GUWAHATI, May 15 – Chief Minister Tarun Gogoi today said that citizens can file RTI or approach the courts in case there is any grievance related to the recently declared APSC results.Replying to a query during an interaction with mediapersons at the State Secretariat here, Gogoi said, “There is RTI. Defending the appointment of Rajya Sabha TV channel CEO Gurdeep Singh Sappal, the Upper House Secretariat has claimed that due to his strong and dynamic leadership, the channel has emerged as a top-rated channel in terms of content, quality and objectivity. It also denied any irregularity in the appointment of senior level officers like joint secretary (JS) and above. After kick starting the anti corruption campaign with an expose on backdoor appointments in the Rural Development department, ACAUT Nagaland said it was only the beginning of its phase-wise campaign. Media Cell of ACAUT said many more exposes were in the offing, provided that PIOs of other departments “furnish the correct RTI answers on time.” ACAUT informed public that it had filed RTIs on backdoor appointments in other departments and requested PIOs to strictly adhere to the time period of 30 days to furnish the answers. It warned, that failure to do so would cast aspersions on the integrity of ACAUT and for which the PIOs would be held solely responsible for misleading public. New Delhi, May 7, 2015, DHNS: The Centre on Wednesday took a swipe at the collegium system of appointment of judges before the Supreme Court, saying all the decisions taken by the executive were open to public scrutiny but the top judiciary maintained opacity. Defending the National Judicial Appointments Commission, Attorney General Mukul Rohatgi submitted before a five-judge Constitution bench presided over by Justice J S Khehar that the ultimate test of the new law is whether appointment by a six-member body was so obnoxious that it was hit by the principle of basic structure of Constitution. “In democracy, masters are public. If you (judiciary) take the role of executive (in appointing judges), you are also subject of scrutiny but the Supreme Court said it will not open and not provide details how collegium chose a name,” he said. The AG was referring to the challenge by the SC (in its administrative capacity) of a decision by the Delhi High Court to provide details of how the collegium system selected a judge to noted RTI activist Subhash C Agrawal. Jammu, May 1: A RTI has brought to fore a backdoor appointment which was made by the State Road Transport Corporation (SRTC) nearly 20-years ago without issuing a formal appointment order in appointees favour. As per the details available with "Early Times", one Monty Kangotra of Vijaypur Samba had filed a RTI to seek the details pertaining to appointment of one Zahoor Ahmed Tantray, presently working as an Inspector in SRTC. In reply to RTI filed by Kangotra, Manager (Administration) Mohammad Ashraf (PIO JKSRTC, Srinagar) stated that the appointment order copy of Inspector Zahoor Ahmed Tantray is not readily available. BELAGAVI: An RTI activist Bhimappa Gadad alleged that there are several irregularities and violation taken place in the direct appointments made to work at Vidhana Soudha in Bengaluru during the period of 2008 to 2013. Government recruited 198 people of different ranks to work at various secretariats in Vidhana Soudha during 2008-2013. An RTI activist said according to Karnataka Civil Services (General Recruitment) Rules- 1977, the candidate who apply for any civil services appointment, should not cross 40 age. But here, several number candidates recruited with the age of 43, 44 and even 46, violating the rules, he said.   10. Delhi High Court adjourns PIL for appointment of CIC and 3 Information Commissioners for ASG to seek instructions 1. The PIL,(W.P.© No.3386/2015) filed by Shri R.K. Jain, Shri Lokesh Batra and Shri Subhash Agrawal came up for hearing on 8-4-2015 before the bench of Hon’ble Chief Justice and Hon'ble Mr Justice Rajiv Sahai Endlaw of Delhi High Court. 2. Shri Prashant Bhushan, Advocate appeared for the petitioners and Shri Sanjay Jain, ASG, appeared for the respondents. 