New Delhi: The Supreme Court on Tuesday took exception to the fact that despite its ruling that governments should not insist on the possession of Aadhaar card for the disbursal of benefits under the social welfare schemes, there were states that were flouting its order. A bench of Justice J Chelameswar, Justice SA Bobde and Justice C Nagappan expressed its concern over states acting in breach of its interim order passed in September 2013 and reiterated in March this year in this regard. New Delhi: The Unique Identification, or Aadhaar project, was started to solve the problem of not having a common identification system through which a person could prove his identity with certainty. The Strategy Overview of the UIDproject, published in 2010, clearly states the objective of the project. “In India, an inability to prove identity is one of the biggest barriers preventing the poor from accessing benefits and subsidies. Public as well as private sector agencies across the country typically require proof of identity before providing individuals with services.” In a response to an RTI application by Ujjainee Sharma and Trishna Senapaty, the Unique Identification Authority of India has revealed that of the 83.5 crore Aadhaar numbers issued so far, a minuscule 2.19 lakh resident have been given numbers based on the introduction by the introducer system. That amounts to a mere 0.03 per cent of all Aadhaar numbers issued. The UIDAI however, did not have data for the overall number of people who had applied through the introducer system. How many people in India have no ID at all is hard to guess, say the RTI applicants in a press release, adding: “If the number is large, as it may well be, then Aadhaar is doing little to solve the problem.     I have enrolled on 10/04/2015 along with my wife, now aadhar number is generated for her but my status in portal is still under process.     हरियाणा में गायों को मिलेगा ‘आधार कार्ड’ मार्च 19, 2015 Leave a comment चैत्र कृष्णपक्ष चतुर्दशी, कलियुग वर्ष ५११६ चंडीगढ़ : हरियाणा में अब गायों को भी आधार कार्ड जैसी ही पुख्ता पहचान दी जाएगी। सरकार ने फैसला किया है कि यूआईडीएआई की तर्ज पर ही अब राज्यों में गायों को स्पेशल आइडेंटिफिकेशन टैग्स दिया जाएगा, जिसमें यूनिक आइडेंटिफिकेशन नंबर होगा। इस कार्ड के माध्यम से सरकार हरियाणा की गायों को हैल्थ स्कीम से जोड़ेगी। अंग्रेजी अखबार इंडियन एक्सप्रेस में प्रकाशित एक रिपोर्ट के मुताबिक, हर गाय को एक १२ अंकों का यूनिक आइडेंटिफिकेशन नंबर दिया जाएगा और उसके गले में एक टैग लगाया जाएगा। गाय के मालिक को एक बुकलेट भी दी जाएगी जिसमें वे गाय का हर दिन का डेटा भर सकें। हरियाणा के पशुधन विभाग के मुख्य सचिव महावीर सिंह का कहना है, ‘इस स्कीम का मकसद गायों की पहचान और सुरक्षा करना है। साथ ही उन्हें हैल्थ स्कीम की सुविधा देना है। गायों के दिए आइडेंटिफिकेशन टैग्स में उनका फटोग्राफ रेस, रंग, शारिरिक बनावट और उम्र आदि दर्ज किया जाएगा। यह कार्यक्रम नैशनल डेयरी प्रोग्राम के तहत चलाया जाएगा।’ यह स्कीम अगले महीने से प्रायोगिक तौर पर कुछ ब्लॉक में शुरू की जाएगी। पशुधन विभाग के एक अधिकारी का कहना है, ‘गाय के मालिक को एक फॉर्म में कुछ जानकारी भरकर देनी होंगी जिसे विभाग के डेटाबेस में फीड किया जाएगा। अगर किसी के पास दो गाय है तो दोनों गायों को अलग-अलग आईडी मिलेगी।’ स्त्रोत : नवभारत टाइम्स
  15. Last month, I had visited RTO ahmedabad and Vadodara office in Gujarat for change of address in RC book. The cleark accepted aadhar card for address proof but the RTO officer who is seating in office no 1, means the head of the office not accepted aadhar card for address proof. Than I attached copy of government bank passbook. Even though he resufused. I paid all required fees sr./Jr. clearks already scrutinised the copy and after that RTO head refused to accept the application. I asked agents outside the RTO office and they said on the basis of aadhar card ur address will be change but I have to pay agent for that five times more than RTO fee. In this case how can I know the fact that aadhar card is valid or not in RTO office?
  16. Can a IC ask the PA to explain as to why it is insisting on Aadhaar for issue of caste certificate ? In a surprising decision a IC in he CIC has asked the PA to explain, as to why it is insisting on a Aadhaar card for issue of caste certificates. Full decision is attached to this post. Does a IC have any powers to seek such explanations ? DECISION 3. Both the parties made their submissions. The appellant made an application forcaste certificate in 2012, when Adhar Card was not an essential requirement for this.There was huge delay in responding to his application. Meanwhile, as represented bythe APIO there is a major change in the requirement for caste certificate. Now theadhar card is made essential, without which the application is rejected by theComputer itself as the new software does not accept the applications