/000131 dated 27.2.2014 to the CIC, stating that his application was returned by the Respondents on the ground that they are not a public authority. The Complainant stated that the Respondents did not provide him any court judgment stating that they are not a public authority. 2. The matter came up before us today. The Complainant submitted that he made a request for a new gas connection in 2012, which has not been provided to him till date. The Respondents have also refused to provide any information concerning his application in spite of the fact that vide the Commission's decision No. 2966/IC(A)/2008 dated 1.8.2008, the Respondents were declared as a public authority within the meaning of Section 2 (h) of the RTI Act. The Complainant further submitted that instead of speaking of any court order staying the above decision of the Commission, the Respondents returned his RTI application. 3. The Registry has brought to our notice an order dated 23.3.2010 of the High Court of Delhi in W.P. © 6687/2008, in which the Court noted that the Respondent No. 2 in the above case was an NGO, the co*coordinator of which had reportedly expired and no one was found on their premises. In view of the above, the High Court further noted that the CIC/SH/C/2014/000131 impugned order of the CIC (order dated 1.8.2008 mentioned above), which had been stayed by it, could not be implemented as there was no one to whom information could be given. In the light of the foregoing, the Court further observed:* "In the peculiar circumstances of the case, this Court directs that the impugned order of the CIC will not constitute as a precedent on the question whether the Mahanagar Gas Limited is a public authority within the meaning of Right to Information Act 2005. That question is left open to be decided in a appropriate case." 4. The Respondents drew our attention to their written submissions dated 6.2.2015, with which they have enclosed the order dated 10.7.2014 of the High Court of Judicature at Mumbai in Mahanagar Gas Limited & Anr. Vs. State of Maharashtra & Ors. [W.P. No 134 of 2014]. The Respondents stated that vide the above order, the High Court of Mumbai has stayed an order of the State Information Commission, declaring Mahanagar Gas Limited as a public authority. CIC/SH/C/2014/000131 5. In the light of the foregoing, we would refrain from considering this complaint further until disposal of the above matter by the High Court of Mumbai. Parties are free to approach the Commission after the disposal of the case by the High Court of Mumbai. 6. Copies of this order be given free of cost to the parties.   4. Over Rs 2 lakh spent for cleaning purpose of the skywalks in Bandra, Santacruz and Vile Parle over a period of one month and yet they never look clean. The cleaning and sweeping of these skywalks is looked after by the Mumbai Metropolitan Region Development Authority (MMRDA). Iamin had filed an RTI regarding the amount of money spent on the maintenance of five skywalks, including one in Vile Parle, two in Santacruz and two in Bandra, between January 2013 and December 2014. In response to the RTI, MMRDA officials stated that in the first four months of 2013, Rs 7.50 lakhs was spent on getting the skywalks cleaned. However, from May onwards the maintenance rights were handed over to a private advertising agency. The Delhi High Court has sought to know from the central and city government why it cannot provide publications on homoeopathy free of cost in jail to a prime accused in 2006 Mumbai serial train blasts. Justice Rajeev Shakdher asked both governments to inform about the problem in providing the free publications to the accused for study. Siddiqui had sought copies of books published by the Central Council for Research in Homeopathy (CCRH), Delhi under the RTI act to study but the council refused on the ground that these were "priced publications" and hence could not be given free.   7. MUMBAI: The University of Mumbai turned poorer by Rs 12.11 lakh to defend its vice-chancellor Rajan Welukar's appointment in court. In response to an RTI query filed by activist Anil Galgali, the MU said it had utilized the services of lawyers who were not empanelled by the varsity. and paid them Rs 12.11 lakh as fees. What is blatant, said Galgali, is that the amount spent from the university's coffers did not have sanction either from the state government or the governor, who is the chancellor.     RC Book Status - Mumbai Kalyan RTO