3. Initially, the Court wanted to know from the ASG as to what steps has been taken for the appointment of the Chief Information Commissioner and 3 Information Commissioners since August, 2014 as in April, 2015, it is a long time. Court indicated that appointments be made within 4 weeks. It is pertinent to mention here that as per the government reply to the Right to Information (RTI) application, the Department has neither record traceable nor any consolidated information with regard to the number of apprentice engineers engaged from time to time in the Corporation. The Corporation in the RTI had also admitted that some of the selected engineers have been terminated after discrepancies were found in their certificates and at least 12 candidates were sent on deputation on Motor Vehicle Department as Motor Vehicle Inspectors.   15. CIC denies info on compassionate appointment since respondent has right to defend itself ! The CIC has ruled that info related to "compassionate appointment" can be denied under RTI since the respondent was defending itself in a court case and it has a right to defend itself. Curiously, the CIC has not cited any sub section of Sec 8 to deny such information.   18. TOI published the news today: Gujarat high court on Thursday held appointment of two Information Commissioners- B.G.Panchasara and Shridevi Shukla as illegal. The HC said that the appointment of both the persons were not legally valid. The HC reached to this conclusion after Praful Desai of NGO Jagate Raho questioned the consultation process adopted by the authorities in appointing Panchasara and Shukla on the post of IC. The appellant, Shri G Nageswara Reddy, submitted RTI application dated 17 October 2013 before the Central Public Information Officer (CPIO), Department of Financial services, New Delhi; seeking information regarding the relevant File Notings of the appointment of Smt. Arundhati Bhattacharya as chairman, SBI on 7.10.2013 vide notification F.No:2/5/2013BOI. 2. Vide reply dated 18 November 2013, the CPIO denied the information u/s 8(1)(i) of the RTI Act, 2005 as the information sought for was part of ‘cabinet paper’. Not satisfied with the CPIO’s reply, the appellant preferred an appeal dated 26 November 2013 to the first appellate authority (FAA) stating that as the Appointment Committee of the Cabinet (ACC) had already decided the matter and the aforesaid decision has already been implemented on 7.10.2013, the cabinet papers could no longer be held back in accordance with the provisions of Section 8(1)(i) of the RTI Act, 2005. Vide order dated 31 December 2013, the FAA, however, upheld CPIO’s decision. 3. Dissatisfied with the response of the public authority, the appellant preferred appeal before the Commission. 4. The matter was heard by the Commission. The appellant was not present during the hearing. The respondent submitted that the appellant vide his RTI application dated 17.10.2013 had sought copy of file notings of the appointment of Smt. Arundhati Bhattacharya as chairman, SBI which was part of the proposal to be placed before the Appointments Committee of the Cabinet which they had denied under the exemption given u/s 8(1)(i) of the RTI Act, 2005. The FAA had also upheld the decision of the CPIO. 5. During the hearing, the respondents stated that the selection process had been concluded and therefore, they will be able to provide the information sought by the appellant. 6. In view of the above, the Commission directs the respondent to furnish the information sought for to the appellant by 31st December 2014 keeping in view the provisions of the RTI Act, 2005 & RTI Rules, 2012.   22. Appointment on Contract/Daily wages in Govt. Company Sir, One of my friend's son directly approached to a Govt Company for some computer operator cum typist Job on contract or daily wages. But ,they took their CV and told that whenever vacancy would be created , we will call you for interview/test. But as he stated that next week they appointed directly to some other person known to them without calling him or anybody. I just wanted to know, can we file any RTI for asking them information for not calling him or not. If Yes, Can you please help me to draft the RTI query for the same. Regards,

Dear All, Please find below the web link to news item appearing in Indian Express about the appointment of three Information Commissioners. harinder dhingra Quote " The husband of a sitting high court judge who is hearing many cases against the Haryana government, the wife of Chief Minister Bhupinder Hooda’s political advisor, and the CM’s advisor (health) — these are the three new state information commissioners selected by the state government on Wednesday. They are likely to be sworn in before Governor Jagannath Pahadia’s term ends on July 26. The decision was taken at a meeting of the statutory committee on Wednesday, chaired by Hooda and attended by Education Minister Geeta