without aadharcard number. It is a serious policy issue which is affecting the people and creatingthe difficulties in getting the caste certificate. Section 4 of RTI Act, says: Every public authority shall— © publish allrelevant facts while formulating important policies or announcing thedecisions which affect public, (d) provide reasons for its administrative orquasi*judicial decisions to affected persons. From the RTI application of the appellant, it reveals that the Department has notmade any public announcement as to the requirement of adhar card for issuing theCaste certificate which is a very serious policy decision affecting millions of people. Section 4(1)(d) of the RTI Act also madates the Public Authority to provide reasonsfor its administrative or judicial decisions, affecting the people. This is anadministrative decision of the public authority to impose Aadhar as a condition forsecuring the Caste Certificate. This was incorporated into the software and that isrejecting the applications for caste certificate mechanically finding no Aadhar cardresulting in denial of other benefits based on the caste certificate. Thus the PublicAuthority has violated these two provisions of RTI Act which should have beenvoluntarily disclosed by the Public authority without somebody asking for informationunder RTI. The RTI Act made it clear that what a public authority should disclose onits own is different from the informaiton that could be sought as a right by applicantsby paying fee. Non*disclosure of obligatory information under Section 4 compells thepeople to pay Rs 10 and seek information under 3 which is against the spirit of RTIAct. The Publi Authorityhas violated Section 4 and also Section 3 of the RTI Act bynot providing it at least, in response to the application. 4. The appellant has quoted an order of the Supreme Court [uIDAI Vs CBI (SpecialLeave to Appeal (Crl) No(s).2524/2014)] stating that adhar card should not be animpediment in providing certain services to the citizens. In fact that information was given bythe respondent department itself. In its Order of March 24, 2014, the Supreme Court saidthat an Aadhar card was not compulsory for availing any facility from a government authorityand any authority making such a card mandatory would have to modify its circulars andnotifications to that effect. 5. It is pathetic that even after the RTI application is filed long ago, such information was notgiven to the appellant. The Commission, therefore, directs the Public Authority to explain thereasons for formulating a policy of making adhar card number mandatory for issuance ofcaste certificate. For a long time they were issuing caste certificates without insisting on thisnew condition. It also their duty to inform the people that Aadhar card number has to beprovided while seeking the Caste Certificate. It is breach of principles of natural justice todeny the certificate which they were getting all these years without informing them thechange in the requirement. Whether a person is eligible to get Aadhar card or not, he wouldbe certainly eligible to get certfication of his caste. The PIO cannot take the execuse ofabsence of adhar card to deny the rights of the people. This was made very specific by theSupreme Court on several occassions. The Commission directs the PIO to explain whypenalty cannot be imposed for denial of information and violation of RTI Act, within 21 daysfrom the receipt of this order. The Commission directs the head of the Public Authority toexplain the reasons for such policy which is in clear violation of orders of Supreme Court andtheir proposed action thereof to resolve the problems in the issue of caste certificates in theform of a policy document, which shall be placed on official website in both Hindi and Englishlanguages, a copy of which shall be served on the appellant and this Commission within onemonth from the date of receipt of this order. 6. The Commission also directs the respondent authority to inform the appellant about fateof his application for caste certificate within 15 days from the date of receipt of this order.The appeal is disposed of. But till 14 January 2015 (almost three year) not received aadhaar card physically. However they transferred my rti on various dept of UIDAI, according to questions , but today I received some replies from one of the UIDAI logistics division. In the reply from UIDAI ... My Question was... Please provide me the present status of delivery (physically) of my enrollment no ****/*****/*** date 22/02/2012 16:00:31. Reply was …The Aadhar letter has already been dispatched on 16.08.2013 through First Class digitally franked mail service of Dept. of Posts for which no individual dispatch number of