  1. Nagpur: An RTI reply revealed that these courts are doing what they’re meant for by deciding about 48% of the cases in consumers’ favours in the last two years. About 19% cases went against them during the same period. Consumer forums have been established for ensuring justice to the customers and address their grievances. A reply by public information officer (PIO) of District Consumer Grievances Redressal Forum here revealed that it collected a revenue of over Rs4 lakh and slapped a fine of Rs2.90 lakh on violators from January 1, 2016 to February 28 this year. He, however, didn’t provide any information on a query on pending cases posed by RTI activist Abhay Kolarkar. The forum received about 1,604 cases from January 1, 2016 to February 28 this year. Of them, 799 complaints were received in 2016, of which 395 were settled in favour of the consumers and 143 against them. In 2017, about 617 complaints were instituted, of which 317 were decided in consumers’ favour while 140 went against them. This year till February end, the forum received 188 complaints of which 57 were settled in favour of the complainants and 14 against them

Hi All, NCDRC, in case of REVISION PETITION NO. 4061 OF 2010 (Against the Order dated 14/09/2010 in Appeal No. 1163/2010 of the State Commission Karnataka) Held that: "Petitioner, in order to sort out the controversy with respect to his pensionary benefits, filed an application under Right to Information Act, 2005 (hereinafter referred to as ‘the RTI Act, 2005’) in the office of Opposite party No.4. Opposite party No.4 failed to provide the information. Petitioner then filed the complaint before the District Forum, which was allowed and a direction was issued to opposite party No.4 to furnish the required information. Respondent, being aggrieved, filed an appeal before the State Commission, which has been allowed by observing thus : “At the outset it is not in dispute that complainant had filed an application u/s 6 & 7 of the Right to Information Act to the OP No.4. But complainant cannot be considered as a consumer as defined under the C.P. Act since there is a remedy available for the complainant to approach the appellate authority u/s 19 of the RTI Act, 2005.” We agree with the view taken by the fora below. Petitioner cannot be claimed to be a consumer under the Consumer Protection Act. There is a remedy available for him to approach the Appellate Authority under Section 19 of the RTI Act, 2005. Dismissed. What we can we say now....? I did not find the judgement of Karnataka State Commission in Appeal No. 1163/2010. Not sure why only this appeal judgment is not available along with the judgments. I would say people shall continue to file consumer complaints against the PIO/PA by invoking the section 3, 2(1)(d)(ii) and 2(1)(g) of CP Act. Let the NCDRC finalise the issue. Wish you gud luck. Dear Malhotra Sir, Do you say that the citation mentioned in this post can not be reproduced and no need to believe this Order. Do you advice the RTI applicants to proceed refering earier decisions to relief from CPA. What is the meaning of your post above that say: [bNo, we do not indulge in witch hunt. There is no reason to believe anything that can not be reproduced . [/b] But it was referred in NCDRC while arguments and also the citation reference is part of the NCDRC Order. It does not matter whether the RTI applicant argued in the State Commission or not. In the natural justice point of NCDRC may consider the CP Act and pass orders. Dear Dr.Malhotra Sir, I have sme quiries as below: 1.Which provision of the RTI Act say that it is special Act, similarly which provision of CP Act say that it is general law. 2. If compensation calim is more than Rs.25,000/- then definitely RTI Act alone wont serve the purpose, am I correct. 3.If compensation claim is less than Rs.25,000/- and if the RTI applicant is already got order on second appeal or complaint before the Information Commission, then certainly the complaint before CP Act is not maintainable, am I correct? 4. If complaint under CP Act and also the complaint under RTI Act both are pending for claim more than Rs.25,000/-, then both the Information Commission and Consumer Forum shall hear the case till end to decide the replief, am I correct?
