NUJS Kolkata students have filed Right to Information (RTI) requests for the report of the law school's 16-years-overdue review, as the administration has not made the report public even two months after it was submitted to the Chief Justice of India (CJI). The RTI asks for a copy of the report, the date on which the review commission had submitted it to the CJI and a copy of all the communication the commission has made regarding the report to any public office since after the report was submitted to the CJI. Application for Empanelment is pending with Oriental Insurance (GIPSA) since last yrs but still we are visiting again again to get status where all efforts are in vain. The Act specifies that citizens have a right to request any information (as defined), to take copies of documents and to obtain information in form of printouts, diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts. The Act gives the right to access to information held by “public authorities” which includes authorities, bodies, institution of self government which are established or constituted by the Constitution, by a law of Parliament or a State Legislature, by notification or an order of the State or Central Governments, bodies owned, controlled or substantially financed by the State or Central Governments, including non-government organisations which receive substantial government funds directly or indirectly. Thus the Act applies to the executives of the Union, the States and the Union Territories, Parliament, State Legislatures, Legislatures for Union Territories, Panchayats and Municipalities; the Supreme Court, High Courts in the States, Subordinate Courts and Tribunals. Ajay Jangid, RTI activist from the city had dug up data and examined each transaction for over a period of six months that helped him expose theft of biometric data by unscrupulous people for pilfering subsidized food grains distributed under National Food Security Act (NFSA) to the needy. Police investigations have so far revealed that the data of all biometric ration cards in the districts of south Gujarat were stolen and sold to racketeers by them. Srikrishna Committee Discloses Minutes Of Meetings; Reveals Circulation Of Draft Data Protection Bill By MeiTY After initially refusing to disclose the minutes and agenda papers of meetings of Justice B.N. Srikrishna Committee for a data protection framework for India, Ministry of Electronics & Information Technology (MeitY) has now disclosed under the RTI Act, 2005 the minutes and agenda papers of two of its meetings dated 8 September, 2017 and 3 October, 2017. The minutes were revealed on an RTI application filed by Mr. Paras Nath Singh. The disclosure comes as a welcome change after a group of 24 legal academicians and advocates had recently written to the Committee, demanding inter alia release of information on its proceedings, meeting notes and draft bill, as well as the comments received by it. The Law Commission is ready with a set of recommendations to make BCCI a 'public body' or, in the alternative, a private body amenable to queries from the public under the Right to Information Act. Sources told TOI the law panel unanimously concluded that given BCCI's monopoly over the most popular and cash-rich game in India and its public nature of work, coupled with substantial financing from governments over the years in the form of tax exemptions and allotment of land, it must be classified as a 'public body' and brought under the RTI Act. A series of appeals filed under the Right to Information Act (RTI) by whistleblower Indian Forest Service (IFS) officer Sanjiv Chaturvedi when he was posted in Haryana had unearthed the scam involving senior Haryana politicians and bureaucrats have revealed how instead of going after corruption committed under the Congress rule, the Modi government has decided to stall the investigations and in doing so has sought to defend the DoPT order which has since been cited by the Haryana government to repeatedly stall a probe by the Central Bureau of Investigation into allegations of corruption involving top political leadership and bureaucracy in Haryana. Preliminary probe had indicted CM, minister, bureaucrats The case goes back to 2010 when on the basis of comprehensive representation of Chaturvedi to the then Cabinet Secretariat, the Ministry of Environment and Forest had constituted a two-member enquiry committee to look into corruption related to illegal mining, illicit filling, fake plantations, etc that had been unearthed by the officer. Finding prima facie substance in the case, the enquiry committee had severely indicted the office of then Haryana chief minister Hooda, then forest minister Kiran Chaudhary, then chief parliamentary secretary Prehlad Singh Hilakhera and senior officers of state government, for their alleged role in these cases of corruption and recommended a CBI probe. Subsequently, both CBI and Central Vigilance Commission (CVC) had given their concurrence for the investigation in November-December 2011 and the issue was under active consideration of MoEF. Less than 30 per cent of the much-hyped Nirbhaya Fund, that now has run up to Rs3,100 crore, has been utilised so far in the last five years despite tall claims by the government on women’s safety and welfare in the country, an RTI reply has revealed. The government, in the Union Budget that Finance Minister Arun Jaitley presented February 1, proposed to pump in another Rs500 crore into the non-lapsable corpus fund that was launched in the aftermath of nationwide outrage over the brutal rape and murder of a 23-year-old woman — given the moniker Nirbhaya, or fearless, by the media — in the capital December 16, 2012. In response to an RTI query, the Ministry of Women and Child Development (WCD) said till date only Rs825 crore has been utilised from the Nirbhaya Fund out of the Rs2,711 crore that accumulated in 2017-18. Till January 2018, 21 proposals have been appraised by the WCD Ministry, of which 17 have been implemented. The RTI query revealed that only Rs50 crore has been utilised by the Railway Ministry, which was given Rs500 crore from the fund for its proposal — Integrated Emergency Response Management System (IERMS).   