tracking facility is provided by the dept of Posts. The delivery of aadhar letter to the resident is being done by the dept. of posts and any information related to delivery of aadhar letter may be obtained from CPIO concerned of dept. of Posts. However the Aadhar letter is being reprinted and it will be dispatched soon after printing through the dept of posts as First Class digitally franked mail service of Dept. of Posts which is currently approved of dispatch. Now what I do?? Unfolding Aadhaar Scam: Importantpages missing from UIDAI contracts - Part1 After refusing to share contract documents for years, the UIDAI finally provided it under the RTI Act, with important pages missing In the matter of Right to Information (RTI) application, on 14 October 2014, Vijay Bhalla, Deputy Registrar, Central Information Commission (CIC) wrote a letter on behalf of Sharat Sabharwal, Information Commissioner, CIC to Central Public Information Officer (CPIO) & Deputy Director, UIDAI. The letter states, “I am directed to convey that you should, within two weeks of the receipt of this order, provide to the Appellant thelimited information i.e. financial quotation/ price by the third party firms inthe subject tender as disclosure of it would not inflict any harm to thecompetitive position of third party firms at this stage when the contracts have already expired.” The RTI application was filed seeking a complete copy of the contract UIDAI signed with L1 Identity Solutions for Biometric Technology, on 24 August 2010 and a copy of thecontract UIDAI signed with Accenture for Biometric Technology, on 1 September 2010. Responding to this letter, Subrata Das, the CPIO & Deputy Director, UIDAI wrote to theRTI Appellant on 22 October 2014 in compliance with the CIC decision on the second Appeal hearing dated 30 September 2014. UIDAI’s letter reads, “The requisite letter in compliance with the CIC decision is as under: (i) financial quotation/ price quoted by Accenture Services Pvt Ltd is Rs2.75 (inclusive of taxes) as a unit price for Enrollment Allotted Transaction for De-duplication Services (ii) financial quotation/price quoted by L1 Identity Solutions Operating Company Pvt Ltd is Rs2.75 (inclusive of taxes) as a unit price for Enrollment Allotted Transaction for De-duplication Services This reply implies that for each of the 100 crore Indian residents targeted forAadhaar enrolment, the taxpayer through the central government will have to incur the cost of Rs2.75 to the companies in question. This is significant because this is not a one-time cost but each time de-duplication of Aadhaar number is done, the cost will be incurred. Besides other gnawing concerns about an assault on human rights, national security, economy and sovereignty, this is yet another case of foreign companies withholding transfer of technology from developing countries. It is also relevant to recall that two US based corporations, HP and IBM, had challenged UIDAI's tender processes. They had objected to their technical disqualification. TheRs2,000 crore contract for UIDAI's tender for managed service provider was won by Wipro Technologies. The Economics Times had reported on how the UIDAI tender process was unfair.” Notably, the 'Strategic Vision on the UIDAI Project' document that was prepared and submitted to the processes committee of the Planning Commission (set up in July 2006) by Wipro Ltd (consultant for the design phase and programme management phase of thepilot UIDAI project). It is noteworthy that the decision of Sharat Sabharwal, Information Commissioner, CIC and the letter of UIDAI furnishing "Limited Financial Information" is contrary to theoriginal order of Sushma Singh, the Information Commissioner, CIC dated 21 October 2013. Mr Sabharwal’s order appears indulgent towards the UIDAI and the foreign companies in question. The sequence of events in this regard is quite germane for understanding the issues at hand. The Biometric Service Providers, namely, Satyam Computer Services/Sagem Morpho, L1 Identity Solutions and Accenture Services had responded to UIDAI’s Expression of Interest (EoI) and submitted their tenders for accepting the projects on thebasis of fulfilling the following clauses: a) The prime respondent should have an office in India in the form of a Registered Office. b) If the prime respondent does not have a Registered Office, then it should have a Branch office, Representative Office, Sales Office, or an office of its subsidiary company in India for the purpose of submission of the expression of interest response. c) If the prime respondent is unable to meet the stated conditions, it shall submit a declaration/confirmation stating that it shall have Registered Office in India for the