  1. How to file RTI regarding subsidised food in Research organisations? Research institutions contains Scientists and Staff who have very good central govt salaries. Why should they be given subsidy in food in canteen. I want to file RTI regarding this. Please guide. The following questions prepared by me. Please Provide following information under RTI Act relating to food expenses in institutions under DST and also in DST head office. 1. Whether there is provision of subsidised food in DST and in the institutes under its control. If Yes, please provide related guidelines and rules. 2. The reasons for provision of subsidised food in these institutions. 3. Please provide the annual expenses for food and related matters for the past five years. Along with total no.of employees and employees below poverty line. Or whose salary below 20,000. S.No. Ann 4. Will this subsidy applicable to all employees? If yes, please provide the reasons for not curtailing the subsidies for these employees? 5. Whether there is canteen facility in each institution , whether it is subsidised. If yes, please provide the annual budget provided by the institution for maintaining this facility. 6. If the query related to some other public authority please transfer this RTI application under section 6(3)?

[h=1]Research paper is not personal information: CIC[/h] New Delhi: The thesis submitted by a research student is not a personal or third party information and cannot be withheld by an Institution under the Right to Information Act, the Central Information Commission has said. Information Commissioner Sridhar Acharyulu said,"It is not third party information. Moreover, there is a public interest in knowing the originality of the thesis, especially when a serious allegation of appropriating the research work is made by the co-researcher, it is the duty of the academic institution to clear the allegation after due verification." The matter related to an RTI applicant who had demanded from Rajasthan-based Arid Forest Research Institute the copy of pre-thesis submission seminar details of a researcher, copy of her thesis, all correspondence related to research work, rules and regulation of research work and related records. The applicant alleged that the researcher had stolen theme of her research paper, hence she requires all these details to establish her claims. Acharyulu said the thesis submitted to a University is not private or personal information of the candidate who submitted it, but the property of the University, which has to discuss and decide whether it deserves the award of Ph.D or not. Taking exception to the chemical tests being carried out on the animals at Byculla Zoo and the Sanjay Gandhi National Park (SGNP), members of Plants and Animal Welfare Society (PAWS) met chief minister Devendra Fadnavis at Vidhan Bhavan requesting him to conduct an investigation into the same. Eight months ago the organisation had filed an RTI query demanding the details of the chemical tests being carried out on the zoo and SGNP park animals and their reactions on them.     Doctoral Student!

    I am doctoral student in the University of Delaware, United States and my dissertation examines the process, in a comparative context, through which RTI was adopted in India, the UK and South Africa. I bracket this work within the context of the Commonwealth countries, while also placing it in a global context and examining whether there is an emerging norm to adopt RTI legislations in countries that seek to promote democracy and good governance.     Research needed on RTI usage

    Article by N.Bhaskara Rao A quick look at the implementation of the Right to Information Act (RTI) so far conveys mixed messages. The disappointment has been particularly on three fronts. Firstly, the political leadership and the political parties by and large have done nothing so far to give a push to the Act, as if doing so would adversely affect them. Both at the Centre and in most States, governments have done little to create much needed awareness among large sections of the people and to help open an important window of the Act – suo motu obligations, maintenance of records, and management. Thirdly, the Information Commission in the States have yet to demonstrate proactive initiatives. The RTI Act is a means, not an end, for change, equity, activism, citizen participation and good governance. The better RTI is implemented, the better it is for everyone, including for those in the system – contrary to what they think. Their credibility and respect in the society will go up. This is even more so for the news media as an institution and for the journalists individually. They can play a more proactive and positive role – irrespective of seniority in the profession – and increase their viewership or circulation. A comprehensive review of the performance is unfortunately not possible since hardly a couple of States have come up so far with their annual reports, which they are obligated to submit to their respective State Assemblies. Nevertheless, a quick analysis of applications filed under the RTI Act indicates that applications (over 75 percent) mostly have been (1) by men (Most Commissions have no women Commissioners), (2) by those in power or within the system, (3) by those in the metros (4) over 60 per cent are for personal or individual reasons or advantage, (5) pertain to service matters, and (6) most of the applications are by the same people (who have filed more than one application). Equally disappointing is the lack of efforts by the Commissions to reach out. For example, in the case of one important State having multiple Information Commissioners and having a relatively better budget, about 40 per cent of the departments having PIOs have not received any application in the year. In the case of another with 50 percent of the departments under the RTI Act, the number of applications received during the year for the entire State was hardly 10 per cent. And the concentration was on just a couple of departments. This is despite claims that PIOs of all these departments were trained. All this brings out the urgency to take stock of the “who, what, where, when and how” aspects of usage of the RTI Act in different States. Only then would we be able to take quick corrective actions or interventions – by the Government, by the Commissions themselves and by civil society groups.   9. This is strange. As a layman none of the research topics look like affecting "natiuonal security" ! NEW DELHI, APRIL 8 : The Government doesn’t want to explain why and how it decides to reject a research proposal by a foreign scholar. Responding to an application filed under the Right to Information Act by The Indian Express — which first exposed how the Government is not only delaying clearances to US research scholars but also forcing some of them to change their subjects — the Human Resource Development (HRD) Ministry refused to part with any information. Its response, signed by director Anupama Bhatnagar, cited the following as reasons: that this correspondent is “not an affected person” and that giving this information “would affect national security.” “...Due to its sensitive nature,” she replied, “disclosure of the information sought by you would prejudicially affect the security of India and its strategic/economic interests and might have adverse implications on our relations with foreign states.” The Home Ministry was a little more open. It did list the nine research proposals of US Fulbright scholars that the Government rejected “after due consideration of the sensitivity of the research proposals.” On the subject of why and how, the Home Ministry, too, declined to give any information other than saying: “(They were declined) after due consideration of the sensitivity of the research proposals.” These are the “sensitive” proposals: • Prospects and problems of outsourcing for India’s economic growth • Is tourism a win-win for local livelihoods and forest eco-systems in the Central highlands of India • The Imaginary Princess: A Muslim girl’s story • Language ideologies in Mumbai schools • India’s energy security • Women’s struggle for empowerment • Democratization in Kerala • Political Empowerment and Biodiversity in Kerala • Politics of land privatisation and access in Delhi. The Indian Express had highlighted the problem of granting visas to the Fulbright scholars in February this year, where delays ranged between 5 to 21 months. In some cases, the research proposals were rejected and a fresh topic was granted approval. The Government then decided to put a “red channel” and “green channel” in place but no decision has been taken yet.