    Team, I have registered my Car with Kalyan RTO on Nov14, 2014 and even after 80 days the RC book is not received. I have visited the RTO office and received NO satisfying answer, moreover I was told the Deputy. RTO is on leave and I cannot meet him too. Please advice how can I check my RC book status.   13. NAVI MUMBAI: An RTI query by a 37-year-old man, Pinto Patil, reportedly uncovered that his uncle had illegally transferred a plot in Turbhe by forging lease documents.   14. Hello, I would like to change my residential address in ration card. I have shifted to new society and it is located next to my existing society and hence residence area will remain same; except society and flat number. I would like to know what is the procedure to change the address in existing ration card. Which form(s) needs to be filled up (whether in english or marathi) and where to submit these documents?   16. Hi All, I have a query and would require your guidance for the same. Is RTI Act applicable on all the states and Goverment offices in the same manner. Ex:- I have asked certain information from Mumbai Municipal corporation , kolkata municipal corporation and Delhi municipal corporation. Mumbai municipal corporation provided me the desired information after paying the fees asked by them however the same information was denied by the other two. Now first query is that are they allowed to deny me information when one municipal corporation has already furnished the desired information. Secondly does it make my case stronger during first appeal as I have recieved information from one municipal corporation but denied by other two.
  17. Mumbai : In a landmark order, the Central Information Commission has ruled that CCTV footage of a public place is in the public domain and cannot be denied to a citizen. The case pertains to Mumbai-based RTI activist Chetan Kothari, who wanted the CCTV footage of the incident when a UCO bank cashier at Bhulabhai Desai Road misbehaved him. “The man ahead of me in the queue got Rs 1,000 in the denomination of Rs ten but when I asked for it, the cashier, Ganpat Dongera, was rude to me,’’ said Kothari. The incident happened on November 3, 2012. Unsatisfied with the action taken by the bank — merely instructing the employee concerned to be polite — Kothari asked for the service record of Dongera as well as the CCTV record of the incident. During January to March 2014, MMRDA paid Rs39.58 lakh to a private PR agency for its image building, reveals an RTI application The Mumbai Metropolitan Region Development Authority (MMRDA) had paid Rs15.82 lakh per month to a public relations (PR) agency as part of its image building before the Lok Sabha election. This was revealed in a reply received by activist Anil Galgali under the Right to Information (RTI) Act. In the reply, Dilip Kavatkar, joint project director of the Authority, said, "MMRDA appointed a PR Agency namely Ad Factors Pvt Ltd for a period of six months and paid them Rs39.58 lakh for a period from January 2014 to March 2014 and Rs7.86 lakh are in balance with MMRDA." Mumbai University to start certificate course on RTI Perhaps a first in India, the department of civics and politics at Mumbai University is set to start a six month certificate course on RTI Act, to empower those struggling to learn its use. The course, likely to start from January 2015, aims at targeting social activists, journalists, bureaucrats and members of civil society, to ensure more effective use of the tool. "The idea has been conceived recently and we are still working on its extensive details. An expert committee will soon be formed to workout the syllabus and other details of the course," said Dr Surrendra Jondhale, HoD of civics and politics, Mumbai University. The department in collaboration with NGOs like Mahiti Adhikar Manch is organising a convention, "Western India Convention on Right to Information" on June 7 and 8. The convention aims at discussing every aspect related to the Act. "In the past eight years ever since the inception of the RTI Act, 40 RTI activists have been killed and 150 injured. We have been demanding a need for a special fast-track court for all such individuals, who were attacked or killed for raising their voice. At the end of this convention, we want to finalise a list of resolutions and demands that will strengthen the use of this Act," said Bhaskar Prabhu, convener of Mahiti Adhikar Manch. The convention aims at discussing every aspect related to the Act. "In the past eight years ever since the inception of the RTI Act, 40 RTI activists have been killed and 150 injured. We have been demanding a need for a special fast-track court for all such individuals, who were attacked or killed for raising their voice.   21. Hello, I wanted to enquire about the plans, projects and expenditure incurred on the cleaning of Powai Lake. I am not too sure which department of BMC the RTI is to be addressed to. I think it is to be addressed to Storm Water Drains Department, but I am not too sure if they would reply with the expenditure incurred on the cleaning projects. Also, is the court-stamp only way to pay for the RTI? Cash enclosed in the postal letter or some other thing?
  22. i Had applied for my PassPort in August 2012, all the formalities police Verification, Document Verification was Completed. But still havent received my PassPort till date. So i filled an RTI Request OnLine rtionline.gov.in The Request was Filed on 19 July, 2013. Now the status shows Transfer to RPO{Regional PassPort Office} Mumbai on 22/7/13. i Dont know what does that mean & when will i get proper reply Can anyone Please help me ?

Loosely translated from Loksatta, a Marathi newspaper The Bombay Electric Supply and Transport (BEST) had issued a circular in 2008, ordering all its divisions to destroy all old record to avoid 'people making RTI applications for old records and resultant problems'. This was revealed in after the Anti corruption bureau sited this circular as reason for closing file about a compliant made to it. the details of the case are given as- One Mr. Jitendra Ghatge found out in 2007 that BEST has issued an electric connection and meter in the name of one Suresh Ojha, at an address belonging to Mr. Ghatge. He made an RTI application, asking for copies of documents based on which the connection was given. The BEST replied that the documents were 'not tracable'. Thereafter, Mr. Ghatge made a complaint to Anti Corruption Bureau in 2009. After a lot of follow-up, the ACB communicated that the enquiry about his complaint has been stopped in 2012 itself. The reason sited was this circular, advising all divisions to destroy all records more than 5 year old. The ACB has also provided a copy of the circular under the RTI Act.

Of the 20 openings, ten were reserved for women, however not a single woman was appointed despite 68 women applying, and male candidates were appointed to the ten posts, petitioner Sunil Kate alleges. Also, a person not having any sports credentials was appointed in the sports category, the PIL says. The division bench headed by Justice AM Khanvilkar on Wednesday asked Kate to add the candidates who were allegedly recruited wrongly as respondents, and posted the matter for hearing after two weeks, said Kate's lawyer Machhindra Patil. MPSC had issued the advertisement for these 20 posts on August 11, 2008. He moved RTI appellate authority which turned down the appeal. His appeal before the information commissioner is pending. Another objection raised by the PIL is that MPSC filled up the posts through interviews, when the advertisement had stated there would be a written test. The petition also states that Kate had approached Secretary, Urban Land Development Department, on the issue, as also the Chief Minister of Maharashtra and Director General of Police, but there was no response.
  25. Hello, We have applied for a new ration card on 28th April 2010 at Kandivali (W), Mumbai. Even after several visit to office and reminder to inspector, our application is not moving anywhere. I have registered a complaint on RTI - CIC online portal on 10 Jan 2011. The status of this complaint states "Signed Copy Awaited". Wanted to know if I have to submit any physical form or online application is enough. If I have to submit a form in hard copy, may I ask for the informaation regarding concerned officer and office address please? Thanks for all your help.