purposes of signing contracts with the UIDAI. But in its letter dated 21 July 2011, the UIDAI stated that “There is no means to verify whether the said companies/ organizations are of US origin or not. As per our contractual terms and conditions, only the companies registered in India can bid.” If that is indeed the case then the UIDAI will have no means to verify whether Sagem Morpho and later L1 are of French origin or not. Subsequent RTI applications forced UIDAI to share contract agreements with these companies, which clearly stated their countries of origin. This establishes that the UIDAI did have the means of verifying the foreign origin of the companies in question. It indulged in misrepresentation of facts with impunity. If the letter of 14 October 2014, Vijay Bhalla, Deputy Registrar, CIC is read with the interim order of Sushma Singh, Information Commissioner, CIC dated 26 July 2013, it become abundantly clear that UIDAI had raised the issue of Third Party’s trade secret and propriety information and the same was responded to by the author in writing. The order reads: “The appellant’s representative filed written submissions before the Commission, which inter-alia states that denial of information is not in public interest. The people of India have a right to know the details of the contracts issued by an Authority set up under an order of the Executive and the Authority claiming to act on behalf of the Government of India, entering into contracts with private firms, both foreign and Indian. Since the contracts are paid from Government funds and the project for which the contracts have been given pertained to the collection and processing of personal information of every person residing in India, including the citizens, the people have a right to the said information.” In her order, she asked the UIDAI to provide “written submissions, justifying non-disclosure of the information sought by the appellant under the provisions of Section 8 (1) (d) of the RTI Act.” The matter was scheduled for hearing on 10 September 2013. On 10 September 2013, UIDAI failed to provide the “written submissions, justifying non-disclosure of the information sought by the appellant under the provisions of Section 8 (1) (d) of the RTI Act”. UIDAI realized that it does not have any defence under the said RTI Act for denial of information. It submitted a letter (No. F.2013/096/2012-RTI-UIDAI) dated 10 September 2013 to Sushma Singh, Information Commissioner, CIC. On 10 September 2013, the author attended the hearing at the Central Information Commission (CIC). Shirish Kumar, Assistant Director General (ADG), Unique Identification Authority of India (UIDAI) and Shalic Das, ADG, UIDAI, were also present during the hearing, wherein the CIC sought an explanation from the UIDAI about their refusal to share a copy of all contracts given to biometric technology companies, namely, L1 Identity Solutions and Accenture. To which the UIDAI “submitted before the Commission that the copy of the said contracts can now be provided as the contracts have now expired.” The UIDAI gave a written submission to the CIC (No.F12013/096/2012-RTI-UIDAI) stating that "contractual obligation with respect to BSP's (Biometric Solution Provider) contracts had expired. Therefore, UIDAI has no objection in sharing the following contract details :- a) Copy of contract of UIDAI with L1 Identity Solutions for Biometric Technology; and b) Copy of contract of UIDAI with Accenture for Biometric Technology". Taking this submission into account, Sushma Singh, Information Commissioner, CIC gave her final order saying, “In view of the above, the Commission hereby directs the respondent (UIDAI) to provide a copy of the two contracts to the appellant within two weeks from the receipt of the order.” This order demolished the reasoning behind the claim of UIDAI for denial of contract agreements of these foreign companies. UIDAI had stated that “The information relating to the referred contracts cannot be disclosed as per clause 8.1 (d) of RTI Act, 2005” in its letter dated 7 May 2012. Following the hearing, the author met Shirish Kumar, ADG, UIDAI at their office in Jeevan Bharti Building, New Delhi who gave me copies of the contract of UIDAI with L1 Identity Solutions for Biometric Technology and Accenture for Biometric Technology. After examining the contract agreement with regard to the Accenture for Biometric Technology, the author noticed that the first 237 pages of the contract agreement were in order but after that there is a one pager titled Annexure J Technical Bid Technical Bid as submitted by Accenture Services Pvt Ltd but the Technical Bid document is missing. After that there is a one pager titled Annexure K Commercial Bid