  4. I visited District Consumer Redressal Forum , Delhi So , thought to share Procedure of filing Consumer Complaint step wise step (of Delhi ). 1. Write Application /Petition in any simple format on A4 Paper typed or Hand written but matter should be only on side of the page(No Fixed Format advised ). 2. Then get an Affidavit typed on A4 paper plain paper (NO STAMP Required ) , certified by Notary regarding applicant details. 3. After it , Get Application & Affidavit checked by Consumer Redressal office staff. 4. Then, purchase Rs.100 POSTAL ORDER as Court Fees. Only Postal Orders are accepted at Delhi Consumer Court (Central Delhi). (Total Value Of Goods OR Services & The Compensation Claimed Upto ONE LAKH RUPEES – For Complainants other than Antyodaya Anna Yojna Card Holders Payment of Rs.100) 5. Make 5 Set (photocopy)of Application/Petition & 4 set of Notary Certified Affidavit. 6. From these Keep 1 copy with original affidavit & Postal order in a File cover . 7. Present all 5 sets at MEDIATION CENTRE located in same building , there they will check the application & issue a date(hand to hand) for Mediation hearing (date within a month or little more) & they will keep 2 sets of application with them. Note: Mediation Hearing is Mandatory in District Consumer Redressal Forum , Delhi before proceeding for case. For, Mediation Hearing a Notice is issued to Opposite party & they are called for Mediation with the Applicant. 8. After it ,Submit rest 3 sets in office of District Consumer Redressal Forum( with 1 set along with original affidavit & postal order in a file). 9. District Consumer Redressal Forum office staff will note the date of Mediation Hearing & issue a date of few days/weeks later for admission hearing of case . 10. Appear on the day of Mediation & what ever is the result , applicant have to inform in Consumer Redressal Forum office. Then , they will direct accordingly.
  5. Hi I have filed an RTI application to District Consumer Forum , Sheikh Sarai as anticipated I have not received any reply from the PIO even after 30 days have been passed. I am interested in Filing my first appeal but I am not sure about the Address and Designation of the Appellate Authority to whom I should reach as per the current circumstances.Please let me know the address and designation of the Appellate Authority who deals with PIO Sheikh Sarai , District Consumer redressal Forum , I'll be highly thankful .

Ensure regular water supply: Consumer court to civic body - The Times of India Ensure regular water supply: Consumer court to civic body Saeed Khan,TNN | Dec 11, 2013, 12.34 AM IST AHMEDABAD: A consumer court has asked Surendranagar-Dudhrej municipality, which is located in one of the water scarcity hit areas of Gujarat, to supply clean and potable water to the city on a regular basis. Besides directing the civic body to supply water on fixed timings, the court has also asked it to keep the city clean by keeping roads garbage free, maintaining streetlights and taking care of other basic amenities for which the municipality collects taxes from citizens. The Consumer Dispute Redressal Forum of Surendranagar district reminded the civic body of its responsibilities and directed it not to remain negligent and show "deficiency in its services", for the citizens paying it taxes have rights to complaint. The order came in response to a complaint filed by a retired person, Kalabhai Bharwad. He had sought cleaning of a waterlogged open plot beside his house, but the civic body officials did not work. After cleaning the plot full of contaminated rainwater on two occasions in July this year, he approached the court asserting his right as a consumer. He sought direction to the civic body to keep the area clean. He also demanded for regular supply of water and that too on fixed timings, a practice that is alien to this area. Bharwad sought compensation for the damage caused to his house due to waterlogging in a nearby plot and for the difficulty he faced due to inaction on part of the municipality. The civic body, on the other hand, blamed him of causing waterlogging by discharging water after domestic use and putting up a hand pump in common plot. It also told the consumer court that it cannot rush to solve Bharwad's problem by leaving other jobs aside. The court ascertained whether he paid taxes regularly. Then it concluded that inaction on part of the civic body to redress Bharwad's repeated complaints amounted to deficiency in service. It directed the municipality to reimburse the amount Bharwad had spent over cleaning the plot. Besides, the court asked the municipality to pay Rs 4,000 to Bharwad for litigation cost and harassment caused by officials' negligence. The court observed that since the issues raised by Bharwad are affecting 2.5 lakh city population, the civic body should be asked to supply clean water to the city on regular basis. (Is it possible that our dear friends can take up similar matter with public authorities since every rupee of "tax paid " then would amount to the "benefactor" becoming a "consumer". In fact combining this with the lucknow development authority judgement would also ensure that the officers responsible for derelection of duty may be held accountable and also the "compensation" paid to the victim may be "deducted" from their salaries).   7. hello, can anyone tell me whether the consumer courts will respond for RTI informaaation. or anyother platform to raise concern regarding case pending with consumer court in delhi. i filed a case in March 2010 against TATA regarding manufacturing deffect on TATA SAFARI car i bought and the court keep the dates postpond for the last three years. can i complaint anywhere else?

