  1. Hello, How can i prevent the mobile phone number and Gas connection from getting deactivated for my elderly ailing parents who are residing with me abroad. I face a real problem running pillar to post to get everything reconnected when i have to take them to India for a month or two for medical stay. They are so old that they cannot be left alone on their own. the family will eventually move to the ancestral home. Also the BSNL Bills online payment does not get through from Oman. your advise will be very valuable. with kind regards,
  2. Dear Experts, I have been noticing since my childhood that government communication to citizens are not addressed with respect. The citizen is never addressed as Sir or Madam (as the case may be) but expect us to address the officials that way in our communication. We do it as it is matter of courtesy but why not public servants because they are our servants they should atleast communicate with courtesy. I intend to write to President/Prime Minister of India And of course to Governor/Chief Minister of Haryana seeking directions to all civil servants to address citizens as Sir/madam in all communications of the Government to Citizens. Kindly help the undersigned with whatever knowledge input you have. As far as I am concerned I find it bizarre that official communication to me as if I am their subject. SIC no to making service books of 164 officers public The Madhya Pradesh State Information Commission has quashed the order of first appellate officer in which it was directed topublic information officer to provide free of charge information of service books of 164 officers and employees. Generally, the citizens make second (final) appeal to the Commission against appellate officer and public information officer. In a rare case, a public information officer lodges second appeal against the appellate officer.The Commission in its hearing by its commissioner Atmadeep accepted the appeal and rejected the order of the first appellate officer. The rejection of the order will lead to a stop on making personal information public of more than 150 officers and employees along with principal of Govt.   4. Mumbai : In a landmark order, the Central Information Commission has ruled that CCTV footage of a public place is in the public domain and cannot be denied to a citizen. The case pertains to Mumbai-based RTI activist Chetan Kothari, who wanted the CCTV footage of the incident when a UCO bank cashier at Bhulabhai Desai Road misbehaved him. “The man ahead of me in the queue got Rs 1,000 in the denomination of Rs ten but when I asked for it, the cashier, Ganpat Dongera, was rude to me,’’ said Kothari. The incident happened on November 3, 2012. Unsatisfied with the action taken by the bank — merely instructing the employee concerned to be polite — Kothari asked for the service record of Dongera as well as the CCTV record of the incident.   5. NEW DELHI: Delhi Sikh Gurdwara Management Committee has written to lieutenant governor Najeeb Jung asking him to exempt Sikh women from wearing helmets. To claim the exemption, they cited an RTI reply from Delhi Police as proof showing that no Sikh woman had died in a motorbike accident last year. Avtar Singh Sethi, president of Delhi Sikh Citizen's Council said that he had filed the RTI to the office of special commissioner (traffic), Taj Hassan. Traffic cops then asked them toapproach the district police who replied that no data of a Sikh woman being killed in a fatal accident was received by them. The groups also wrote to the LG asking him to exempt Sikh women from wearing helmets since it would be hurting their religious sentiments.     How RTI can help us........

    True that RTI has helped in getting information about passport status etc. But it shouldn't be limited to that. RTI can help not only an individual, but the entire society. For eg: The Adarsh scam was exposed due to RTI We have to make use of this act to find out the effectiveness of various governmental organisations such as government schools, hospitals etc.If the funtioning is found to be faulty, it should be made public through media for press is probably the most effective change-bringer. Though we are a democracy, what is quite sad is that once the elections are over, politicians don't bother to pay attention to our views.The decision our representive takes might not be what the majority of the people in her/his constituency wants.But do we, as citizens, fight against this, Most probably not because most of us dont have the time to and even don't know how to. So, to keep a watch on these politicos and their ever-growing appetite for our money,RTI is the right vehicle. Just the fact that we have such a right won't make any change.We, as proud citizens of this country, have to put it to use.