Commercial Bid as submitted by Accenture Services Pvt Ltd but the Commercial Bid document is missing. With regard to the L1 Identity Solutions for Biometric Technology, the author noticed that the first 236 pages were in order, but a one pager titled “Annexure I Non-Disclosure Agreement as submitted by L1 Identity Solutions Operating Company Pvt Ltd” is missing. After that there is a one pager titled Annexure J Technical Bid as submitted by L1 Identity Solutions Operating Company Pvt Ltd., which is missing. After that there is a one pager titled Annexure K Commercial Bid as submitted by L1 Identity Solutions Operating Company Pvt Ltd., which is missing. This compelled the author to write to Shirish Kumar, ADG, UIDAI about the “Missing Pages from the contract agreement of UIDAI and foreign biometric technology companies, CIC Case No. CIC/SS/A/2012/003157,” asking him to share the missing papers. It was/is evident that although the CIC asked the UIDAI to share a copy of the contracts, it chose to violate this order and shared truncated and selected parts of the contact agreement. Shirish Kumar responded on 20 December 2013 claiming, “There are no missing pages in the two contracts…Some of the pages in the above contracts have only references of Annexures. The annexures J&L w.r.t Accenture Service Pvt Ltd mentioned Technical Bid and Commercial Bid. The annexures I, J, & K wrt to L-1 Identity Solutions Operating Pvt Ltd mentioned-non disclosure Agreement, Technical Bid and Commercial Bids.” The very next paragraph of his letter revealed the inconsistency of his claim. He further stated, “As per Confidentiality Disclosure statement, the document contains confidential information of the above firms and they have requested not to disclose the information outside UIDAI or be used for purposes other than the evaluation of their business capabilities. Secondly, this being third party information, the firms were requested for their comments, wherein they had declined to share their documents with any applicant.”

Aadhaar: Once allotted, you can never cancel it, reveals RTI While Nandan Nilekani, former chairman of UIDAI, is busy fighting his election, he has left behind a dubious record of keeping the Aadhaar holdersin the dark regarding access to their biometrics and other personal details by any private or public agency Now, it is from the horse’s mouth. The office of the Unique Identification Authority of India (UIDAI) has admitted that information regarding biometrics and other personal details of Aadhaar, the 12-digit unique identification (UID) number, to any outside agency cannot be revealed to the holder unless it is requested by the government. In addition, once you have been allocated the UID number, there is no way to delete or cancel it, which means you cannot opt out of it. More shocking is that Aadhaar was never used to authenticate subsidies for the LPG cylinder. It was just used as an identifier for the bank. The second appeal was heard In a Central Information Commission (CIC) Sharat Sabharwal’s office on 13 March, 2014, wherein he stated that although the RTI applicant, CJ Karira had filed a requisition under Section 7 of the RTI Act, which requires the PIO to give information within 48 hours; the requisition does not specifically come under this section. However, his order stated: “…we took this appeal up for consideration out of turn as the answers of the public authority to the queries of the Appellant in the instant case may be of interest to a large number of UID card holders, who may have similar apprehensions as the Appellant regarding sharing of the data provided by them to the UIDAI for obtaining a UID card.” Karira, co-convener of India Against Corruption (IAC) filed a RTI application on 27 September 2013 seeking information regarding sharing of his Aadhaar data to outside agencies. He also asked for certified copies of the agencies with whom the data has been shared and procedure to delete one’s name from the UID register. Not having received a reply from the CPIO, he filed an appeal to the First Appellate Authority (FAA) on 13 November, 2013. The FAA did not conduct any hearing or pass any order. On 23 December 2013, the CPIO gave him partial and wrong information, particularly regarding the query of whether details of his UID number was shared with any agency. Karira stated to the FAA that the “information provided by the CPIO vide his letter dated 23 December 2013, was ‘incomplete and incorrect’, because HPCL and the State Bank of Mysore had his UID number and got the same authenticated through UIDAI, while the CPIO had stated in his reply that his data had not been shared with any entity outside the UIDAI.” Karira again asked for “complete and