    Power board's PIO adjudged best by SIC

    As reported at timesofindia.indiatimes.com on 11 November 2009 PATNA: Bihar State Electricity Board (BSEB)'s public information officer (PIO) Arun Kumar Sinha has been adjudged Bihar's best PIO by the State Information Commission (SIC). Sinha will receive Rs 20,000 and a citation as award from chief minister Nitish Kumar at a function scheduled for November 12. SIC has instituted the award with a view to encouraging those PIOs who have performed well in delivering information to information seekers, Bihar chief information commissioner A K Choudhary told TOI on Tuesday. Three other PIOs __ Jaya Laxmi Shivam of Muzaffarpur district magistrate's office, Phooleshwar Paswan of cabinet secretariat and Dr Sudhanshu Singh of Patna Medical College __ have been selected for the second prize of Rs 10,000 each. B P Singh of Patna High court, Bhola Chourasia of Lalit Narayan Mithila University, Chandrabhushan Pathak of Bihar legislative assembly secretariat, Dinesh Choudhary of commercial taxes department and ex-Gaya SP M R Nayak have been selected for the third prize of Rs 5,000 each. "The winners were selected by a special committee on the basis of fixed parameters," Choudhary said and added that he would urge the state and Centre to provide funds for instituting a similar award for the citizens who are making the right use of the Act and showing path to others. SIC has also decided to award the school and college students who took part in the essay and painting competitions organized by the commission as part of its efforts to spread awareness about the Right to Information (RTI) Act.     SIC to award info officers

    As reported by Sanjeev Kumar Verma at timesofindia.indiatimes.com on 30 October 2009 PATNA: Otherwise known for imposing fine on public information officers (PIOs) for their failure to part with information sought under the Right To Information (RTI) Act, the state information commission (SIC) has now decided to award the PIOs sincerely performing their duty. At the first such award ceremony, scheduled to be held next month, as many as nine PIOs would be given prizes by chief minister Nitish Kumar. While one PIO would get the first prize of Rs 20,000, three PIOs have been selected for the second prize of Rs 10,000 each and five PIOs for the third prize of Rs 5,000 each. They would also get a citation each. Prizes would also be distributed among winners of the essay and painting competitions which were organised recently by the SIC in schools and colleges as part of its efforts to generate awareness about the RTI. "Ours is the first SIC to have launched an award scheme for PIOs in the country," chief information commissioner (CIC) A K Choudhary told TOI on Thursday. He, however, did not name the winners, pleading they would be made public at an opportune time. Choudhary said the idea is to encourage the PIOs to perform their duty properly and deliver correct information to applicants promptly. He said the commission is also working on a roadmap to achieve the target of becoming the best performing SIC in the country. "Things like introduction of an interactive website and launch of video-conferencing facility would help us get to the top," he added. Choudhary said the website, likely to become functional in three to four months, would help information seekers get prior information about the status of their applications.     24000 cases, only 2 info commissioners