AS a measure to motivate more citizens to avail of information through the Right to Information Act, the city-based Sajag Nagarik Manch has announced two awards on the occasion of its first anniversary, in the first week of November. “After the establishment of the Manch, we came across many activists and citizens who are active in the field of RTI,” said the Manch president, Vivek Velankar. “Besides the applicants, the awards will also felicitate those government officials who have contributed to the effective implementation of the Act.” The ‘Sajag Nagarik Mahiti Adhikar Award’ will be conferred on that candidate who has used the RTI, generated awareness about it as well as brought about some social awakening through the Act. Similarly, the ‘Sajag Nagarik Mahiti Adhikar (Mahiti Adhikari) Award’ will be conferred on a government official who has addressed the RTI petition, legally and satisfactorily within the stipulated time period. The award being given to an ordinary citizen, will comprise a memento, a certificate, a shawl and a cash award of Rs 11,000. “Awarding a cash prize to government officials will be inappropriate and come under scrutiny, hence they will be felicitated without it,” said Velankar. Abhyankar stressed that rather than the prospective candidates describing their ‘achievements,’ the citizens who know of such people should contact the Manch describing the candidate’s work. An expert committee will also be set up to screen and evaluate the candidates’ accomplishments and emerge with the winners. “The second anniversary of the RTI Act was recently celebrated and its undisputed that the Act has proven to be a powerful tool of democracy aimed at bringing accountability and transparency in governance. These awards will not just reinforce the performance of the award winners but will also set an example for the others to follow,” said the Manch’s convener, Jugal Rathi. On PMC terrain, one urinal for 9,000 citizens Pune, December 11 For a city witnessing a realty boom in all corners, shockingly, the basic amenities like public urinals and toilets are woefully inadequate. Health norms say there should be at least one public urinal per hundred people. In reality the number is one public urinal for every 9,000 people. What is even more shocking is that there is absolutely no public urinal for women and disabled people in the city. These facts came to light in response to a Right to Information Act (RTI) application filed by activist Vijay Kumbhar. “Despite the health norms being in place, PMC is clearly apathetic towards providing basic health amenities like public urinals. The norms say that there should be one public urinal every 100 people. However, there are only 352 urinals in Pune, which has crossed a population of 30 lakh.” He said the situation was still worse as there were no public urinals for women and the disabled. Kumbhar said on several major roads in the city, no public urinals could be found at long stretches. “On many major roads in the city, like Sinhgad Road and Bajirao Road, only one urinal could be found for kilometers. For example, no urinal exists between the stretch of Wakdewadi and Deccan Gymkhana bus stand. The same is true in case of University chowk to Aundh or Baner.” In Pune, there are 772 pay-and-use public toilets with 11,319 seats, out of which, 5,731 are for men and 5,588 for women. “Most of these pay-and-use are for slum-dwellers and not on the public roads for general public. So in this case, if someone relieves himself in open space, PMC’s nuisance detection squad might fine that person for dirtying the city. When there is lack of public sanitation facilities, the civic administration should not be charging fine from poor people.” Kumbhar said that he would soon be serving a notice to the PMC in this regard.   9. Any news on priority given to senior citizens by CIC ? CIC ASKS SECOND APPEALS IN BOTH CATEGORIES TO BE GIVEN PREFERENCE Pune, June 01: Second appeals filed by senior citizens and differently abled persons under the Right to Information Act (RTI) will now be taken on a high priority basis, according to a directive of the Central Information Commission (CIC) in response to a petition by city-based activist Vihar Durve. The commission issued the instruction on June 19, after an email by Durve to the Chief Information Commissioner Wajahat Habibullah on June 17. “The issue was discussed and agreed upon ahead of the agendas for that day. However, I had also made an appeal to consider people below poverty line which was not looked into,” said Durve. RTI petitions are first filed with the public information officer and then the first appeal is filed with the first appellate authority; the time limit in case of the reply for both the petition as well as appeal being 30 days. If the petitioner is unsatisfied with this reply, the next resort is a second appeal with the CIC or the SCIC. Durve said that the CIC which used to take four to six months to hear Central Government related second appeals and more than one and a half years to hear State related second appeals will now be giving priority to the cases in the two categories. “The demand was to fix a time limit of 30 days for the second appeal too, but the CIC has not committed to this. There are more than 2,000 second appeals pending before the city information commissioner. At least now it becomes mandatory for the State information commissions to give high priority to senior citizens and differently abled persons,” he said. Durve had sent the email on the basis of a 1996 High court circular, which said, “precedence would be given by courts for hearing and final disposal of cases wherein one of the parties is of advanced age who has crossed 70 years of age.” However, Durve said that the petitioners should send their age proof and differently abled medical certificate along with the RTI application. “For, senior citizens and physically challenged if appeals are already pending with the CIC/SCIC, they should write to the CIC/ SCIC about their status,” he said.     