correct information free of charge; imposition of penalty on the CPIO under section 20(1) of the RTI Act for the delay in provision of information; a warning to the FAA to dispose of appeals to him within the stipulated time limits under the RTI Act; departmental action against the CPIO and the FAA under the relevant rules and regulations and; a direction to the public authority to arrange training on RTI matters for its concerned officials.” Having failed to get the required information and to request action against delay of information, Karira went in second appeal with the CIC on 15 January 2014. The CIC order observes during the hearing on 13 March, 2014, “… it is seen that three of his queries related to the requests… for authentication/ confirmation/ matching of any of his data held by the UIDAI, the details of the persons or entities asking for such authentication etc. and certified copies of requests for such authentication and replies by the UIDAI..” “The CPIO had stated in his reply dated 23 December 2013 that Karira’s data had not been shared with any entity outside the UIDAI. Karira has submitted that this information was misleading, because he had given his UID number to his gas agency and bank in connection with provision of subsidy on supply of cooking gas cylinders.” “UIDAI stated that the use of the UID number, provided by the Appellant to his gas agency and bank, was for the limited purpose of ensuring that the person being provided the gas cylinders and subsidy was the same. It did not involve authentication/ matching by those agencies with the data held by them.” The shocker is about the procedure to surrender one’s Aadhaar number. The order observes: “Two of the queries related to the procedure by which a UID number holder could surrender his UID number and card and get his data erased from the data base of the UIDAI. The CPIO informed the Appellant vide his letter dated 13th and 16 January 2014 that as on date, there was no such procedure adopted by the UIDAI to delete the UID number from the UID database. The last query in the RTI application sought information regarding the non-UIDAI entities/ persons, who have access to his personal/ demographic/ biometric data held by UIDAI or with whom UIDAI has shared such data. “…The CPIO stated that data would be shared only on a formal request by the State concerned through the Nodal Departments for the delivery of welfare and public services and schemes of the Government. Karira submitted during the hearing that a declaration in the application for UID number obtains the consent of the applicant for such sharing of data. The Respondents stated that such consent is not mandatory, but optional.’’ The CIC also ordered that UIDAI should have adequate number of CPIOs and FAAs to ensure that all applications are disposed off within the relevant time frame. According to CIC, “…there had been a surge in the RTI applications to the UIDAI through the online RTI portal since August-September 2013, and as many as 480 applications were received between August & November 2013…We are surprised that a public authority such as the UIDAI, with widespread public dealings, should have thought it fit to have only one CPIO until recently.” Reacting on the CIC order, RTI activist Maj Gen SCN Jatar (retd) said, “It is shocking to note that Aadhaar is not used to authenticate LPG gas subsidies. It is only an identifier for a bank and the OMC to ‘match’ the number; there is no way to delete an UID number once allocated; there is no way to delete the biometric and other details of a citizen who wants to "opt out" of Aadhaar; there is no record maintained of who Aadhaar data is shared with and; there is no record maintained of who Aadhaar data is shared with!’’ Attached is the order from the CIC… C J karira vs UIDAI.pdf

What has changed during past 12 months that required urgent intervention from the ‘pseudo supreme’ authority of Congress to lobby for increasing the subsidised LPG cylinders to 12? Will it stop the suffering of citizens who are harassed under the pretext of Aadhaar and subsidised cylinders? Here is what you can do in the meanwhile As mentioned in the first part, the Aadhaar, LPG refill subsidy and direct benefit transfer (DBTL) scheme is in to complete mess. The ‘larger than life’ claims made by the proponents of Aadhaar, especially IT Czar Nandan Nilekani, are falling flat in practice. Can the Unique Identification Authority of India (UIDAI) explain why people are not receiving LPG refill subsidy on time and into their own lined bank account while people not related with these are receiving SMS about LPG subsidy? The mess is created under the pretext of unique identification (UID), which was then penetrated into