    As reported by Faizan Ahmad at timesofindia.indiatimes.com 21 September 2009 PATNA: The petitions are piling up in the office of the State Information Commission (SIC) here. Reason: there are only two information commissioners (ICs) to take up the cases. The post of chief information commissioners (CIC) have been lying vacant for almost a year. The Patna High Court directed state government more than once to appoint the CIC and fill the vacant posts of ICs. Earlier, the state government had informed the court that it has appointed retired Chief Justice of Patna High Court J N Bhatt as CIC. But early this week when a PIL was taken up for hearing by the court, advocate general P K Shahi stated thatr Justice Bhatt had been appointed as CIC but now he has expressed his inability to accept the post. The office of CIC has been lying vacant after the retirement of Justice Shashank Shekhar Singh in September last year. Since then only two information commissioners P N Narayanan and Shakil Ahmad, both retired bureaucrats, are in the office. Bihar Right to Information Manch convenor Parveen Amanullah said the government kept the court in the dark about Justice Bhatt for several months though he had declined the offer long back. She said Bihar never had more than three information commissioners. "The government is not serious and does not intend to provide correct information to seekers hence it is not appointing information commissioners," she alleged. About 24,000 cases have been filed with the SIC and over 14,000 are still pending. The situation is quite ironic. Bihar was once regarded as a model for implementing RTI Act and introducing "Jankari" call centre for the benefit of the people seeking information. It also received gold award from the Union ministry of personnel for the Jankari call centre under which people can seek information. Jankari, a brainchild of chief minister Nitish Kumar, aimed to enable people living in remotest corners of the state to submit applications for information under RTI by dialling 155311. The operator receiving the call would draft the application under the RTI Act and send the same to the authorities concerned for providing the requisite information. The applicant is provided with a reference number of the application by the call centre. And in case the information is not provided by the authorities, the applicant is entitled to file the first appeal to the appellate authority and later the second appeal to the State Information Commission. But Shiv Prakash Rai, an RTI activist, said the Jankari was not a successful experiment. "The applicants who phone say something and the operator notes something else. Also, the applicants are not provided any Jankari by the call centre, who charge for the calls," he said and added people are least interested in that mode of filing cases. As reported at timesofindia.indiatimes.com on 19 August 2009 PATNA: The State Information Commission (SIC) on Tuesday directed Madhubani district magistrate (DM) to take disciplinary action against district additional collector for not depositing the fine amount and not providing information to an applicant as directed by the commission earlier. The SIC also directed the DM to deduct the fine amount from the salary of erring official and inform the commission about it when the case would be taken on the next date of hearing on October 6. The erring additional collector had failed to provide relevant information to one Vishnudeo Bhandari who had sought certain information using the Right to Information (RTI) Act. Finding the additional collector on the wrong side of the Act, the SIC had imposed fine on him. In a separate case, the commission imposed fine on the water resource department chief engineer, Samastipur, for not providing information to one Girjananda Choudhary, the applicant. The chief engineer would have to cough up fine at the rate of Rs 250 per day with Rs 25,000 being the fine upper limit. The case would be taken up for next hearing on October 1.     HC notice to ex-CJ on CIC post vacancy

    As reported at timesofindia.indiatimes.com on 18 August 2009 PATNA: The Patna High Court on Monday issued a notice to the former Chief Justice of the Patna High Court, Justice J N Bhat, asking him to state whether or not he would take charge as the Chief Information Commissioner of the State Information Commission (SIC). A division bench comprising Chief Justice P K Misra and Justice Shivakirti Singh issued the notice while hearing a PIL of Vikash Chandra alias Guddu Baba. Advocate general P K Shahi submitted that Justice Bhat was appointed by the state government on October 8, 2008 as the CIC after he had given his consent for it. The PIL has sought immediate appointment of the CIC as the post has been lying vacant for more over ten months. The petitioner pleaded that the presence of the CIC at the SIC is necessary for expediting hearing of the cases related to Right to Information Act. The court asked the advocate general to furnish the address of Justice Bhat to the petitioner for the issuance of notice to him.     BDO fined under RTI Act

    As reported at timesofindia.indiatimes.com on 18 August, 2009 PATNA: The State Information Commissioner (SIC) on Monday slapped fine on public information officer-cum-block development officer (BDO), Danapur, for not supplying information to one Bakhora Choudhary under RTI Act between March 11 to August 3, 2009. As per an official press release issued here, the SIC slapped fine to the tune of Rs 25,000 for not providing information on time to Choudhary. The SIC also directed the BDO to provide all information to the applicant by November 24. It may be mentioned here that fine was imposed on the BDO for transferring the application of the applicant to another officer in a wrong way. The next date of hearing has been fixed on December 1, 2009. In a separate case, the SIC on Monday directed the chief engineer, NH, road construction department, Patna, to collect fine from executive engineer, NH division, Darbhanga, Veer Bahadur Singh on whom fine was slapped earlier. As per an official press release issued here, the SIC has directed the official concerned to provide information to the applicant Umadhar Singh. But he failed to follow the directive, the release stated. The SIC also directed during hearing to realise fine from Veer Bahadur in five instalments.     Officials fined under RTI Act