AHMEDABAD: Remember that Jaspal Bhatti comedy show, where a PhD student spent more than half of his research time buying groceries, booking rail tickets and mopping floors for his guide in order to get his thesis done on time? Well, that may have been reel life. But in real life too, Jigar Patel, a research scholar at Gujarat University's chemistry department, went through all of this. And his guide VK Jain insisted that Patel maintain a daily activity log sheet mentioning this non-academic work and even signed it. A year into his research, a frustrated Patel has filed an application under the Right to Information Act, seeking answers from the university on whether mopping lab floors, repairing electrical equipment, booking tickets for his guide formed part of his research topic — 'Calix Pyroles and Its Applications'. Patel claims in his application that he was asked by Jain to do odd jobs like repairing his scooter’s flat tyre and depositing cheques. Patel has submitted a copy of the log book. An entry in Patel's log sheet on October 16, 2005, which carries Jain's signature, states, "Went to BSNL office, creation for printer work, post-office, watch shop for repairing, complex preparation of dyes and computer work." Another entry dated September 19, 2005 reads, "Printer repair, mouse change and searched for 'Jhaadu' (broom)." Similar entries appear practically every day till September this year on Patel's log sheet. "After going through my daily log sheet, no one would believe that I did complex research. I filed the RTI application to bring to the university’s notice the harassment we face from some guides. It is time students came out in the open," said Patel. Want a PhD?   11. There are several projects prepared by research institute and several research results recorded in such institutes which are normally supplied with a price. Can I apply for that information under RTI?

Pradipta Dutta, B-141 Chittaranjan Park, New Delhi – 110 019 Name of the Public Authority: Directorate of Income Tax (Legal & Research) (DIT), 3rd floor, Drumshaped Building, I.P.Estate, New Delhi- 110 002. DECISION Facts of the Case: The appellant had sought certain information in the form of queries, whichhave been duly responded by the CPIO and the appellate authority as well. Hehas however filed an appeal before the Commission against the reply of theappellate authority and prayed that the CPIO of DIT (L&R) be directed to furnishinformation with respect to his following queries: “Kindly inform why ITOs have been posted at DIT (L&R) even though there is no corresponding post in the same pay-scale at ITJSection, CBDT. What functions are the ITOs expected to discharge at DIT (L&R)? Kindly inform why ITOs at DIT (L&R) are being forced, under threat of disciplinary action, to perform the functions of an Asstt.Commissioner without being paid officiating pay.” Commission’s Decision: In its oft-repeated decisions, the Commission has advised the informationseekers that they ought not seek the views and comments of the CPIO on the questions asked by them. Yet, in the garb of seeking information mainly for redressal of their grievances, applications from requesters are filed. The CPIO’s in turn, have also ventured to answer them. Thus, the information seekers as providers have erred in interpreting the definition of information. A CPIO of any public authority is not expected to create and generate a fresh, an information because it has been sought by an appellant. The appellant is, therefore, advised to specify the required information, which may be provided, if it exists, in the form in which it is sought by him. The information sought relate to duties and responsibilities of ITOs deployed at different locations and the salary or compensation paid to them.Under Section 4(1) of the Act, all the public authorities are required to disclose such information as above. Had it been done by the respondent, the CPIO could have informed the applicant about the source where from he could have obtained the information. The need for filing application for information and this appeal could have thus been avoided. In pursuance of the principle of maximum disclosure, as u/s 4(1) of the Act, the CPIO is directed to disseminate the information so that in future, such applications are minimized.