the LPG subsidy through banking system. All this was done without taking into consideration the issue and problems of LPG refill distribution and banking system. This has resulted in citizens suffering at the hands of LPG distributors under the pretext of Aadhaar, which is meant for residents. Following the interim order issued by the Supreme Court, all three oil marketing companies (OMCs), as well as union government and Ministry of Petroleum and Natural Gas (MoP&NG) had sought modification of the apex court’s order of 23 September 2013. The order unequivocally directed, “no person should suffer for not getting the Aadhaar card in spite of the fact that some authority had issued a circular making it mandatory.” According to Justice KS Puttaswamy, the retired judge from Karnataka High Court, who had filed the public interest litigation in the Supreme Court, government schemes (of making Aadhaar mandatory) cannot be imposed upon people. Speaking with Citizen Matters, Bangalore, Justice Puttaswamy had said, "An interim order is as much as a final order. So presently all these government schemes cannot be imposed upon people. And if it is done, it is contempt of court. The interim order does not mention any names ofschemes. But under this, no one can insist of Aadhaar for any government schemes like ration card, bank account, cash transfer, issue of LPG subsidies and so on." Another interesting aspect of the whole Aadhaar drama is Congress and most political parties are avoiding taking a clear political position demanding scrapping of the biometric identification exercise and are speaking with forked tongue. Congress vice president Rahul Gandhi’s speech last week is nothing but another example of bluffing. When finance minister P Chidambaram said there is a need to increase the quota for subsidised LPG refill to 12 from nine, both oil minister Veerappa Moily and oil secretary Vivek Rae were quick to rule out the hike. However, as soon as Rahul Gandhi expressed the need to increase the quota, the same Moily was quick to say that his ministry would put forward such proposal before the upcoming cabinet meeting. This shows the politicisation of LPG subsidy, especially looking at the general elections in next few months. It must be noted, it was the same Manmohan Singh-led government, which capped the subsidised LPG refill quota to six cylinders per year in September 2012. Following outcry from several quarters, in January 2013, it was increased to nine cylinders. The original idea behind the cap in LPG refill cylinders was to reduce the subsidy bill of the government. If the UPA government is interested in reducing subsidy bill, then why not scrap it in one stroke, instead of playing hide and seek games with common citizens? Interestingly question though, what has changed between January 2013 and January 2014 that required intervention from the ‘pseudo supreme’ authority of Congress to lobby for increasing the LPG refill per year to 12? It is nothing but vote bank politics to appease voters before the general elections. Hope the same thinking would be applied in scrapping the UID/Aadhaar project as well from the Congress high command, which still reportedly has not enrolled for the scheme. In a country like ours where illiteracy is rampant and the average citizen is already burdened with different cards for different purposes- voter ID card, PAN card, BPL card, the forceful linking of Aadhaar with LPG refill subsidy is only burdening the common citizen. Hope the Supreme Court takes the OMCs, Oil Ministry and the UPA government to task and put the illegal ‘Aadhaar business’ to an end. Most importantly, as Moneylife has been writing, the basic issue in India and its over billion citizens are not about subsidy, but it is about demand and supply gap. Citizens are being deprives their rightful benefits because the middleman-politicians-babu nexus is siphoning off the benefits before it reaches the end user. For example, citizens from a far away village are not receiving foodgrains because of the nexus. And directly transferring subsidy money in to these people’s bank account (if they have one) is not going to ensure that the foodgrains reach the village. This is because if the foodgrains are siphoned off before reaching the village and public distribution (PDS) shop, then how and from where these poor people are going to buy it? Anyway, that is subject for another article. Here we will discuss about the LPG refill subsidy only. There are basically two types of LPG customers, one who has linked their Aadhaar andbank account and two, those who have not done so. Those who do not have Aadhaar: Such customers are being flooded with SMS to enrol for Aadhaar and link it to their bank