  1. Once the RTI application is filed the records available with CPIO/respondent authority, cannot be destroyed as per the retention and removal schedule.- CIC CIC recorded that the PIO of Department of Posts without application of mind denied the information on points under section 8 (1) (h) of the RTI Act. The appellant had sought the copy of all cameras (CCTV) video recording of head post office Bhavnagar. Since video recording is covered under information as per Section 2(f) of the RTI Act. If the CCTV footage is held by the respondent authority, it is his duty to share it, except when the denial is justified under any provisions of exemptions mentioned in Section 8 of the RTI Act. Once the RTI application is filed the records available with CPIO/respondent authority, cannot be destroyed as per the retention and removal schedule. In this case, the CPIO denied the information under Section 8(1)(h) of the RTI Act, which means they have the CCTV footage with them. Therefore, commission recorded that the respondent authority is directed to provide CD with required CCTV footage and the information sought by the appellant.
  2. Can I ask information of salary, post held, duty hours, CCTV footage etc. of a govt. Employee. Is this information fall in the category of 3rd party info. Is there any chances of denial of information and under which rule of rti they can deny it. If above info is denied then under which rule I can challenge it.

Hello, I was molested in public view by group of 6 people in which 2 boys and 3 girls involved in year 2015 .Police did not even investigated or reg FIR for 16months and after i brought my story on social media FIR was reg under 354 sec and others. bt as it got very delay in registering the FIR and the molesters bribe the police police have not arrested 4 accused 3 girls and one man. They stalked me they where also present in police station Rabale. I want to know how could i get the cctv footage of roads and police station of 2015. even if they say they dont have data but sunanda pushkar's murder we saw her cctv footage and phone call was found after 3 yrs. Plz guide me and plz give me sample format how to write letter to road ministers or police station and where to send it also how many time period I would be getting that. or is that the application/letter to be given to court of getting footage? Thanks

    Sir, Inresponse to RTI application seeking CCTV footage at Tehsildar's office,PIO has stated that CCTV footage contains images and data of third party people present at Taluk Office.Above all he has stated that Information Technology Act has prohibited the sharing of CCTV footage
  6. I lost my wallet at Bank of Baroda ATM. I filled the lost form at suvidha center, but police is not ready to file the FIR. What can be done to see the CCTV footage of ATM to find out who picked up the wallet after I forgot it in the ATM as it has my newly made drivers licence and my Pan card. It also had a big amount of 11k.
  7. I witnessed SHO of Police Station calling my friend regarding a civil dispute. First SHO is not suppose to conduct Kangaroo courts in PS as per the Govt order.SHO again cannot call parties to PS wherein already a case is under trial in court.Further,SHO abused and threatened my friend and asked him to settle the dispute in PS.An office staff working at SSP office influenced the SHO to conduct Kangaroo court and settle the dispute in his favour.The office staff sat at PS along with SHO and threatened us to settle the dispute.We immediately filed an oral complaint with the superiors and recorded the same. All these has happened without the knowledge of SSP who happens to be the FAA I filed an RTI the very next day seeking CCTV footage for all the installations for the day on which the issue occurred. SHO has replied that " CCTV was installed in PS for transparency in operation of PS and its staff,to make the police more responsible,to eradicate corruption and to protect the Government secrets held at PS.Henceforth, at any cost I will not provide CCTV Footage" No sections quoted, They have installed 4 camera's out of which one is an outdoor camera at the entrance. The PIO received the above stated reply from SHO and forwarded it to me. CCTV footage will clearly indicate that office staff of SSP and SHO conducting kangaroo courts.They deliberately denied the footage. Looking for help on grounds of appeal.