Bhukkal. The third member of the committee, Leader of the Opposition in the Assembly Om Prakash Chautala, did not attend the meeting. However, Chautala recorded his dissent in a note to Hooda. Many cases against the state government are pending in the court of Justice Daya Chaudhary, whose husband, Dr Amar Singh, a retired Excise and Taxation department officer, is among those selected for the post. These include the issue of multiple allotments of residential plots by the Haryana Urban Development Authority (HUDA). The others who have been picked are: Rekha, the wife of Hooda’s political advisor Professor Virender Singh, and Shiv Raman Gaur, the CM’s retired additional principal secretary who was recently re-employed as his advisor (health). In his dissent note, Chautala urged the CM to stop the appointments. “It will only result in wrongfully extending the benefits of political patronage to persons like Smt Rekha, Amar Singh and Shiv Raman Gaur, who otherwise are not eligible for appointment as the state information commissioners,” he said. “Such appointments should be of persons of eminence in the field of law, administration and management etc., as stipulated in the 2005 Right to Information enactment of the Parliament of India. Is it not correct, for example, that the lady… has no qualification other than being the spouse of your so-called political advisor, and earns her livelihood from the education department of Haryana?” Justifying the decision, Bhukkal said, “The screening committee scrutinises the applications of interested people who have applied for the post. The screening committee forwarded us the names and we gave our approval. There is nothing wrong in this.” On the decision to pick Amar Singh and Rekha, Bhukkal said, “Both must have applied for the post in their individual capacity. Many retired judges also want to be appointed state information commissioners. If a judge’s husband has been selected, there is nothing wrong.” Both Rekha and her husband did not respond to repeated phone calls and text messages. When contacted, Amar Singh refused to comment. Justice Daya Chaudhary was also not available for comment. The Haryana Information Commission has a chief information commissioner and seven information commissioners at present. According to the rules on selection of information commissioners, the candidates “should be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance. The information commissioners should not be a Member of Parliament or Member of Legislature of any state or union territory, or hold any other office of profit,or connected with any political party, or carrying on any business or pursuing any profession.” The information commissioners remain in office for a term of five years or till he/she attains the age of 65 years, whichever is earlier. As reported by Pramod Kumar at organiser.org Official documents, procured through RTI by this correspondent, reveal that even while the election results were being announced on May 16, the Finance Ministry was busy in issuing transfer orders of around 148 Indian Revenue Service (IRS) officers in Income Tax Department. Some officers of the Central Customs and Excise Service, serving as private secretaries to various ministers, also got new postings as soon as they realised that the game was over for their political masters. The Government also empanelled 45 IAS officers as Additional Secretaries. According to the information procured through an RTI dated May 21 (No. 4-1/2014-CLM), the Ministry of Minority Affairs appointed Prof Akhtarul Wassey as Commissioner for Linguistic Minorities (CLM) with effect from March 4, 2014, a day before the imposition of moral code of conduct for general elections. The notification to this effect was issued on April 4. The tenure of the post is three years. The designation is equivalent to the post of Secretary to the Government of India and he is paid a salary of Rs 80,000 per month plus other allowances as admissible. The appointments in other ministries or departments include that of Raghvendra Singh as Additional Secretary in Ministry of Information & Broadcasting. Dr Rajpal was made Medical Superintendent of Safdarjung Hospital on May 16. Later, on May 19, the Finance Ministry issued transfer orders of another 11 IRS officers to coveted posts of the Income Tax Department in Mumbai, Delhi and Hyderabad. Even on May 20, the Finance Ministry issued orders for promotion of 104 officers of Customs and Excise Department from Group B to Group A ranks of Assistant