account and subsequently provide the details to their LPG distributor. However, with the interim order of the Supreme Court being in force, the LPG distributor and OMC cannot deny the rightful subsidy to the rightful customers. This means, any LPG customer, who may or may not have submitted the Aadhaar is liable to get the nine subsidised LPG refills for FY2014 (unless the OMCs increase it to 12 refills per year following the diktat from Rahul Gandhi). As Moneylife wrote, in one glaring example of misuse of powers, one distributor from Hyderabad not only denied a LPG refill to a customer despite showing willingness to buy it at market rate. Going one step ahead, the distributor even blocked the connection of the customer for not providing Aadhaar. Those who have submitted Aadhaar are also facing problems: Major issue these customers are facing is about receiving LPG refill subsidy on time and the communication. Several customers are still waiting for their subsidy to be deposited in their bank accounts. In the meanwhile, many had to buy the LPG refill at market rate that is without the subsidy. At present, the open market rate of a domestic (home use) LPG refill costs Rs1,275.5 while the subsidised refill costs Rs455. The subsidy amount in this case works out to be Rs820.5, however, the customer is getting only Rs794.84. This means he will have to pay the differential amount from his own pocket. In addition, there is value added tax (VAT) and income tax that the customer will have to pay. The subsidised cost of LPG refill included all taxes, but for non-subsidised LPG cylinder the customers will have to borne the cost. In addition, since the money would be deposited in the bank account, it would be considered as ‘income from other sources’ and the customer would have to pay income tax, as per his/her obligations under appropriate slab. Mention in your letter that as per the Essential Commodities Act, the OMC and distributor is mandated to deliver the LPG cylinder at your home within 48 hours of booking. As most of the distributors don’t follow this, you can tell your distributor that you would file a complaint before the Consumer Forum. Here are rights of consumers under the Essential Commodities Act 1955 and the corresponding LPG (Regular Supply & Distribution) Order 2000... -Bookings for the gas cylinder must be accepted over the phone. -100% home delivery. -The gas cylinder should to be delivered within 48 hours of booking. -The customer has the right to weigh the cylinder on taking delivery. -Gas agencies must be open for business between 10am and 6pm, except on public holidays and Sundays. 5. Also inform the LPG distributor that his/her act is contempt of Supreme Court order and you would be compelled to write to the Chief Justice of India for it. 6. If the LPG distributor/OMC continues to act high-handedly, then write to the Chief Justice of India (with supported documents), requesting the Court to take suo moto action for contempt of court order against your LPG distributor, the OMC, Ministry of Petroleum and Natural Gas, the minister of MoP&NG and last but not least, the Prime Minister. You can also include Nandan Nilekani, the chairperson o UIDAI, the UIDAI and Planning Commission (as UIDAI works under it). 7. Use the Right to Information (RTI) Act while perusing the matter with all the concerned as they all fall under the category of 'Public Authority' as defined under the Act. According to the Union Minister for Petroleum and Natural Gas M Veerappa Moily, 'Over 14 crore people in the country have LPG connections. However, three crore among them have got connections by producing fake documents’. Clearly the 11 crore honest and law-abiding citizens do not need to be made to suffer Aadhaar numbers or bank accounts? Surely you cannot be placing blind faith on using a random number assigned by the UIDAI to a set of unverified and unaudited demographic and biometric data submitted and maintained/ operated by private parties who are paid for every record they submit in preference to your own records that you seem to have audited and have used all along? What purpose does this suffering serve? Surely you know that through its notification of 28 September 2011 the Reserve Bank of India suspended the “Anti-Money Laundering” Rules for bank accounts opened with Aadhaar as the sole KYC? Surely you know this makes it possible to transfer subsidy to unverified accounts operated by anyone who has hold of the Aadhaar-linked bank account? Surely you cannot want to cause people to suffer the embezzlement of their subsidy? I urge you to immediately discard any linkage or use of Aadhaar with your databases and revert to the time tested practices of issuing subsidized cylinders.