Gayathri Nivas The RTI Act is potentially a powerful tool in the hands of the public but only if the latter chooses to use it. *Was Sanjay Dutt granted permission to smoke in jail? *How many encroached government plots have actually been slated for re-auction because they did not fetch a good price the first time round? *Who is answerable to the fact that there are few or no fire-extinguishers at important public places like railway stations? You can have answers to these and more intriguing questions, thanks to the Right to Information (RTI) Act, hailed as probably the most significant legislation enacted since Independence, allowing the common man to seek – and receive within 30 days – information on most aspects of government functioning. The RTI Act is potentially a powerful tool in the hands of the public but only if the latter chooses to use it. The RTI Act, enacted by Parliament in 2005, extends to the whole of India except the State of Jammu and Kashmir. It provides for the creation of a Central Information Commission (CIC) and Information Commissions (ICs) in the states. The CIC is headed by a Central Chief Information Commissioner (CCIC) and the state ICs by Chief Information Commissioners (CICs). In addition, up to ten Information Commissioners may be appointed for the Central and State Commissions. Karnataka Information Commission (KIC), almost two-year-old, has had an action-filled but unarresting run as people generally seek information to redress personal grievances such as an encroaching neighbour (violating building plan) or about a civic problem. Former Chief Secretary K K Misra, whose comment that he is busier now as CIC than before, is an indication that people are, indeed, using the RTI tool, though not very effectively. He believes that the RTI Act medium is just as powerful as the public interest litigation and should be invoked to serve larger public interest. The KIC acts as a second appellate authority and may be approached when the information officer and first appellate authority of a Public Authority (PA) fail to satisfy an applicant. A PA is any body constituted under the Constitution or law of Parliament/legislature and receiving substantial public finance. The KIC hears the two parties and disposes of the case in one or two sittings. The backlog is kept low in order to win the confidence of the people, says Misra. Penalty may be levied on a PIO for refusing or delaying the requisite information. Cost and compensation is also ordered to be paid to the applicant (calculated on the basis of 'avoidable expenditure' to the applicant) if a respondent (PIO or PA) seeks an adjournment. While the penalty and cost have to be paid by the PIO from his pocket, compensation is payable by the PA. Penalty ranging from Rs 500 to Rs 10,000 (at Rs 250 a day and up to a maximum of Rs 25,000) has been levied in about 40 cases so far, and payment of cost and compensation ordered in about 20 cases. The compensation amount varied from Rs 200 to Rs 4000, reveals K A Thippeswamy, State Information Commissioner. KIC is no redressal mechanism. However, merely seeking information puts a public authority on alert and that is half the job done, believes Thippeswamy. The Commission has asked the various public utilities such as BBMP to standardise procedures like Khata transfer and publish it so that people have ready access to them. Preventive Vigilance is another proposal. Under this, NGOs and special interest groups such as Public Affairs Committee will be asked to prepare Citizens’ Charters to be made a part of the disclosures under RTI. South Africa model better The South African Constitution guarantees the right to information wherever it is needed to fulfill another constitutional right, and its RTI Act applies to both public and private institutions. It also has a "whistle blower protection" to protect citizens from harassment. Bone of contention Should personal information such as medical records and Income Tax assessment details be divulged? This remains a bone of contention between KIC and Central Information Commission. While KIC is against disclosing personal information, the Central Commission contention is that no information should be denied as ‘personal’. To illustrate, K K Misra, KCIC, cites the example of a dowry harassment victim, who approached the police helpline - Vanitha Sahaya Vani. After she recorded her statement, her in-laws applied for details of her statement, which was denied as it could jeopardise her case. The alibi for denial - the helpline “does not receive substantial public finance and does not constitute a Public Authority”. Missing CA sites! In Byatarayanapura City Municipal Council limits, the CMC and Canara Bank Employees House Building Cooperative Society together formed sites on land transferred by the Bangalore Development Authority (BDA) for parks. The sites were “allotted” to private persons. A complaint was filed before the KIC, which sought details from the CMC. The CMC denied any sites transfer from BDA. When BDA confirmed the transfer, the CMC owned up the fraudulent transaction and its Commissioner was slapped a fine of Rs 5,000. It empowers the ordinary citizen who has hither-to been armed with only his vote, with the tools of information that propel government decisions. Thanks to the legislation, citizens can seek -- and get within 30 days - information on how the government arrived at decisions, be it about his ration card application or the money spent on lighting a bridge outside his home. Shailesh Gandhi, convenor of the National Campaign for People's Right to Information, answered questions put forth by rediff.com readers on the Right to Information Act.   12. I believe the RTI act will bring citizens closer to democracy. For me an application as such doesnot matter much, nor for many of us. What RTI application in true sense matters is that we tell to Government that we are watching and that it is for us the Government is working for. Thus by this way, RTI will make citizens like me to participate in Government and decision making process. May be in transition phase, people will go on asking personal question and distroying the correct thing for what RTI is meant for, and in medium term it will slow down the decision making process of the Government bodies because once RTI roles out, it will generate much fear in Officers taking decisions. But in long run, it will bring about correct decision making co-terminous with citizens aspiration and thus will bring empowered citizens closer to democracy.
