Namaskaram. Can i use RTI to redress the following situation? It is pertaining to Illegal Recovery of Pension- by a very well known PSB (Public sector Bank). This is a highly escalated case and sub-judice case; Bank is recovering the Pension without a order of recovery from any competent authority. After exhausting all redressal mechanisms, a letter was written to the Chariman of the PSB- with verifiable facts - and copied to the CVO - chief vigilance officer of the bank to initiate the investigation. The bank is protecting its own staffers who are responsible for the mess and it is stonewalling all such requests for investigation. The said letter was written in January 2017- for which no response was received either from the Chariman's office or the CVO. On following up on phone with the Chariman's office and CVO's office- they did not have any record of the letter written to them. Another complaint was written to the CVO of the bank a month back- again on following up with the officer designate, they were non-committal of the response. The complaint is not even acknowledged, no reference number is generated, no guidelines exist about the duration under which the investigation would be completed.....in fact the whole process of addressing the issues to CVO is a hogwash (perceptibly, in my experience) as nothing comes out of the process. On the contrary - letters written to the CVC are acknowledged with complaint numbers/ reference numbers and there is a guideline for finishing the investigation in a fixed time period. My Question is: Can I use RTI in the above case & how? What should be the questions that I should frame? If you need any further inputs, please let me know. thank you everyone. Regards, Andy

Cuttack, June 24: A public interest litigation filed in Orissa High Court has sought intervention for recovery of water tax worth Rs 6,000 crore that is yet to be realised from major industries and public sector undertakings. Bhubaneswar-based RTI activist Pradip Pradhan, 44, has alleged in his PIL that the huge amount of money was "outstanding against 59 companies and industries towards water tax." On the basis of information assessed through RTI, the petitioner alleged that more than a 100 companies, PSUs and mining operators had not paid water tax for 15 years. This was revealed at an RTI query exercised by The Asian Age. What’s worrying is that the city police’s recovery rate in burglaries remains the same, a dismal 15 per cent for 2013 and 2014. Also, burglary cases have marginally shot up from 2,925 cases in 2013 to 3,055 cases in 2014. The detection rate has marginally increased from 37.50 per cent in 2013 to 38.13 per cent in 2014. One of my relatives retired from Maharashtra Zilla Parishad Services. Her pension has been sanctioned after 8 months. They have initiated a recovery of over 3 Lakh rupees. But they have only given the order,the Gratuity amount & the recovery amount. We want the details of the Recovery Process, all the documents related to the Pension proposal & calculation sheets. We also want the copies of Service Book. So how should the application be filed? Can we demand Certified or True Copies of all the Documents? or only Photocopies are allowed under RTI?
One of my friends has been informed by Nodal CPIO of Central Information Commission vide his letter No. CIC/CPIO/2012/1128 dated 04-10-2012 as under: “The total amount of penalty imposed since 2007-2008 onwards is Rs.15804275/- out of this Rs.9216264/- has been recovered so far. The Commission does not maintain year-wise data in this regards. In certain cases, the PIOs have preferred writ for waiver and stay of penalty amount. Although in some cases, the Commission has been made a party but there are many instances where the Commission is not made a party. The figures regarding recovery of penalty is based on inputs received from the PIOs and Pay & Accounts Office.”