Just sue govt - Hindustan Times The right to information (RTI) law can be used to sue the government for inadequate service if it can be proved in a consumer court that the delay in providing information caused loss. This was the view of three different consumer courts who awarded compensation to right to information users for delay saying that the applicants were consumers of the government since they paid a fee and furnishing information within 30 days was, therefore, a service. A district consumer forum in Tamil Nadu awarded Rs. 5,000 compensation to N Arasakumaram, who had filed an right to information application relating to answers in a test for recruiting teachers, a delayed response to which cost him a government job. In second case, a Chennai consumer forum held the public information officer of Tamil Nadu State Information Commission liable for “deficiency of service” for failing to provide information. He was asked to pay a compensation of Rs. 5,000 to right to information applicant B Ramesh. The third case is from Pune consumer forum which asked the Maharashtra Directorate of Technical Education to pay compensation of Rs. 10,000 to right to information applicant KR Kakade for delay in providing information. Kakade had sought information regarding his employment with the institute but failed to get any response. Such consumer court orders may open a Pandora’s box as any unsatisfied RTI applicant can now file petitions against public information officers and seek compensation.

Officer fined for not divulging RTI info Reported by deccanchroncile.com on 06.05.2013 Officer fined for not divulging RTI info | Deccan Chronicle Chennai: A teacher who appeared for the Teacher Eligibi*lity Test sued the TRB (Teacher Recruitment Board) for causing severe mental agony to him by not giving correct ans*wers in the RTI reply for three questions which appeared in the exam. The court ordered the TRB official to pay Rs 5,000 as compensation to the litigant. N. Arasakumaran of Karur filed a complaint with the Karur consu*mer court in December 2012 saying that he took the economics exam as a part of the TET exam in May 2012 and hoped he would get through and secure a government job. “When I verified the answers with the blue print released by TRB online, I was surprised to see that in the case of three questions, two answers were given for each question and in the case of another set of three questions, answers were not given. I sent an RTI petition to TRB regarding the confusion in these answers and also attached a guide that gives the correct answer. I also sought details on appointment of teachers through caste-based reservation,” he said in his petition. Since the TRB official failed to respond to Arasakumaran’s RTI petition within the stipulated period, he moved the consumer court seeking compensation for the mental agony he suffered. He argued that if he had received the information on time, he would have approached the officials and could have landed the job. Ruling that non-furnishing of information to Arasakumaran amounted to deficiency of service, consumer court judge P. Ramakrishnan and member P. Vishakan ordered the public information officer to pay Rs 5,000 as compensation for the mental agony caused to Arasakumaran and Rs 500 as litigation costs within two months.
  10. Hi, I want to know how many cases are there against "country club" in consumer courts all over India. Is it possible to get this information thru RTI ? Do i need to request each consumer court separately or single request will provide information? And also please let me know the process of request.This is the first time i am planing to use RTI.   11. Hi Sir, Do High Courts have any jurisdiction over the Consumer Cases initiated under any section(s) of the Consumer Protection Act -1986(As Amended upto date)? If so, pl. define the prescribed procedural details, and if not why Hon'ble Delhi High Court is exceeding its jurisdiction in the Consumer Matters and the Consumer cases against M/s. Triveni Infrastructure Development Co. Ltd., New Delhi while their jurisdiction (both original and and appellate) exclusively and entirely vests in the Consumer courts (Distt., Forum, State commission and National Commission and finally with the Hon'ble Supreme court. What is the remedy for the hundreds of aggrieved Consumers of the services of the defaulting company who are coerced to take their cases to a Committee Court created by the Hon'ble Delhi High Court, even when they have already been decided by the proper and appropriate Consumer Fora. One such case is Execution case No.504 of 2010 u/s27 of CPA -1986 Sandeep Maheshwari Vs. the Developers still pending before the Hon'ble Distt. Forum No. X, Qutub Institutional Area, New Delhi-110 016 since more than a year?. there could be several such cases as the notorious company has gravely and severely defaulted in providing the necessary services for which they have collected huge sums for their various projects from the hundreds of Consumers. Even vested with the powers of !st Class Magistrate, the Consumer courts for reasons better known to them are shying away from awarding the defaulting company the deterrent punishment and prison term as provided under the Consumer Protection Law.
  12. An applicant under the RTI act is also a consumer. I understand that the applicant can approach the consumer court in case information is not provided by the CPIO. My query is whether the applicant submit the first appeal and simulatneously file a petition in the consumer court? Will the consumer court direct the PIO to provide the information or just grant the compensation to the applicant? Whether non-supply of information can be the ground for getting compensation or the applicant has to prove something more?