    As reported at timesofindia.indiatimes.com on 30 July 2009 PATNA: The State Information Commission (SIC) on Wednesday imposed fine on two government officials for violation of Right to Information (RTI) Act. Those found on the wrong side of the Act are the block development officer (BDO) of Maner block in Patna district and the public information officer (PIO) of Barh sub-divisional hospital. Both the officials failed to provide relevant information to the applicants who had sought certain information under the RTI Act. The BDO and the PIO would have to cough up Rs 25,000 each as the fine amount. The SIC directed the erring PIO to provide relevant information to the applicant latest by October 19 and fixed October 26 as the next date of hearing of the case.     Two govt officials fined under RTI Act

    As reported at timesofindia.indiatimes.com on 26 March 2009 PATNA: The State Information Commission (SIC) on Wednesday imposed fine on two government officials for violation of Right to Information (RTI) Act. Those found on the wrong side of the Act are an executive engineer of electricity supply division in Saharsa district and secretary of Vishunpur Panchayat in Madhubani district. Both these officials failed to respond to the applications filed seeking information under RTI Act. In both these cases, the SIC imposed a fine at the rate of Rs 250 per day with upper limit of fine being Rs 25,000. The SIC also directed the erring officials to provide information to the applicants by May 11 and fixed May 18 as the next date of hearing of the cases. As reported by Shweta Singh at jaibihar.com on 11 February 2009 PATNA : The Public Information Officer (PIO) of the Bihar Director General of Police (DGP) office has been slapped a fine of Rs 25,000 for not providing proper information to a retired IAS officer. State Information Commissioner (SIC) P N Narayanan slapped the fine on public information officer of the DGP office on Tuesday after he failed to supply required information to retired IAS officer Gangadhar Jha, Commission sources said on Wednesday. The Commission has directed the PIO to submit complete information to Jha by April 30, and fixed May 5 as the next date of hearing of the case. In yet another hearing, the Commission also levied a fine of Rs 25,000 on Samastipur district mass education officer for violation of Right to Information Act. The Commission, besides, slapping the fine also recommended departmental proceedings against the education officer for not providing relevant information to one Sunita Kumari.     Panchayat secretary fined under RTI Act

    As reported at Times of India, Patne on 18 February, 2009 PATNA: State Information Commissioner (SIC) P N Narayanan slapped a penalty of Rs 25,000 on panchayat secretary Raj Hakam (Gopalganj) under Right to Information Act (RTI). The SIC found the panchayat secretary guilty of refusing to supply the information sought by one Bharat Ram and of not replying to an explanation sought by the SIC in this regard. The panchayat secretary has been directed to deposit the penalty amount in five equal instalments in the government treasury. The SIC has also directed panchayat secretary to supply required information to Ram and to apprise the SIC of the compliance of the order by April 22. In yet another complaint under the RTI Act, Narayanan has slapped a fine of Rs 25,000 on PIO-cum-assistant registrar, co-operatives, Hajipur (Vaishali). The SIC has found him guilty of denying information sought by one Kamaldeo Prasad Singh under RTI Act and his not replying to an explanation sought by the SIC in this regard.     Official fined under RTI Act

    As reported at timesofindia.indiatimes.com on 12 February, 2009 PATNA: The State Information Commission on Wednesday slapped a fine of Rs 25,000 on public information officer-cum-deputy collector, establishment, Bhojpur, for violation of Right to Information (RTI), Act. The erring official failed to provide relevant information to one Vipul Kunwar who had sought certain information from him under RTI. Information commissioner P N Narayanan also directed the Bhojpur district magistrate to ensure the fine amount is deposited. The commission would take up the matter for next hearing on April 21. Meanwhile, Narayanan has also issued directives for ensuring fine amounts are deposited in cases which were taken up for hearing in his court.
