[h=1]City bar council slaps notice on Tomar, to probe forgery claims[/h] Spelling more trouble for Delhi law minister Jitender Singh Tomar, the Bar Council of Delhi (BCD) has issued notice to him on a complaint alleging that he used forged and fabricated documents to enroll himself as an advocate. Honorary secretary Puneet Mittal said the council was holding an independent inquiry due to the seriousness of the allegation. The council has asked Tomar to come up with an explanation by March 20. The Delhi High Court had on Friday decided to scrutinise the authenticity of Tomar’s law degree even as the petitioner in the case sought to withdraw his petition that had made similar allegations. Mittal said that the BCD initiated the inquiry after it received a complaint from advocate Ripudaman Singh Bhardwaj against the Aam Aadmi Party (AAP) leader seeking cancellation of his registration and initiation of criminal proceedings. He said the complaint was filed after an RTI query to Dr Ram Manohar Lahia Avadh University, where Tomar had claimed to have obtained an undergraduate degree in science, revealed that it did not have any records of granting any degree to him. The RTI reply, a copy of which is with HT, clearly says that Tomar’s degree, marksheet, and roll number are “completely fake”. “The Bar is of the view that the allegations are prima facie serious. If Tomar fails to give plausible explanation on the issue, we might also register an FIR. However, future course of action will be taken after his appearance,” Mittal said. The complaint received by the Bar said Tomar did not submit his provisional LLB degree nor his attendance certificate while enrolling as an advocate. It said non-submission of requisite documents “show that essential norms as framed by Bar Council of India (BCI) for enrollment purpose have not been complied with”. If the allegations are found to be correct, Tomar will not only lose his licence to practice as an advocate but will also face charges of forgery. If the degrees and certificates turn out to be fake and if Tomar had submitted the same set of documents with the Election Commission while filing his candidature he may lose his seat too. In 2013, the Delhi High Court had said that a false affidavit by a candidate at the time of filing of nomination papers is a ground for setting aside his/her election. On SEZ land, a global smart city NEW DELHI: About 800 acres of the total land the Haryana government got back from Reliance Haryana SEZ Limited (RHSL) in February last year will be developed as a global city having all the attributes of a smart city as the Narendra Modi government has envisioned. "The city shall be one of its kind in India. It will be designed by integrating smart community concepts ranging from water supply and power to integration of IT services in managing various utilities of the area. The project components would include festive and leisure (components), including an exhibition and convention centre, high value innovation and knowledge industries, central business district and township etc," says the concept note on the global city. The project will be developed by a special entity through a 50:50 partnership between the Haryana State Industrial & Infrastructure Development Corporation (HSIIDC) and Delhi Mumbai Industrial Corridor Development Corporation (DMICDC). While the state finance minister said on Tuesday his government would investigate how the previous Bhupinder Singh Hooda government did not invite bids for the scrapped SEZ project, the new government seems to be keen on the global city project in the outskirts of Gurgaon. In response to an RTI application filed by a Gurgaon-based activist, Aseem Takyar, the HSIIDC said DMICDC has appointed a consultant for preparing the master plan for the global city project. Sources in DMICDC said the state agency is working on the site boundary. According to the RTI reply, the board of directors of HSIIDC had approved the setting up of a joint venture in its meeting on March 14, 2014. "Work is going on and the project may be rolled out by the end of this year," a government source said. The concept note also mentioned that any excess land would be reserved for an exclusive township of HSIIDC and its "monetization to compensate for the opportunity cost of the land". Cosmos City project sale illegal, says DTCP GURGAON: After TOI reported that around 400 investors were allegedly duped by a developer in a multi-crore housing scam in Sector 103, a government probe has revealed that Adel Landmarks violated norms by selling off the Cosmos City project on Dwarka Expressway to another developer after taking 25% of the cost for each flat. The report by the department of town and country planning (DTCP) has recommended strict action, including filing of FIRs, against Adel Landmarks for selling off its subsidiary company, Identity Buildtech Limited, which was developing the Cosmos City project, to another builder - Ansal Housing and Construction Limited - without the department's knowledge and allegedly cheating 432 investors. The report, prepared by the then senior town planner Kamal Kumar has come to the fore, thanks to a response to an RTI query by one of the investors, K K Khurana. According to the probe report, Adel Landmarks Limited sold off Identity Buildtech Limited, along with all its assets, by entering