Commissioners. Similarly, Ashwin B Pandya was appointed Chairman of the Central Water Commission and ex-officio Secretary to Government of India. On May 6, Bhagwati Prasad Pandey was appointed as Additional Secretary and Financial Adviser to the Department of Commerce under Ministry of Commerce and Industry. Even being at the exit gate, the government hurriedly filled top positions and made major appointments. Interestingly, most vacancies filled were those lying unattended for several years. One such case is the appointment of Narendra Kothari as CMD of National Mineral Development Corporation (NMDC). The post was lying vacant since 2011 and it was the Appointments Committee of the Cabinet (ACC) headed by Prime Minister which cleared the appointment at the eleventh hour. Another post which was filled up was that of the Chairman of Housing and Urban Development Corporation Limited (HUDCO). Dr Medithi Ravi Kanth, a 1986 batch IAS officer, was put in the chair towards the end of April. Not just the appointment of Lt Gen Dalbir Singh as new Army Chief, many other key appointments in security establishments were made including that of Devendra Kumar Pathak as Director General of Border Security Force. The appointment of Jammu & Kashmir Police DGP Ashok Prasad as Special Director of Intelligence Bureau also came in first week of May. The appointment of Prof Mahesh Rangarajan as Director of Nehru Memorial Museum and Library is a classical case of obliging people of choice. Despite strong objections from the Department of Personnel & Training (DoPT) Dr Manmohan Singh, on May 5, approved his permanent absorption as Director of NMML. This extension was rushed through in a fortnight in the last days with the ministry putting up the proposal for approval of the Appointments Committee of the Cabinet (ACC) on April 30 and was cleared just days ahead of the election results. The order was issued on May 14. Rangarajan’s three-year term ends in August but now after this permanent absorption he will serve as Director until his superannuation in April 2024. In the National Commission for Scheduled Tribes under Ministry of Tribal Affairs also some appointments on constitutional posts were made in November 2013. According to an RTI dated May 26 (F.No.11030/2/2014-C&LM-I), the Ministry appointed Dr Rameshwar Oraon as Chairperson on November 1, 2013, Ravi Thakur as Vice Chairperson on November 13, 2013, Smt K Kamla Kumari as Member on November 1, 2013 and Bheru Lal Meena as Member on November 1, 2013. Though the previous three names have graduation or post graduation degree but the fourth on, Bheru Lal Meena, is just matriculation pass. The term of all the four persons is three years. Not only this Sheila Dikshit was appointed Governor of Kerala just a day before the imposition of model code of conduct i.e. on March 4. RTI response from Union Ministry of Home Affairs (MHA) confirmed that selection of Sheila Dikshit as Governor was a one-man verbal directive of the then Union Home Minister Sushil Kumar Shinde with all formalities from resignation of Nikhil Kumar, temporary posting of HR Bharadwaj followed by permanent posting of Sheila Dikshit on the post was completed within hours on the same day, March 4, 2014. Not only these appointments, the Congress showered largesse of spacious bungalows in the prestigious Lutyens' zone to its favourites a mere three days before the voters wiped it out of the power. On May 13, the government allotted bungalow at 5 Janpath to Assam Chief Minister Tarun Gogoi and allowed Nandan Nilekani, the former Chairman of Unique Identification Authority of India, to extend his occupation of a bungalow allotted to him as the Authority's chief. Sources say former Additional Solicitor General KTS Tulsi, who represented Robert Vadra in his land deal cases, was allotted a Type VIII bungalow at Motilal Nehru Marg. According to sources, there are hundreds of such other Congress nominees who were showered largesse just before the exit. Detail of all such appointments is yet to come out. It is yet to be seen whether these people continue or the new government removes them from the posts. It is undisputed fact that the Congress by appointing its people on key posts prior to leaving the office tried to ensure that it remains updated with what is going in the government. 10 Janpath confidant Sam Pitroda has already been shown the doors, but when the Congress leaders who were made Governors just to avoid their arrest in corruption cases, will be removed is yet to be seen. -Pramod Kumar
