  12. Activists Empower Disabled Voters as reported in Indian Express | Sep 22, 2008 Mumbai, September 21 Despite existing laws on the right to accessible polling locations, people with disabilities are unable to exercise their franchise during elections. However, with the Lok Sabha elections round the corner, activists for disability rights from across the country — 40 non-governmental organisations along with 15 Human Rights Law Network (HRLN) lawyers —congregated in Mumbai for the launch of a nationwide campaign. A two-day seminar to provide information to people with disabilities about their voting rights as well as facilities that exist to enable them to vote with ease kick-started the campaign. Representatives from Kashmir, Kerala, Madhya Pradesh and many other states participated in the seminar, except the hilly regions where elections for the general public is itself an issue.” As per the conservative estimate, seven per cent of the Indian population is disabled which is a sizeable number. However, scant regard is given to them both by the political parties and the Government when it comes to implementing Supreme Court directives to enable them to vote. Elections have come and gone but each poll leaves a familiar aftertaste for the disabled - denial of their basic right to vote due to inadequate arrangements and facilities,” said Rajiv Ratouri, National Director, HRLN. Disability right groups have laid down various strategies for the campaigns in their states. “In the year 2007, in his letter to the Supreme Court, the Election Commissioner had given an assurance that all the necessary arrangements will be made. He had also issued notices to all the state election commissions to implement the law. We have filed right to information application to monitor the work in progress. At the national level we have urged individual state NGOs and human rights activists to file RTIs and Public Interest Litigations,” said Ratouri. According to the Bombay High Court orders and other high courts, every polling booth should have ramps, Braille for visually impaired to cast their votes. Persons with disabilities will not be required to stand in queues, disabled voters will be allowed facility of a companion of their choice to assist them in entering the booth and in casting their vote and assistance should be provided by the staff on duty to escort the voter on a wheel chair inside the booth. Casting one’s vote takes very little time but this act has great ramifications on the disabled - it is all about being visible and being... Activists empower disabled voters

    Sex appeal

As reported by Kranti Vibhute at www.mid-day.com on 11 May 2005 Why don't most eunuchs have ration cards or voting rights? Four city law students want answers to some simple questions Nirav Marjadi (19), Kushal Mehta (19), Dharampal Dave (18) and Jay Vakil (19) are law students who take the law very seriously. Instead of giving lip service to laws about equality, the four second-year students of SVKM Law College have decided to fight for the basic rights of eunuchs in India. Inspired by Tamil Nadu's decision to give ration cards to eunuchs with a third sex option, Marjadi filed a Right to Information (RTI) application before the Public Information Officer and ministry of social justice and empowerment, Maharashtra, on May 6 to know the laws, education schemes, employment schemes and the rules for provision of ration cards for eunuchs in this state. "When Tamil Nadu can give ration card to eunuchs, then why is our state lagging behind in helping them," questioned Marjadi. Next step As their second step, Dave will file an RTI application before the election commission today to know about the voting rights for eunuchs. "Justice must be seen to be done. Why should eunuchs be reduced to begging and prostitution just because the government is not providing them with basic amenities like a ration card?" Based on the answers, the group will file a petition in the Maharashtra State Human Rights Commission to ensure that eunuchs get their rights. The students have taken up this endeavour under the guidance of their professors and retired high court judges. Their move has been welcomed not only by eunuchs, but also the other marginalised communities. Eunuch Laxmi Narayan Tripathi, the founder of the NGO Astitva, said, "My support is with these students. Everyone wants his or her own identity." Tripathi holds the credit of being the only eunuch in the UN's Civil Society Task Force on HIV/AIDS. Ashok Row Kavi, gay rights activist and chairperson of the Humsafar Trust, said, "We, at Humsafar, strongly feel there should be a welfare body that can keep their data. They also need to be provided with ration cards, special wards in hospitals, etc." Transsexual actor Bobby Darling too welcomed the move, saying, "Eunuchs need to get their basic amenities. Hats off to these students who are fighting for their rights." 1.2 million The estimated number of eunuchs in India 90% The estimated percentage of eunuchs who live in poverty Source: Sex appeal

    Hello From an angered voter

Hello all, I am Sanjaya Mariwala, live in Mumbai and at the moment very angry as I was not allowed to vote in the current election. One of my first projects is going to be to get to the bottom of the reason for many like me not being allowed to vote, as their names did not feature on the electoral rolls. I am happy to collaborate and get support from those willing to help me and guide me in the process. Thanks,
  25. As reported at timesofindia.indiatimes.com on 29 April 2009 RAJKOT: In a glaring blooper by local administration, seven Pakistani nationals have been listed in Rajkot Lok Sabha constituency voters' list. The administration is working overtime to ensure that they don't vote. On Wednesday, district collector and chief election officer, HS Patel banned all the seven persons living in the country on a long term visa (LTV) from casting their vote on April 30. Names of Kusum Nuruddin, Rashidabanu Kadri, Devanand Velji, Meghna Devanad, Geeta Narayan, Hansa Rajesh and Amarshi Hingla all Pakistani citizens have appeared in the list of Assembly segment of seat no 69. "The fact came to light after a citizen applied for the details of these persons under the RTI Act on March 24. An inquiry came to the collector's office and after a 15-day query, the facts of the individuals were established," a source in the collectorate said. "In an intimation, they have been told they cannot take part in the democratic process of the country as they live here on an LTV," the official added. "We have also informed the returning officer and zonal and presiding officer and asked them not to let these seven persons vote," Patel said. "They might have got their names entered in the list by showing themselves as owners of property here," Patel explained, adding that further inquiries as to how their names got featured will be done after the elections are over. "If found guilty they could be booked under the IPC sections of Representation of Peoples' Act," Patel added. Through the same inquiry, it was also known that at present 336 Pakistani nationals live in the city on LTV.