11. More than a year later, the full effect of the November 2016 note ban imposed by the Narendra Modi government remains a mystery. For the Reserve Bank of India (RBI) still hasn’t finished counting the returned currency notes. “Specific bank notes are being processed for their arithmetical accuracy and genuineness and the reconciliation for the same is ongoing.   14. BJP Kerala State President Kummanam Rajashekaran has been slapped with a fine of Rs 1.5 lakh as two vehicles registered under his name were booked for over speeding. The two cars together have exceeded the speed limit a staggering 97 times, said to be among the highest such violations in the state. According to SouthLive, the information was revealed by RTI officer Archana Sadashivan of Transport Commissionerate in response to a Right to Information application filed by activist CS Shanavaz. As per the norms of the Motor Vehicles Department (MVD), the driver of the vehicle and the owner are fined Rs 400 and Rs 300 respectively for the first violation. The amount increases, with the repetition of the offence, to Rs 1,000 for the driver and Rs 500 for the owner. The BJP leader will now have shell out Rs 1.5 lakh as fine to the MVD for repeated incidents of over speeding by the two cars, report various sources. In what could be termed a setback to the state government, the Union Ministry of Home Affairs (MHA) has revealed that the state government appointed DGP Loknath Behera as Vigilance Director without seeking permission from the ministry. It has further come out that an officer continuing to hold two cadre posts - state police chief and Vigilance Director - is in violation of norms. Meanwhile, the Chief Minister's Office has maintained that it's the prerogative of the state government to appoint an officer to a post. In reply to a Right to Information query from activist D B Binu, the MHA revealed the state appointed Behera as Vigilance Director without seeking permission. "As per Rule 11 of All India Service Rules, the post should not fall vacant because an officer goes on leave and the additional charge should not go beyond six months," Binu said.   16. The Assam Home department on Friday issued a notification saying N. Rajamarthandan an IPS officer has been reinstated and restored as commandant of the 21st Assam Police Battalion at Katlicherra in Hailakandi district, some 330 km south of Guwahati. The IPS officer of the Assam-Meghalaya cadre, who was suspended last year for allegedly revealing crucial information on an investigation in a reply to an RTI query is now back to power. Rights organisations in the Northeast have hailed the IPS officer’s reinstatement. “His crime was that he gave information under RTI Act as public information officer in the Assam Police. We salute this officer and hope and pray there are more like him,” social activist Agnes Kharshiing told The Hindu from Meghalaya capital Shillong.   17. Activists have alleged that metro work is going on in full swing at the Aarey Milk Colony in the absence of the requisite permissions for extracting and using groundwater. According to Vanashakti, an NGO working on environmental issues that sought information from the Mumbai Metro Rail Corporation (MMRC) regarding the extraction of groundwater under the Right to Information Act, the metro rail authority responded, saying that no such application was made. Moreover, a cement-mixing plant has also been established in the metro carshed area. The NGO has further alleged that, based on satellite images, it has been revealed that a massive amount of levelling work has been carried out at the cost of greenery at the Aarey Milk Colony without the requisite permissions. While rejecting the FAA CPIO didn't gave notices to 3rd party and without any reference to 3rd parties my appeal was rejected by FAA. I approached CIC and during hearing of second appeal, I told that financial assets are sold by the bank to the Assets Reconstruction companies and hence there is no contractual agreement exist with the borrower. Out of the total 8 cases, 3 cases were related to fradus and hence CBI complaints are filed. After hearing, CIC passed interim order and asked bank to intimate all borrowers involved and gave 2nd date of hearing. During 2nd hearing CPIO told that he could not contact all and he is not aware about how many borrowers have committed frauds. During hearing I told that CPIO came totally unprepared and if he wish he can download CBI FIRs from its website just now. Hearing this, CIC pass 2nd interim order and gave another hearing date and asked me to provide CBI complaints filed by the bank. I told it's ok Now questions for me are as under: 1 I want whatever is argued during two hearings should be percolated in written final order of CIC. 2. Can I file rejoinder to my Second written appeal and send to CIC. Else whatever orally argued critical points will be missed out from final order. 3. I want this to be incorporated in final order because if it goes against me (which is rare possibilities), I can move to High Court I am confident of favorable order as 3 borrower accounts are frauds. Sir /madam I asked an information regarding a registered document from sub registrars office ... information that had asked is 1) what are the supporting documents or papers regarding ownership of property that are kept as a proof for registration? I got a reply that "there are no supporting documents available for the registered document in our office." But when I took A certified copy from online I am getting those supporting documents. Please help me how to proceed[emoji120] In online I am getting them but they are not preserved in their office records....some one might have removed them or there seems to be some conspiracy .