into a share purchase agreement with Ansal Housing and Construction Limited. The whole process - which amounts to transfer of license - had taken place without the knowledge of DTCP, the licensing authority. In fact, the probe was ordered by the then principal secretary of town and country planning, TC Gupta, after TOI had exposed the scam in July last year and reported that a project by the second builder was coming up on that land. The then senior town planner, Kamal Kumar, carried out the inquiry. Kumar has recommended action against the developer for breach of terms and conditions of license. "DTP (enforcement), Gurgaon, has sent a complaint to the commissioner of police, Gurgaon, for lodging an FIR against the offenders," he said in the reports. When contacted, the additional chief secretary to DTCP, P Raghvendra Rao, told TOI, "After the case came to light, the department had even initiated action against the developer and a show-cause notice as to why the builder's licence should not be cancelled was issued to the builder." He added, "During a hearing, Adel's representatives had said that the claims of all investors would be settled by refund of their money along with interest. Another notice was issued on January 22 this year. The report is being compiled and further action will be taken after the compilation of the report." A spokesperson for Adel Landmarks said, "We have already replied to the notice issued by the DTCP on February 6 and apprised him of the progress of the refunds to investors.   6. "This is sheer waste of taxpayer money and a waste of time. It looks like lack of planning and improper implementation of the project. After all, time is money," Sachin Chavan, who had filed an RTI application for information on the flyover delay, said. Chavan, who alleged that there was something fishy about the delay and its cost jump, has written to chief minister Devendra Fadnavis, demanding a probe.   7. Residents say that in order to buy a Re 1 stamp they have to shell out much more money just to reach the mini secretariat. "It is mandated by law to affix a revenue stamp for every cash transaction that is over Rs 5,000. There are about 36 post offices in Gurgaon but none of them sell revenue stamp which causes lot of inconvenience to the general public as they have to travel a long distance to get the stamp," said Aseem Takyar, who filed a Right To Information application on the issue. He said the issue could be resolved if the state government wanted to. "All it needs to do is agree to pay the commission sought by the postal department like every other state in the country that has agreed to do so," Takyar said. "I filed the RTI in the postal department in Delhi and they in turn forwarded it to several postal offices in the country. Recently, I received over 500 replies from different post offices and all of them maintained that they received 10% commission from their respective state government for every revenue stamp sold," he said.   8. As much as Rs 140,13,72,440 (140.13 crore) has been lost to house break-ins and other theft cases in the past three years with the police unable to recover the booty. This was revealed at an RTI query exercised by The Asian Age. What’s worrying is that the city police’s recovery rate in burglaries remains the same, a dismal 15 per cent for 2013 and 2014. Also, burglary cases have marginally shot up from 2,925 cases in 2013 to 3,055 cases in 2014. The detection rate has marginally increased from 37.50 per cent in 2013 to 38.13 per cent in 2014.   9. Hi, This is first time i am trying to raise RTI. I stay in Wakad, Pune. My apartment is on the road, Pink City Road, for which i want to raise RTI. This road was really in a bad condition. PCMC worked on that and made it good somewhere around 1 Jan 2015. Recently (around 15 Jan 2015) some contractor marked that road for digging at 2 places. Out of those one place he has already dug and messed up the road. Soon he will be dig another one. I want to know if he is doing it legally. I believe he is doing illegally. If it is legal then the next question is why did he do that after the road is made proper. he could have done it in Dec 2014. It would have kept the road in proper condition. Please help. Diesel price in city should be just Rs 13.35, not Rs 52.50 HC sends notices to Centre and oil majors over pricing of petroleum products A writ petition in Karnataka high court has argued in favour of a sharp drop in retail price of diesel, petrol and LPG to benefit the common man. It argues that the cost for such a drop in retail prices could be easily covered by the humongous sale of 166 by-products of crude oil, and has gone on to say that the actual retail price of diesel in Bengaluru comes to Rs 13.35 per litre. Acting on the petition, the high court issued notices to the Union government and its oil marketing companies and agencies. The Public Interest litigation (PIL) questions the unreasonable profits made by the government from sale of petroleum products. The petition by NP Amrutesh, presented before the court by senior advocate SP Shankar, says the actual cost of diesel in Bengaluru would be Rs 13.35, including the cost of importing crude, refining it and transporting the product diesel to the city. However the government has not revealed similar prices for other products like petrol, kerosene and LPG. The petition, says, "Under RTI Act, specific information is obtained in regard to the actual cost of acquisition, cost of cracking, blending and refining as well as cost of transportation from the refineries to the outlets and that the comprehensive cost of 1 litre of diesel at Bangalore is Rs 13.35 paise. Respondents have not furnished the cost of petrol and kerosene in like terms." Besides the Union government, the high court issued notices to Indian Oil Corporation (IOC), Hindustan Petroleum (HP), Bharat Petroleum (BP) and oil & Natural Gas Commission (ONGC). The petition alleged that the government was making profits by selling petroleum products like petrol, diesel, kerosene and LPG at a much higher retail price than what they should actually have. People are the losers The petition says the government and oil companies are hiding facts about the actual profits. Around 166 by-products are produced from crude petroleum and all of them are sold. The petition says, "When crude is cracked, refined and blended the products that are generated are 166 in number. The number of by-products has now reached 183. Some of these by-products are used as base material in manufacturing of aspirin and brufane. Entire gamut of base for cosmetics is built on petroleum by-products. Automobile and chemicals and fertiliser industries have roots in petroleum products like naphtha. So the government is never a loser in the matter of refining crude and (is) recovering the entire cost from sale of at least 166 by-products. The GOI through its petroleum ministry has a legal duty to make these aspects transparent and to be accountable to the people." The petition says that instead of making profit out of the common man, the government can keep the prices low. It says, "The fact that sale of 26 by-products meant for industrial use will alone take care of the entire cost of acquisition of crude, its transportation to refineries at various places in India, for cracking the crude and refinement would show that there is no loss occasioned to the oil industry. Further, rest of the by-products are in constant demand in the market. Their sale is sufficient to make profit." Welfare state The petition alleges that the Union government was allowing concentration of wealth and material resources in the hands of the oil companies to the detriment and prejudice of the common good. "The interest of the public at large is ignored in de-controlling and de-licensing sale of petroleum products by oil marketing companies. (The oil companies) cannot be treated as a trading wing or a commercial enterprise but only a service instrument of the Union of India. People of India do not exist and strive for promoting the interest of oil marketing PSUs or political bosses," it says. Oil companies exposed The petition cites the Comptroller and Auditor General (CAG) reports and also from the reports of the oil companies to show that the companies never suffered losses. "CAG of India has castigated the State owned fuel retailers namely Indian Oil Corporation Limited (IOCL), Hindustan Petroleum Chemicals Limited and Bharat Petroleum Chemicals Ltd who have overcharged customers from the years 2007-08 to 2011-12 by rupees 26,626 crore, by way of calculating the desired retail price in a manner as if the product was imported by adding customs duty, freight, insurance, ocean loss and wharf-age charges to the prevailing international price of petroleum products," the petition says. "Thus an expenditure never incurred under the headings of L.C Charges, insurance charges, freight, wharfage charges, custom duty and ocean loss, amounting to Rs 50,513/- crores is added to the cost of petroleum products and is passed on to the consumers," it says. The petition seeks a transparent regulatory mechanism in the matter of sale of petroleum products; a simple cost accounting method of arriving at the selling price namely cost plus margin of profit. The petition says "how the 166 by-products are marketed is not disclosed. There is no transparency or accountability in fixing the price." The petition, among other things, has sought pricing of petroleum products be as per Constitutional guidelines of a welfare state. It seeks a transparent manner of pricing the products and a court direction to the Union government to commit oil companies to be non-profit-making units. This can be done by considering petroleum a material resource in which earning profit is forbidden, the petition said.   12. CHENNAI: Most government hospitals in the city have fewer ventilators than sanctioned or necessary. Several ventilators are unused as they've not been maintained, as per data obtained through an RTI application by TOI. In Government Stanley Medical College Hospital, 22 of the 50 ventilators are not working. In Government General Hospital, 19 ventilators are not working. Government Royapettah Hospital and Government Kasturba Gandhi Hospital have only 13 ventilators each. Government Kilpauk Hospital did not reply to the RTI application. A ventilator is a life-saving equipment that helps a patient breathe. A hospital requires ventilators in its intensive care unit (ICU), intensive cardiac care unit (ICCU), TB ward, neonatal ICU and casualty ward. Chennai's government hospitals get about 150 critically ill patients every day, not just from the city but also from districts.
